RESOLUTION NO. 523 ~ff~C~~l ~',:>1~!1 [ ~~""~1' I~" Y , I' ; , d j ; 'I j: " .:J ,.lL,c ~ ' I,.: A RESOLUTION OF THE CITY PLANNIN COMl1ISSION OF THE CITY OF ARCADIA CALIFORNIA, RECO~~ENDING THE GRANTING OF A ZONE VARIANCE TO PERMIT THE USE FOR RED CROSS CHAPTER OFFICES OF AN EXISTING ONE-STORY SINGLE-FAMILY DltJELLING IN ZONE R-3 AT 166 BONITA STREET IN SAID CITY. vnIEREAS, there was filed with this Commission on the 18th day of June, 1964, the application of the Arcadia Chapter American National Red Cross by John W. parker, Chapter Chairman, for a zone variance to permit the use for Red Cross Chapter offices of an existing one-story single family dwelling in Zone R-3 located at 166 Bonita St~eet in the . City of Arcadia, County of Los Angeles, State of California, which property is described as follows: The East 95 feet of Lots 19, 20 and 21 of Block 65 of Arcadia Tract No. 866, per map recorded in Book 18, pages 198 and 199, of Maps, Official Records of said County; and, WHEREAS, after due notice as required by the Zoning Ordinance of said City, a public hearing was duly held on the matter by and before this Commission on the 14th day of July, 1964, at I'lhich time all inter- ested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY P1A}il~ING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETE~lINES AND RESOLVES AS FOLLOWS: . SECTION 1. That the intended use of subject property con- stitutes an exceptional circumstance that does not apply to the class of use in the same vicinity and zone. That the granting of the variance for the limited period hereinafter recommended will not adversely affect the comprehensive general plan. That the granting of the variance as hereinafter recommended will not be materially detrimental to the pub- lie health or welfare or injurious to the property or improvements in the same zone or vicinity in which the property is located. SECTION 2. That for the foregoine; reasons this Commission recommends to the City Council that a variance be granted to permit the use of the above described property for Red Cross Chapter offices conditions: -1- 523 v ..... . . . . . . 1. That the period of the variance be limited to five (5) years from and after the date of adoption of the resolution of the City Council granting the same, and that such use shall thereupon cease with- out necessity of further action by the City of Arcadia, unless prior to such time the property be reclassified to a zone permitting such use or the variance be duly extended. 2. That twenty (20) feet of existing concrete sidewalk at the northeast corner of subject property be removed and reconstructed to proper grade. 3. That a five (5) foot concrete sidewalk along Second Avenue be constructed per City Standard #lL~8 leaving bricked-up tree Hells to the satisfaction of the Department of Public ~'Iorks. 4. That a drainage inlet at existing driveway be installed per City Standard #148. 5. That the easterly 12 feet of property and corner cut-off be dedicated for future widening of Second Avenue. 6. That the unpaved portion of the rear yard be paved per Department of Public Works standards. 7. That a five (5) foot high decorative wood fence or masonry wall be constructed parallel to and three (3) feet west of the adjusted property line along Second Avenue, such fence or wall to be required to turn west and connect with the existing garage per approval by the Planning Department. 8. That the same type fence or wall five (5) feet high be constructed along the south property line to a point where the existing driveway begins. 9. That an eighteen (l8) inch concrete gutter be constructed at the northeast curb return and along Second Avenue. 10. That the area betl'leen the fence or tJall and the sidewalk along Second Avenue be planted, irrigated and maintained. 11. That all structures on the property be painted. 12. That the total aggregate of all signs on the property shall not exceed 16 feet. -2- 523 ..... ~ . . . SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy hereof to be forwarded to the City Council of the City of Arcadia. July 14, 1964 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: ZONE VARIANCE APPLICATION V-64-12, PARKING LOTS FIRST BAPTIST CHURCH OF TEMPLE CITY - SOUTH BALDWIN AVE. 1. APPLICATION The opplication filed by the First Baptist Church af Temple City requests a zone variance to permit the use of two Zone R-l lots for church parking lot purposes. 2. SUBJECT PROPERTY AND SURROUNDING LAND USE The church, itself, is located on the sauthwest corner of Baldwin and Woodruff Avenues, completely within the boundaries of Temple City. The proposed parking lots are located and improved as follows: Parking Lot No. I on the northwest corner of Baldwin and Woodruff Avenues on Zone R-3 land, has a house and garage shown to be removed. Thirty-two (32) parking spaces are proposed on th is lot. Parking Lot No.2, on the northeast corner of Baldwin and Woodruff Avenues, on Zone R-l land has a house and garoge which are proposed to remain on a 45 ft. wide lot with twenty-two (22) parking spaces developed adjacent to the house on the property. The parking areas are both within the City of Arcadia and are surrounded by residentially-zoned and improved properties. ANALYSIS This application, as in the case bf applications dealing with non-profit, charitable and religious organizatians,poses special problems and considerations in terms of equity. Yet the sole and legitimate purpose of a variance is to modify the application of a zoning ordinance to bring the privilege of the subject property to a parity with other properties similiarly locoted and c1assfied. In the case of the subject application, it has not been established that the subject property would be deprived of privileges commonly enjoyed by other properties in the same vicinity ond zone. - 1 - ". .., . . . . . . v - 64 - 12 Poge Two July 14, 1964 Therefore, from 0 zoning viewpoint, the proposed C1Pplication fails to meet the most basic and prime requisite for approval. From a planning viewpoint, the isolation of these two parking areas from the area of major activity, by traffic right-of-way, appears to be highly undesirable, particularly in the areas of traffic movement interference and pedestrian safety. Sound site planning principles would require the provision of parking on property immediately adjacent to the church ond school activities. The Planning Department, although entirely sympathetic with the parking needs of the church, cannot in good conscience recommend the approval of the use of two isolate4 ,f!arking sites and, therefore, recommends that the opplication be denied. If, on the other hand, the Planning Commission decides to approve this variance, such approval should be based upon conditions of approval to be determined and presented to the Planning Commission ot the next regularly scheduled meeting of July 28, 1964. July 14, 1964 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: V-64-11 RED CROSS CHAPTER 166 BONITA AVENUE The American Red Cross, Arcodia Chapter, proposes to purchase the property at 166 Bon ita Avenue. Th is property is 95 feet wide and 160 feet in depth. On the property is amold frome house and a detached garoge. The property is in Zone R-3-H. Adjacent to the property on the ~est is a one-story apartment building. The subject property is also located in the Central Area Plan area. The Central Area Pion and recent decisions about the pion and the area are used as reference points in evaluating this proposal. 1. The Central Area Plan shows the area best suited for multiple-family residential s tru ctu res. 2. The areas shown on the pion suitable for this type of use were office areos on First Avenue, south of Huntington Drive; and on Santa Anita Avenue, north of Huntington Drive. Based on the plan, there appeors to be no justification for deviating from it. This is even more evident when the recent actions of the Commission and Council are considered, i.e., opproval of the plan, approval of Zone H for the orea, approval of new community commercial zone, approval of amending Zone C-1 and M-], approval of reclassifying property into these districts with provisions for placing this type of use in Zone C-l-D. From the ordinance viewpoint, the Code specifically states four prerequisite conditions which shall be met if a variance is granted. Copies of these conditions, along with the applicant's answers are attached for your consideration. The property does not have any exceptional, extraordinary circumstances, or conditions that are generally applicable to other property in the same zone. - 1 - .. . . .~.. ....,. . V-64-11 July 14, 1964 Page Two The granting of the variance would introduce a use not permitted in the zone, and further the use would occupy 0 non-conforming building. (Single-family structures in Zone R-3 are non-conforming); therefore, this use would be considered as prolonging the life of a non- conforming structure which in itself is detrimentol to the general welfare of the area. The other properties in the area are not permitted to be used for office use. Therefore, why should the subject property? The use of the subject property will adversely affect the comprehensive plan for the area because if the component parts of the plan, i. e., each lot is not compelled to develop in compl iance with the approved pion, the area when fully developed will bear little resemblonce to the pion that was proposed studied, considered and approved. The Plonning Department is completely sympathetic with the excellent work of the Red Cross; however, based on the prerequisites required for gronting a variance and good planning principles, . it must recommend that the appl ication not be approved. If the Planning Commission considers opproving this application, it is recommended that the conditions of approval be presented at the next meeting of the Commission on July 28, 1964. d/~~ WILLIAM PHELPS, Planning Director .
