CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 04-006 TO OPERATE A DAY CARE CENTER WITH A MAXIMUM NUMBER OF 45 CHILDREN AND SIX STAFF MEMBERS AT 100 E. LIVE OAK AVENUE. - WHEREAS, on June 8, 2004, a conditional use permit application was filed by Badjuan Xu to establish a day care center with a maximum number of 45 children (Development Services Department Case No. C.U.P. 04-006) at property commonly known as 100 E. Live Oak Avenue; and WHEREAS, a public hearing was held on June 8, 2004, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE. THE PLANNING COMMISSION OF THE CITY OF . ARCADIA RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity because the initial study did not disclose any substantial adverse effects to the area affected by the proposed project. 2. That the use applied for at the location indicated is a proper one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces. walls, fences, loading, landscaping and other features including the shared parking with the neighboring business, . are adequate to adjust said use with the land and uses in the neighborhood. The . . . proposed project complies with all related zoning requirements as set forth in the Arcadia Municipal Code. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan because the land use and current zoning are consistent with the General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 04-006, to operate a day care center with a maximum number of 45 students and six staff members. upon the following conditions: 1. The use approved by CUP 04-006 is limited to a day care center with a maximum of 45 children and six staff members. The day care center shall be operated and maintained in a manner that is consistent with the proposal and plans submitted and approved for CUP 04-006, and any expansion upon the use approved shall require approval of a separate conditional use permit. 2 1708 . 2. That the drive approach off Myrtus Avenue adjacent to the proposed outdoor play area is removed and replaced with curb, gutter and sidewalk to the satisfaction of the Engineering Services Division. 3. The applicant shall comply with the provisions of the City of Arcadia Municipal Code Section 9275.3 regarding "nursery schools', and shall comply with all applicable State regulations for day care centers. 4. A separate sign design review application shall be submitted for all new signs on the premises. . 5. The applicant shall defend, indemnify, and hold hannless the City of Arcadia and its officers, employees. and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action. or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The . 3 1708 . City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. 6. Approval of CUP 04-006 shall not take effect until the property owner(s), and applicants have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. SECTION 4. Lambert, Associate Planner SUBJECT: Conditional Use Permit Application No. CUP 04-006 to allow a day care facility with a maximum number of 45 children at 100 E. Live Oak Avenue. SUMMARY - This Conditional Use Permit application was submitted by Badjuan Xu to allow a day care facility with a maximum number of 45 children to be within an existing commercial building at 100 E. Live Oak Avenue. The Development Services Department is recommending approval of this application, subject to the conditions of approval listed in this report. GENERAL INFORMATION APPLICANT: Badjuan Xu LOCATION: 100 E. Live Oak Avenue REQUEST: A Conditional Use Permit to allow a day care facility with a maximum number of 45 children at 100 E. Live Oak Avenue. SITE AREA: 17.941 square feet (.41 acres) FRONTAGES: Approximately 95 feet on Live Oak Avenue Approximately 170 feet on Myrtus Avenue CUP 04-006 June 8, 2004 Page 1 e e e EXISTING LAND USE & ZONING: This subject lot is developed with a 2,575 square foot commercial building and is zoned C-2. SURROUNDING LAND USES & ZONING: North: Mixed Commercial; zoned C-2 South: Single-Family Residential; unincorporated L.A. County East: Mixed Commercial and Light Industrial; zoned CoM and C-2 West: Mixed Commercial; zoned C-2 GENERAL PLAN DESIGNATION: Commercial BACKGROUND The subject 2,500 square foot building was built in 1982 as a bank, and in 1998 was converted to a leaming center for 45 students under CUP 98.023. The learning center relocated approximately one year ago and the current applicant is proposing a day care center for up to 45 children at the project site. Sec. 9275.3 of the Municipal Code allows nursery schools (day care centers) with an approved conditional use permit. PROPOSAL The proposed day care center would be located within the existing 2,500 square foot commercial building, and would accommodate a maximum of 45 children. The proposed hours of operation are from 7:30 a.m. to 6:30 p.m. A driveway with a drop off area is accessed from the alley off of Myrtus Avenue and exits onto Live Oak Avenue. as shown on the submitted site plan. The parking area is accessed from a separate driveway off of Myrtus Avenue. The drop off area is separate from the parking area, which is a desired feature for day care centers as it eliminates conflict between pedestrian and vehicular traffic. Currently, there are 16 on site parking spaces, which were required for the original financial use. The applicant proposes to convert five parking spaces to an outdoor play area. A six-foot tall decorative wrought iron perimeter fence would secure the proposed play area. The play area is 3,920 square feet. and is in compliance with the amount of outdoor play area required pursuant to Sec. 9275.3.3 of the Municipal Code. CUP 04-006 June 8, 2004 Page 2 e Parking Based on the code requirements, day care uses require one parking space for every 10 children if an adequate drop off area is provided, and one space for each staff member. After the outdoor play area is constructed. 11 parking spaces shall remain. A day care center with 45 children requires five parking spaces plus one space for each staff member. Therefore, the proposed day care would have enough parking for 45 children and six staff members. ANALYSIS The former bank building has adequate parking. drop off and pick up areas, and will be improved with a secured outdoor play area. The proposed project is in conformance with Sec. 9275.3 of the Municipal Code regarding "nursery schools. and will also require approval for the State Department of Social Services. It is the opinion of staff that the proposed use is appropriate for the project site. Other Code Reauirements The applicant is required to comply with all development requirements and policies determined to be necessary by the Building Official. Fire Marshall, Community Development Administrator, and the State of California. e CEOA Pursuant to the prOVIsions of the California Environmental Quality Act, the Development Services Department prepared an Initial Study for the proposed project. Said Initial Study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air. water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole. there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. - CUP 04-006 June 8, 2004 Page 3 e 2. That the use applied for at the location indicated is properly one for which a Conditional Use Pennit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces. walls, fences. parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. RECOMMENDATION The Development Services Department recommends approval of Conditional Use Pennit Application No. <?UP 04-006. subject to the following conditions: 1. The use approved by CUP 04-006 is limited to a day care center with a maximum of 45 children and six staff members. The day care center shall be operated and maintained in a manner that is consistent with the proposal and plans submitted and approved for CUP 04-006, and any expansion upon the use approved shall require approval of a separate conditional use penn it. e 2. That the drive approach off Myrtus Avenue adjacent to the proposed outdoor play area is removed and replaced with curb, gutter and sidewalk to the satisfaction of the Engineering Services Division. 3. PLANNING COMMISSION ACTION Approval The Planning Commission should move to adopt approve CondItional Use Permit Application No. CUP 04..Q06 and adopt Resolution No. 1708 approving a day care center with a maximum number of 45 children and six staff members at 100 E. Live Oak Avenue. Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should state the specific reasons for denial and direct staff to prepare the appropriate resolution incorporating the Commission's decision and specific findings.
