HomeMy WebLinkAbout1706 . . - RESOLUTION NO. 1706 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 2004-004 FOR A VOCATIONAL SCHOOL WITH 80 STUDENTS IN TWO EXISTING INDUSTRIAL BUILDINGS WITH A COMBINED FLOOR AREA OF 14,109 SO.FT. AT 5417 PECK ROAD. WHEREAS, on April 12, 2004, a conditional use permit application was filed by C2G, Architect, for a vocational school with 80 students (Development Services Department Case No. CUP 2004-004) at property commonly known as 5417 Peck Road; and WHEREAS, a public hearing was held on May 11, 2004, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity beceuse the initial study did not disclose any substantial adverse effects to the area affected by the proposed project. 2. That the use applied for at the location indicated is a proper one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, loading, landscaping and other features including the shared parking with the neighboring business, are adequate to adjust said use with the land and uses in the neighborhood. The proposed project complies with all related zoning requirements as set forth in the Arcadia Municipal Code. . '. .~ 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan because the land use and current zoning are consistent with the General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 2004-004, for a vocational school with ao students at 5417 Peck Road, upon the following conditions: 1. The maximum number of students, at anyone time, shall not exceed eighty (80). 2. The parking lot shaff be restriped and landscaped per the Arcadia Municipal Code, subject to the approval of the Development Services Department. 3. The use approved by CUP 2004-004 is limited to the vocational school and office. The school and office shall be operated and maintained in a manner that is consistent with the proposal and plans submitted and approved for CUP 2004-004. 4. A separate sign design review application shall be submitted for all new signs on the premises. 5. Any exterior alteration to the building requires the filing and approval of a design review application. 6. All conditions of approval shall be complied with prior to opening the school and office. Noncompliance with the plans, provisions and conditions of approval for CUP 2004-004 shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing of the school and office. 2 1706 :. 7. All City code requirements regarding accessibility, fire protection, occupancy, and safety shall be complied vfflh to the satisfaction of Building Services and the Fire Department. 8. Approval of CUP 2004-004 shall not take effect until the property owner(s), <!nd applicants have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. 9. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of May 11, 2004, by the following votes: . Road. SUMMARY This Conditional Use Permit was submitted by Michael Chait, architect on behalf of the Cement Masons Southem California Trust Fund, for a vocational school with 80 students in two existing industrial buildings with a combined floor area of 14,109 sq.ft.at 5317 Peck Road. The Development Services Department is recommending approval of this application subject to the conditions in this staff report. GENERAL INFORMATION APPLICANT: Michael Chait (Architect) LOCATION: 5317 Peck Road REQUEST: A Conditional Use Permit for a vocational school with 80 students in two existing industrial buildings with a combined floor area of 14,109 sq.ft., at the subject location LOT AREA: 72,000 sq.ft. (1.65 acre) FRONTAGE: 240 feet along Peck Road EXISTING LAND USE & ZONING: The subject property is improved with two industrial buildings with a combined floor area of 14,109 sq.ft., and is zoned M-1. e e e ~> SURROUNDING LAND USES & ZONING: North: Industrial Use; zone M-1 South: Vacant Land; zone M-1 East: Industrial Use; City of EI Monte West: Water Conservation Park; unzoned GENERAL PLAN DESIGNATION: Industrial BACKGROUND The subject property was previously occupied by Terminix Intemational Company since 1983, and has been vacant since the company relocated in 2002. Cement Masons Southern Califomia Trust Funds currently have several campuses throughout Southem California to provide training for cement and masonry work. The capacity of the proposed school at the subject location would be very similar to their other operations. An attendance survey of their Whittier school site shows an average attendance of 57 students per session. PROPOSAL AND ANALYSIS The applicant is requesting a Conditional Use Permit for a vocational school with 80 students and an administrative office, which will utilize the existing buildings on the site, as shown on the submitted site plan. They plan to utilize the front building, a two-story building with 6,584 sq.ft. of floor area, as an administrative office area. The rear building, a single-story building with 7,525 sq.ft., will be used for instructional purposes. As mentioned above, there is an average attendance of 57 students at the facility in Whittier, CA. The applicant anticipates a similar attendance for the subject site but is applying for 80 students to allow for a potential increase in attendance. Classes will be offered on Saturdays from 8:00 a.m. to 4:00 p.m., and additional classes with reduced enrollment may be offered on weekdays during the aftemoon and early evening hours. This program would be open to qualified persons who wish to obtain skills in the building trades. The training program would also offer continuing training opportunities for apprenticeship advancement. There will be up to 8 instructors. The administrative offices include management, accounting, and clerical activities. There will be approximately 18-20 employees. The office hours will be Monday through Friday, 8:00 a.m. to 5:00 p.m. A vocational school is a permitted use in the,M-1 zone with an approved conditional use permit. CUP 2004-004 May 11, 2004 Page 2 e Parkina The applicant is proposing to restripe the existing parking lot to provide 86 on site parking spaces. Based on the current code requirements, a vocational school with 7,525 sq.ft. of instructional area requires 215 parking spaces, Le., one space for every 35 sq.ft. of instructional area. This would result in an overall parking deficiency of 129 spaces. However, under the proposed changes to the parking regulations, trade schools are required to provide 1 space for every 3 students and 1 space for every employee. Based on these calculations, the proposed use would require 27 spaces for students and 28 spaces for employees (20 office employees plus 8 instructors), for a total of 55 spaces. Therefore, the proposed parking would have an excess of 31 parking spaces under the proposed new code. In staffs opinion, the proposed on-site parking should be adequate provided that the maximum number of students does not exceed 80 and that the school encourages ride- sharing. CODE REQUIREMENTS All City requirements regarding disabled access and facilities, occupancy limits, building safety, health code compliance, parking and site design shall be complied with to the satisfaction of the Building Official, Community Development Administrator, Fire Marshall, and Public Works Services Director. . Any exterior improvements, such as any new signs, sign face changes, and awnings shall be subject to architectural design review and approval by the Community Development Division. CEQA Pursuant to the provisions of the Califomia Environmental Quality Act, the Development Services Department has prepared an Initial Study for the proposed project. Said Initial Study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: -- ~~ / CUP 2004-004 May 11, 2004 Page 3 e e . ~ 1. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit Application No. CUP 2004-004, subject to the following conditions: 1. PLANNING COMMISSION ACTION Approval The Planning Commission should move to approve Conditional Use Permit Application No. CUP 2004..Q04, and direct staff to prepare a resolution to approve CUP 2004..Q04 for a vocational school and office at 5417 Peck Road. Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should state the specific reasons for denial and direct staff to prepare the appropriate resolution incorporating the 'Commission's decision and specific findings. The proposed use of the site is commercial and institutional. The Cement Masons Southern California Trust Funds will occupy the site. The existing 2-story office building will house administrative offices, and the I-story accessory building will house a vocational training program for their building trade. The training program curriculum is attached. Modifications to existing site improvements will be limited to parking stall striping. No modifications to the existing structures are proposed. 12. The project sponsor is currently in contract to purchase the property. The sale of the property is contingent on the approval of the CUP application for the use of the property by the project sponsor. If the CUP is approved by the City of Arcadia, then the project sponsor will move to occupy and use the site. 18. The administrative offices include management, accounting and clerical activities; with approximately 18-20 employees. The offices will be open 5 days per week, Monday through Friday, during nonnal working hours, approximately 8:00 am to 5:00pm. The training program includes office and classroom areas for training administration and vocational education; with approximately 10 employees; including instructors. The training program will occur each Saturday of each month, from 8:00am through 4:00pm, and accommodate between lOO-ISO students. The curriculum for the training program is attached as Exhibit B. The training program is open to qualified persons wishing to gain valuable and necessary skills in the building trades. The training program also offers continuing training opportunities for apprenticeship advancement. 19. According to the City of Arcadia Planning Department staff, the proposed use of the site for administrative offices and vocational training requires a Conditional Use Permit. We suggest that the proposed useis consistent with the intent of the zone (M-l). 35. The site is fully improved with two free standing buildings, asphalt and concrete paving, perimeter fencing and walls, and landscape and parking areas. The two buildings include a two-story office building along the Peck Road frontage, and a one- story accessory structure in the rear area of the site. The site was constructed for, and previously occupied by a pest exterminating company. See attached photographs. 36. The site is located on,the west side of Peck Road.
