A RESOLUTION OF TliE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECO~lliNDING THE GRANTING OF A VARIANCE TO PERMIT THE FILLING OF AN ABANDONED GRAVEL PIT UPON SPECIFIED CONDITIONS. ...........-...---...... _. -~.; IfrffiREAS, there was filed with this Commission the application of l-lax Goldring for a variance to permit the fillins of an abandoned '" ~ ,- gravel pit located on Lots 121 through 155, 18L~ throu;;h 220, 249 througn 291 and 315 throU~l 359 of the Chicago Park Tract in the City of Arcadia, pursuant to which after notice required by the Zoning Ordinance of said City, a public hearing was duly held on said matter by and be- fore this Commission on June 23, 1964, at which time all interested per- sons were given full opportunity to be heard and to present evidence; . NO\'I, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLO\'1S: SECTION 1. That subject property, though located in Zones 1.1-1 and D, consists for the most part of an abandoned gravel pit, makinc subject property totally unfit for any surface use. That in order to be usable for any purpose permitted under its present zoninc;, the prop- erty must be broue;ht up to grade. That the condition of the property constitutes an exceptional circumstance applicable to the property in- volved that does not apply Generally to the property or class of use in the same zone or vicinity. That the granting of the requested vari- ance, under' the conditions l1ereinafter recornmended, \Iill not be materially detrimental to the publiC health or welfare or injurious to the property . or improvements in the zone or vicinity in \'Ihich the property is located. That the granting of the variance to permit the filling of the existinc; pit is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and viCinity, to wit, the use of the surface of his property. the granting of such variance will not adversely affect the com- rehensive general plan. -1- 520 v . . . , ,- . SECTION 2. For the foreGoing reasons this Commission recom- mends to the City Council that a variance be Granted to permit the sanitary fill to be conducted upon subject property upon the following conditions: 1. All filling operations shall be conducted to State of California Regional Water Pollution Control Board standards and speci- fications, and notice of their approval submitted to the City of Arcadia. 2. Compaction specifications and programming to the satis- faction of the Public Works Department shall be prepared by a soils engineer or a geologist approved by the City of Arcadia prior to the commencement of filling operations. . 3. Site entrance locations shall be approved by the Depart- ment of Public Works. 4. That the variance shall expire five (5) years after the date on which the same is granted by the City Council, and all fill operations shall be completed within said time. SECTION 3. The SecretaF.f shall certify to the adoption of this re:!lolution and shall cause a copy hereof to be forwarded to the City Council of the City of Arcadia. June 23, 1964 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: ZONE VARIANCE APPLICATION V 64-9 AVENUE, EAST OF PECK ROAD GRAVEL PIT SOUTH OF LIVE OAK APPLICATION This applicatio~ filed in the name of Max Goldring, seeks permission to allow the filling of an abandoned gravel pit which is located on Lots 315 through 359 consecutively, Lots 249 through 291 consecutively, Lots 184 through 220 consecutively and Lots 121 through 155 consecutively, of the Chicago Park Tract in the City of Arcadia and generally located south of State Street, 'north of Clark Street and east of Myrtle Avenue. The variance application is necessary since the original quarrying operation was granted under a special use permit. The Planning Department is desirous of eliminating the present gravel pit as an eyesore and making this land available for future industrial uses. Variance application V 64-9 is, therefore, recommended for approval, subject to compliance with the following conditions of approval: A. All filling operations shall be conducted to State of California Regional Water Pollution Control Board standards and specifications, and notice of their approval submitted to the City of Arcadia. B. Compaction specifications and programming to the satisfaction of the Public Works Department shall be prepared by a soils engineer or a geologist approved by the City of Arcadia prior to the commencement of filling operations.
