A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, APPROVING CONDmONAL USE PERMIT NO.
2004-003 AND ARCIDTECTURAL DESIGN REVIEW NO. 2003-044 FOR A
506 SQ.Ff. WIRELESS COMMUNICATIONS EQUIPMENT ENCLOSURE
AND A FIFTY-FOOT (50') TALL MONOPOLE ANTENNA STRUCTURE
CAMOUFLAGED AS A PALM TREE (MONOPALM) AT 20 E. FOOTIllLL
BOULEVARD.
WHEREAS, on March 18, 2004, a conditional use permit application was filed
by SBA Network Services, Inc. for a 506 sq.ft, wireless communications equipment
enclosure and a fifty-foot (50') tall monopole antenna structure camouflaged as a palm
tree (monopalm) (Development Services Department Case No. CUP 2004-003 and ADR
2003-044) at property commonly known as 20E. Foothill Boulevard; and
WHEREAS, a public bearing was held on April 27, 2004, at which time all
interested persons were given full opportunity to be heard and to present evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA RESOL YES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare, or injurious to the property or improvements in such zone or
vicinity because the initial study did not disclose any substantial adverse effects to the area
affected by the proposed project.
2. That the use applied for at the location indicated is a proper one for which a
Conditional Use Pennit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, loading, landscaping and other
features including the shared parking with the neighboring business, are adequate to adjust
said use with the land and uses in the neighborhood. The proposed project complies with
. all related zoning requirements as set forth in the Arcadia Municipal Code.

4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan because the land use and current zoning are consistent with
the General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants
Conditional Use Permit No. CUP 2004-003 and Architectural Design Review No. ADR
2003-044, for a 506 sq.ft. wireless communications equipment enclosure and a fifty-foot
(50') tall monopole antenna structure camouflaged as a palm tree (monopalm) at 20 E.
Foothill Boulevard, upon the following conditions:
1. Two (2) forty-foot (40') tall live palm trees shall be planted by the monopalm.
2. The concrete masonry wall and landscaping around the facility shall match the
existing trash enclosure and landscaping adjacent to the site.
3. All City code requirements regarding accessibility, fire protection, occupancy,
and safety shall be complied with to the satisfaction of Building Services, Public Works
ServiceS, Development Services, and the Fire Department.
4. The proposed wireless communications facility including its colors and
materials shall be maintained in a manner that is consistent with the plans and materials
subDlitted and approved for CUP 2004-003 and ADR 2003-044.
5. Noncompliance with the plans, provisions and conditions of approval for CUP
2004-003 shall be grounds for immediate suspension or revocation of any approvals.
6. Approval of CUP 2004-003 and ADR 2003-044 shall not take effect until the
property owner(s), and applicants have executed and filed the Acceptance Form available
from the Development Services Department to indicate awareness and acceptance of these
conditions of approval.
7. The applicant shall defend, indemnify, and hold harmless the City of Arcadia
and its officers, employees, and agents from and against any claim, action, or proceeding

against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or
annul any approval or condition of approval of the City of Arcadia concerning this project
and/or land use decision, including but not limited to any approval or condition of
approval of the City Council, Planning Commission, or City Stat( which action is brought
within the time period provided for in Government Code Section 66499.37 or other
provision oflaw applicable to this project or decision. The City shall promptly notify the
applicant of any claim, action, or proceeding concerning the project andlor land use
decision and the City shall cooperate fully in the defense of the matter. The City reserves
the right, at its own option, to choose its own attorney to represent the City, its officers,
employees, and agents in the defense of the matter.
SECTION 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of April 27, 2004, by the following votes:
A YES: Commissioners Hsu, Lucas, Wen, Olson, Baderian
NOES: None
SECTION S. The Secretary shall certifY to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUBJECT: Conditional Use Permit Application No. CUP 2004-003 and Architectural
Design Review No. ADR 2003-044 for a 506 sq.ft. wireless
communications facility at 20 E. Foothill Boulevard.
SUMMARY
Conditional Use Permit No. CUP 2004-03 and Architectural Design Review No. ADR
2003-044 were submitted by SBA Network Services, representing Cingular Wireless, to
construct a wireless communications facility, consisting of a 506 sq.ft. wireless
communications equipment enclosure and a fifty-foot (50') tall monopole antenna
structure camouflaged as a palm tree (monopalm) at 20 E. Foothill Boulevard. The
Development Services Department is recommending approval of these applications and
adoption of Resolution No. 1705 subject to the conditions in this staff report.
GENERAL INFORMATION
APPLICANT: SBA Network Services (Representative of Cingular Wireless)
LOCATION: 20 E. Foothill Boulevard
REQUEST: A Conditional Use Permit and Architectural Design Review for a 506
sq.ft. wireless communications equipment enclosure and a fifty-foot
(50') tall monopole antenna structure camouflaged as a palm tree
(monopalm).
LOT AREA: 59,978 sq.ft. (1.38 acre)

FRONTAGE: 148 feet along Foothill Boulevard
EXISTING LAND USE & ZONING:
The subject property is improved with a 25,000 sq.ft. office building
constructed in 1980, and is zoned C-2.
SURROUNDING LAND USES & ZONING:
North: Commercial retail center; zoned G-2
South: Single-family dwellings; zoned R-1
East: Escrow office; zoned C-2
West: Laundry service; zoned C-2
GENERAL PLAN DESIGNATION:
Commercial
PROPOSAL
Communications equipment facilities are permitted in any zone with a Conditional Use
Permit (AMC Sec. 9275.1.11). The proposed location for the monopalm antenna and
its equipment is a 506 sq.ft. area located near the center of the subject property. The
proposed antennas will be mounted on a fifty-foot (50') tall monopalm located within the
subject area with block wall screening. The proposed screening will match the colors
and materials of the existing trash enclosure adjacent to the subject area.
The applicant is also requesting a height modification of 50'-0. in lieu of the 40'-0"
maximum building height permitted in the C-2 zone. The additional height is requested
because it is necessary to provide the best level of service. By code, rnechanical
equipment and its screening on top of a 40'-0" tall building can extend 10'-0" above the
roof of the building. Therefore, the proposed 50'tall antenna would not exceed the
maximum height allowable for mechanical equipment and its screening on top of a roof.
ANALYSIS
Uses such as this wireless communications equipment facility are permitted in any zone
with an approved Conditional Use Permit (AMC Sec. 9275.1.11). The new equipment
enclosure and the 50' tall monopalm will not decrease the number of parking spaces for
the commercial office building. Based upon the applicant's proposal and location it is
staff's opinion that the proposed monopalm will be an appropriate use for the
commercial site.
Architectural Desion Review
Concurrent with the consideration of the Conditional Use Permit. the Planning
Commission may approve, conditionally approve, or disapprove the applicant's
architectural design concept plans.

The 50-foot tall monopole antenna structure is proposed to be camouflaged as a palm
tree, also referred to as monopalm. To further camouflage the monopalm, the applicant
is also proposing to plant two (2) forty-foot (40') tall live palm trees by the structure.
Furthermore, the proposed masonry wall enclosure and landscaping will match the
existing trash enclosure and landscaping adjacent to the subject site.
In staff's opinion, the proposed structure will be visually harmonious with existing
buildings and structures, and surrounding development, and will enhance the
appearance of the area; staff finds the proposed architectural design concept to be in
compliance with the City's Architectural Design Review Regulations.
Code Reouirements
The proposed project is required to comply with all Code requirements and policies as
determined to be necessary by the Building Official, Fire Marshall, City Engineer,
Community Development Administrator, and Public Works Services Director, and are to
be determined by having fully detailed construction plans submitted for plan check
review and approval.
CEQA
Pursuant to the provisions of the California Environmental Quality Act, the Development
Services Department has prepared an Initial Study for the proposed project. Said Initial
Study did not disclose any substantial or potentially substantial adverse change in any
of the physical conditions within the area affected by the project including land, air,
water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic
significance. When considering the record as a whole, there is no evidence that the
proposed project will have any potential for adverse effect on wildlife resources or the
habitat upon which the wildlife depends. Therefore, a Negative Declaration has been
prepared for this project.
FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:
1. That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare or injurious to the property or improvements in such zone
or vicinity.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping, and other features required to adjust said use with the land and
uses in the neighborhood.

RECOMMENDATION

The Development Services Department recommends approval of Conditional Use
Permit Application No. CUP 2004-003 and Architectural Design Review No. ADR 03-
044, subject to the following conditions:

2. The color and material of the wall and landscaping around the facility shall match

PLANNING COMMISSION ACTION
Approval
The Planning Cornrnission should move to approve and file the Negative
Declaration and adopt Resolution No. 1705: a Resolution of the Planning
Cornrnlsslon of the City of Arcadia, California, granting Conditional Use Permit
No. CUP 2004-003 and approving Architectural Design Review No. ADR 03-044 for
a 506 sq.ft. wireless cornrnunications equipment enclosure and a fifty-foot (50')
tall rnonopole antenna structure carnouflaged as a palrn tree (rnonopalm) at 20 E.
Foothill Boulevard.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application, the
Commission should state the specific reasons for denial and direct staff to prepare the
appropriate resolution incorporating the Commission's decision and specific findings.

Proposal for a Cingular Wireless Telecommunications Facility

Project Description
Cingular Wireless (CW) is proposing to develop a wireless telecommunications designed
as a 50 ft. monopalm. CW's project will consist of twelve (12) panel antennas and four
(4) Base Transceiver Station (BTS) equipment cabinets. The 12 panel antennas will be
concealed within and painted to match the color of the foliage of the palm fronds. The
four (4) BTS units will be concealed within a block wall enclosure with landscaping. The
blockwall and the landscaping will match the block wall and landscaping for the trash
enclosure. Two (2) 40' real live palm will be installed adjacent to CWs facility to further
camouflage the facility. This facility has been designed so that it will not affect the
aesthetics, functionally and/or use of the existing property and will be compatible with
the surrounding environment.
Zoning Consistency & Justification
The location, size, design, and operating characteristics of the proposed
telecommunications facility will create no impact on circulation systems, generate no
noise, odor or smoke. Furthermore, the facility will not create any adverse impacts that
are detrimental or incompatible with other permitted uses in the vicinity. The proposed
facility will be screened from all views.
The equipment associated with the facility operates virtually noise-free, does not emit
fumes, smoke, dust, or odors. The proposed facility will be in operation 24 hours per
day, 7 days a week and will only require routine maintenance only every 4 to 6 weeks.
The proposed telecommunications facility will not result in conditions or circumstances
contrary to the public health, safety, and the general welfare. The facility will operate in
full compliance with the regulations and licensing requirements of the FCC, FAA, and
CPUC as govemed by the Telecommunications Act of 1996.
Unlike other land uses, which can be spatially determined through the General Plan the
location of wireless telecommunication facilities is based on technical reqUirements
which include service area, geographical elevations, alignment with surrounding sites
and customer demand components. Placement within the urban geography is
dependent on these requirements. Consequently, wireless telecommunication facilities
have been located adjacent to and within all major land use categories inclUding
residential, commercial, industrial, open space, etc. proving to be compatible in all
locations.

Wireless telecommunication networks enhance the general welfare of communities by
providing a resilient communications system in the event of emergencies (earthquakes,
fires, traffic accidents, etc.) whereas land line communications systems are often
disrupted during and after a major incident. In addition, wireless telecommunication
networks add an additional layer of communications infrastructure with little to no
construction disruption to the community.
Network Design
The proposed communications facility will transmit at a frequency range of between
1850 MHz and 1990 MHz. A typical PCS facility operates at 200 watts. Depending on
the unique characteristics of the site, the actual power requirements may vary. When
operational, the radio signals from the site will consist of non-ionizing waves generated
at less than 1 uW/cm2, which is significantly lower than the maximum allowable public
exposure of 1,000 microwatts as set by the American National Standards Institute
(ANSI) and Institute of Electrical and Electronic Engineers (IEEE).
The distance between antenna sites will normally range trom Yz mile to 9 miles,
depending on the population density, consumer usage, existing vertical elements, and
the geographical terrain. In order to have a clear line-ot-site; antennas must be mounted
high enough to overcome challenges posed by local topography and development.
Telephone calls can originate or be received from a wireless facility because antennas
share a fixed number of frequencies across the network grid. As the caller is traveling
through the network the call is continuously being handecklff between wireless facilities
to provide an uninterrupted telephone conversation. The following are some of the basic
types of cell sites:
Coverage sites serve to expand coverage in large areas orin areas with difficult terrain
and to enhance coverage for portable systems. Coverage sites allow users to make and
maintain calls as they travel between cells.
Capacity sites serve to increase the capacity when surrounding sites have reached
their practical channel limits. As the years pass, the number or subscribers increases
exponentially creating a strain on the existing network. In order to alleviate this strain,
capacity sites are implemented into the systems network to accommodate the increase
in customer demand.

enclosure and a fifty-foot (50') tall monopole antenna structure camouflaged as a palm
tree (monopalm) (Development.Services Department Case No. CUP 2004-003 and ADR
2003-044) at property commonly known as 20 E. Foothill Boulevard; and
WHEREAS, a public hearing was held on April 27, 2004, at which time all
interested persons were given' full. opportunity to be heard and to present'evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
e ARCADIA RESOL YES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity because the initial study did not disclose any substantial adverse effects to the
area affected by the proposed project.
2. That the use applied for at the location indicated is a proper one for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, loading, landscaping and other
features including the shared parking with the neighboring business, are adequate to
adjust said use with the land and uses in the neighborhood. The proposed project
complies with all related zoning requirements as set forth in the Arcadia Municipal Code.

4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan because the land use and current zoning are consistent with
the General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will have any potei1tial for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants
Conditional Use Permit No. CUP 2004-003 and Architectural Design Review No. ADR
2003-044, for a 506sq.ft. wireless communications equipment enclosure and a fifty-foot
(SO') tall monopole antenna structure camouflaged as a palm tree (monopalm) at 20 E.
Foothill Boulevard, upon the following conditions:
I. Two (2) forty-foot (40') tall live palm trees shall be planted by the monopaJrn.
2. The concrete masonry wall and landscaping around the facility shall match the
existing trash enclosure and landscaping adjacent to the site.
3. All City code requirements regarding accessibility, fire protection, occupancy,
, and safety shall be complied with to the satisfaction of Building Services, Public Works
Services, Development Services, and the Fire Department.
4. The proposed wireless communications facility including its colors and
materials shall be maintained.in a manner that is consistent with the plans and materials
submitted and approved for CUP 2004-003 and ADR 2003-044.
5. Noncompliance with the plans, provisions and conditions of approval for CUP
2004-003 shall be grounds for immediate suspension or revocation of any approvals.
6. Approval of CUP 2004-003 and ADR 2003-044 shall not take effect until the
property owner(s), and applicants have executed and filed the Acceptance Form available
from the Development Services Department to indicate awareness and acceptance of
these conditions of approval.
7. The applicant shall defend, indemnify, and hold harmless the City of Arcadia
and its officers, employees, and agents from and against any claim, action, or proceeding

against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or
annul any approval or condition of approval of the City of Arcadia concerning this project
and/or land use decision, including but not limited to any approval or condition of
approval of the City Council, Planning Commission, or City Staff, which action is
brought within the time period provided for in Government Code Section 66499.3 7 or
other provision oflawapplicable to this project or decision. The City shall promptly
notil)' the applicant of any claim, action, or proceeding concerning the project and/or land
use decision and the City shall cooperate fully in the defense of the matter. The City
reserves the right, at its own option, to choose its own attorney to represent the City, its
officers, employees, and agents in the defense of the matter.
SECTION 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of April 27, 2004, by the following vote:

Resolution and shall cause a copy to be forwarded to the City Council of the City of
