EXISTING LAND USE & ZONING:
This subject lot is developed with a 2,575 square foot commercial
building and is zoned C-2.
SURROUNDING LAND USES & ZONING:
North: Mixed Commercial; zoned C-2
South: Single-Family Residential; unincorporated L.A. County
East: Mixed Commercial and Light Industrial; zoned CoM and C-2
West: Mixed Commercial; zoned C-2
GENERAL PLAN DESIGNATION: Commercial
BACKGROUND
The subject 2,500 square foot building was built in 1982 as a bank, and in 1998 was
converted to a leaming center for 45 students under CUP 98.023. The learning
center relocated approximately one year ago and the current applicant is proposing a
day care center for up to 45 children at the project site. Sec. 9275.3 of the Municipal
Code allows nursery schools (day care centers) with an approved conditional use
permit.
PROPOSAL
The proposed day care center would be located within the existing 2,500 square foot
commercial building, and would accommodate a maximum of 45 children. The
proposed hours of operation are from 7:30 a.m. to 6:30 p.m. A driveway with a drop
off area is accessed from the alley off of Myrtus Avenue and exits onto Live Oak
Avenue. as shown on the submitted site plan. The parking area is accessed from a
separate driveway off of Myrtus Avenue. The drop off area is separate from the
parking area, which is a desired feature for day care centers as it eliminates conflict
between pedestrian and vehicular traffic.
Currently, there are 16 on site parking spaces, which were required for the original
financial use. The applicant proposes to convert five parking spaces to an outdoor
play area. A six-foot tall decorative wrought iron perimeter fence would secure the
proposed play area. The play area is 3,920 square feet. and is in compliance with
the amount of outdoor play area required pursuant to Sec. 9275.3.3 of the Municipal
Code.
CUP 04-006
June 8, 2004
Page 2
e Parking
Based on the code requirements, day care uses require one parking space for every
10 children if an adequate drop off area is provided, and one space for each staff
member. After the outdoor play area is constructed. 11 parking spaces shall remain.
A day care center with 45 children requires five parking spaces plus one space for
each staff member. Therefore, the proposed day care would have enough parking
for 45 children and six staff members.
ANALYSIS
The former bank building has adequate parking. drop off and pick up areas, and will
be improved with a secured outdoor play area. The proposed project is in
conformance with Sec. 9275.3 of the Municipal Code regarding "nursery schools.
and will also require approval for the State Department of Social Services. It is the
opinion of staff that the proposed use is appropriate for the project site.
Other Code Reauirements
The applicant is required to comply with all development requirements and policies
determined to be necessary by the Building Official. Fire Marshall, Community
Development Administrator, and the State of California.
e CEOA
Pursuant to the prOVIsions of the California Environmental Quality Act, the
Development Services Department prepared an Initial Study for the proposed
project. Said Initial Study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air. water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole. there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:
1. That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare or injurious to the property or improvements in such
zone or vicinity.

DETERMINATION (To be completed by lheLead Agency)
On the basis of this initial evaluation:
[X] I find that the proposed project COULD NOT have a significant effect on the
environment, and a NEGATIVE DECLARATION will be prepared.
[] I find that although the proposed project could have a significant .effect on the
environment, there will not be a significant effect in this case because the

mitigation measures described on an attached sheet have been added to the
project. A NEGATIVE DECLARATION will be prepared.
[ ]
I find that the proposed project MAY have a significant effect on the
environment. an ENVIRONMENTAL IMPACT REPORT is required.
[ ]
I find that the proposed project MAY have a significant effect on the environment.
but that at least one effect has been adequately analyzed in an earlier document
pursuant to applicable legal standards and has been addressed by mitigation
measures based on that earlier analysis as described on attached sheets, and if
any remaining effect is a "Potentially Significant Impact" or "Potentially
Significant Unless Mitigated," an ENVIRONMENTAL IMPACT REPORT is
required, but it only needs to analyze the effects that have not yet been
addressed.
[ ]
I find that although the proposed project could have a significant effect on the
environment, there WILL NOT be a significant effect in this case because all
potentially significant effects have been analyzed adequately in an earlier
Environmental Impact Report pursuant to applicable standards alid have been
avoided or mitigated pursuant to that earlier EIR, including revisions or mitigation
measures that are imposed upon the proposed project.

EVAlUATION OF ENVIRONMENTAl IMPACTS:
,. A brief explanation is required for all answers except UNo Impact' answers that are adequately
supported by the information sources a lead agency cites in the parentheses following each quesllon.
A uNo Impact" answer is adequately supported if the referenced Information sources show that the
impact simply does not apply to projects such as the one involved (e.g., the project is not within a
fault rupture zone). A uNo Impact' answer should be explained where Ills based on project-specific
factors as well as general standards (e.g., the project will not expose sensitive receptors to
pollutants, based on a project-specific screening analysts).
2. All answers must take account of the whole action Involved, inclUding off-site as well as on-slle,
cumulative as well as project-level, indirect es well as direct, and construction related as well es
operatIonal impacts.

3. 'Potentially Significant Impacf' is appropriate if there is substantial evidence that an effect is
significant. If there are one or more, 'Potentially Significant Impacf' entries when the determination is
made, an Environmental Impact Report is required.
4. 'Potentially Significant Unless Mitigation Incorporated" applies where the incorporation of mitigation
measures has reduced an effect from 'Potentially Significant Impacf to a 'Less Than Significant
Impact." The lead agency must describe the mitigation measures. and briefly explain how they
reduce the effect to a less than significant level (mitigation measures from Section 17 "Eariier
Analyses" may be cross-referenced). .
5. Earlier analyses may be used where, pursuant to the tiering, program Environmental Impact Report,
or other CECA process, an effect has been adequately analyzed In an eariier EIR or Negative
Declaration {Section 15063(c)(3)(D)). Eariier analyses are discussed in Section 17 at the end of the
checklist.
a)
b)
Eariier Analyses Used: Identify and state where lheyare available for review.
Impacts Adequately Addressed. Identify which effects from the above checklist were within the
scope of and adequately analyzed In an eariier document pursuant to applicable legal
standards, and state whether such effects were addressed by mitigation measures based on
the earlier analysis.
c)
Mitigation Measures. For effects that are 'Less than Significant with Mitigation Measures
Incorporated,' describe' the mitigation measures that were incorporated or refined from the
eariier document and the extent to which they address site-specific conditions for the project.
6. Lead agencies are encouraged to incorporate Into the checklist, references to information sources
for potential impacts (e.g,. general plans, zoning ordinances). Reference to a previously prepared or
outside document should, where appropriate, Include a reference to the page or pages where the
statement is substantiated.
7. Supporting Information Sources. A source list should be attached, and other sources used or
individuals contacted should be cited in the discussion.
8. The explanation of each Issue should identify:
a) The significance criteria or threshold. if any. used to evaluate each question; and
b) The mitigation measure identified. if any. to reduce the impact to less than significant.
