RESOLUTION NO. 511 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A SPECIAL USE PERMIT TO ALLOW THE CONSTRUCTION AND OPERATION OF A DRAG STRIP FOR AUTOMOBILE RACING AND RELATED PURPOSES ON PROPERTY LOCATED IN THE CITY OF ARCADIA. WHEREAS, there was filed with this Commission on the 16th day of January, 1964 the application of Soland Corporation as Lessee for a special use permit to allow the construction and operation of a drag strip for automobile racing and related purposes on property located in the City of Arcadia, County of Los Angeles, State of Cali- fornia, described as follows: . That portion of Lot 1 of Tract No. 10369, in the City of Arcadia, County of Los Angeles, State of California, per map recorded in Book 149, pages 95 and 96, of Maps, in the office of the County Recorder of said County, lying westerly and northwesterly of the westerly line of the land described in the condemnation Action Case No. 574211 Superior Court of said County, a certified copy of the Decree had in said action was recorded in Book 38373, page 153, Official Records of said County; EXCEPT ,an undivided 75 per cent of all oil, gas and other hydrocarbon substances in and under said land, with right of ingress and egress necessary for the mining and removal of same, as reserved by Martin Wunderlick, E. Murielle Wunderlick, George P. Leonard and Wilma Leonard, by deed recorded February 4, 1955, as Instrument No. 470, in Book 46821, page 149, Official Records; and, . WHEREAS, after due notice as required by the Zoning Ordinance of said City, a public hearing originally scheduled for February 11, 1964 and duly continued, was held on the matter by and before this , Commission on March 24, 1964, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: -1- 511 v . . . SECTION 1. That the site proposed is partially in Arcadia and partially in the City of Irwindale. That the portion of the drag strip proposed in Arcadia is located just north of the intersection of Lower Azusa Road with the Los Angeles County Flood Control Channel. That the entrance to the site is located in Arcadia approximately 650 feet easterly of, the intersection of Roseglen street, Durfee AVenue and Lower Azusa Road. That in the unincorporated territory both to the West and Southwest of subject property, there are substantial residentially dev.eloped areas adjacent to the subject site. That the granting of the r.equested special use permit will be extremely detri- mental and harmful to the public health or welfare and particularly injurious to such properties and improvements in the vicinity in which the property is located. That according to the applicant's testimony . the racing facility will parallel and be immediately adjacent to the proposed County Equestrian Trail. That when the proposed drag strip is in use it would be extremely dangerous to horses and horsemen. That SUbject property is presently zoned M-2 with a special use per- mit for the development of natural resources, particularly rock, sand and gravel. That at the time such property was granted such special use permit it was alleged and found by this Commission to be true . that the material in subject property is prime aggregate in high de- mand and very valuable. That the granting of the special use permit is not necessary to prevent financial hardship to the property owner and if anything the presently proposed use of the property will only tend to postpone the profitable extraction of the natural resources contained therein. That there appears to be no exceptional or extra- ordinary circumstances or conditions applicable to the property in- volved that do not apply generally to the property or class of use in the same zone. That the granting of the requested special use permit is not necessary for the preservation or enjoyment of a sub- stantial property ~ight possessed by other property in the same zone . r vicinity; on the contrary the denial of the requested special use -2- 511 ~ ' , . . . permit is necessary for the preservation and enjoyment of the sub- stantial property rights of the immediately adjacent residential properties. SECTION 2. That for the foregoing reasons, this Commis- sion recommends to the City Council that the requested special use permit for the construction and operation of a drag strip for auto- mobile racing and related purposes on the above-described property be denied. SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded to the City Council of the City of Arcadia. STEVENS RE: APPLICATION FOR ZONE VARIANCE BY SOLAND CORPORATION Gentlemen: .' I , Inasmuch as the hearing on Tuesday, March 16, 1964 was so lengthy and I did not have the op~ortunity of adequately rebutting the opponents to,the application of Soland Corporation, ,1 am sending you my comments to the opposition's remark's in writing in hopes that you will consider them in making your'determinations in this matter. One thing must be clearly borne in mind . \ - the nature of . .: the property and area in which they are seeking this zone variance. The area is a quarry and heavy manufacturing area, , ,\ which industries could be all,owed to operate in this area daily with heavy deisel trucks' and equipment, rock crushers, bull dozers and other equipmerit which is both noisy and dirty in the sense of raising dust. The ordinary use .of this property for which it is zoned would be'a continuous operation and not one such as the d'rag strip which woul.d h~ one day per week. In my opinion I can see no liability whatsoever to the City of Arcadia, Irwindale or Soland Corporation,for, noiSe i l I -" , i I" i,., nuisance on one afternoon a week. Furthermore, Soland Cur- , " poration maintains an insurance policy providing for liability of $200,CDO per persvn and $400,000 pPI." OCt'lIlTt't1Cl' which should more than (lover any contemplated lialjillty. ..1- ,. ~ . . . The decrease in property value was made an issue by one of the opponents. He mentioned the drop in Inglewood of property values due to the airport and race tracks. It was entirely a different situation in Inglewood, the integration of certain neighborhoods had an effect upon the property values and also the continuous noise factor, i.e., airplanes, is unique in itself. Furthermore, the reference to the Ascot Race Track involves a different type of continuous car racing. These facts regarding property values can be substantiated by savings and loan appraisers with whom I have talked re- garding this matter. The horse trail problem was raised by various members of the opposition. At the old drag strip the trail was not fenced and the horses and riders were straying onto the drag strip property. In fact, I am informed that many riders of horses would stop and observe the race as they would pass rather than avoid the use of the trails during the operation of the drag strip. Soland is not aware of any incident involving a horse that shied from the operation of t~e strip endangering the life of' 'the rider or any other person. The beer cans and debris referred to along the trails are not an incident to the drag strip but I believe, are'a result, of other people parking there and riding up and down the trails. Reference was made to dairymen within the area who would object to the drag strip operation. I believe the absence of any objection from a dairyman would indicate their tacit approval or at least ~ their disapproval of the application before' you. Much noise was made by housewifes concerning the.present and speculated future of drag racing up and down, the residential area of Norwood Village. We are seeking by the operation of the drag strip to control this drag racing snd I believe the 'proll lem chat thl! housewifes have expll1:f encud woul d cl,.-l ,11 11'1 Y be reduced by allowing the teenagers to have a controlled . ,', . -2- ...IIIIIl .-.---c~... . . . . place to race their cars. We do not propose to use any residential streets as ingress or egress to the track and the speculation about increased traffic in the residential areas, I believe,'i's' unwarranted and without foundation. The gentleman in oppqsition who spoke concerning the fact that he is awakened by a pin dropping and moved away from freeways, will be greatly surprised by the San Gabriel Valley Freeway which is on the drawing boards to be placed in the area along the San Gabriel Valley Wash. Suffice it to say, you gentlemen can always find a hypersensitive person ~posing any legitimate business. The gentleman in opposition whose name was "Fur,. like a fur coat and then add a couple of Rah Rahs"., seemed to be present just to find out what was going on and was so educated in the hearing by the economics of the drag strip that he would like to buy stock,in it. However, speaking of economics, the drag strip would be gener,ating about $3,000 per year in a 1% of the admission fee tax to the City ot: Arcadia. The other persons who ,objected seem to be concerned with the controlling of traffic, including the installation of stop signs ,and lights in the area. I believe this could be very well. provided for in a joint venture with the Soland Corporation and the City of Arcadia if they were necessary. As a fin~l1 objection, a' lady brought up the point that there were sorne deaths at the drag strip before. It is I11Y understanding that drag racing is somewhat dangerous, and if deaths occur, they will occur at any drag strip wherever they will be. It should be pointed out that these deaths were not due to !:iots, fighting or anything of this nat'ure" but were due to accidents on the drag strip while racing. ',I . . -3- , . _ l. f:.."._' .- .-. .-.'.. ~ I .~'...~ ----.r... - . . . .- ~ ,-' c ._~ ...-....... <,' In conclusion, I believe if you gentlemen will seriously consider the nature of this area, the uses that C4n be made of the property as it is now zoned, the traffic generated by quarries and heavy industry. the objectionable fellttll'(~S of quarrying and heavy industry, and the real lack of any substantial objection to the drag strip operation, you should find in favor of the application. In fact, the opposition to it. seems to be mainly a hysterical reaction to what used to be a bad ward, namely, drag racing. I believe you gentlemen are better informed, than the people who opposed this application. As a final point, it has come to my' attention that my position, in relation to the City of Irwindale and Soland Corporation was not made too clear. I have no financial interest whatso- ever in Soland Corporation. I hac;! nothing whatsoever to do with'the, filing of the application for a conditional use permit, in Irwindale. In fact I was .not even present during the lrwindale hearing. However, when the decision was being made I was present and disqualified myself. To provide the Commission with an up-to-date report describing the proposed use; 2. To provide the Planning Department's recommendations and appropriate development conditions. . APPLlCA TION: This is the application of Soland Corporation seeking a Special Use Permit to allow the construction of a Drag Strip for automobile racing purposes. SUBJECT PROPERTY AND SURROUNDING LAND USES: The site is proposed partially in Arcadia and partially in Irwindale. The portion of the Drag Strip proposed in Arcadia is located just north of the intersection of Lower Azusa Road with the L.A.County Flood Control channel. The entrance to the site is locoted in Arcadia approximately 650 ft. easterly of the intersection of Roseglen Street, Durfee Avenue ond Lower Azuso Rood (See maps attached). The property owned by Rodeffer Industries is presently vacant and is not being osed for quarrying purposes. There are substantial county residentially developed areas bath to the west and to the southwest of the subject site. . - 1 - .- . . . Drag Strip March 24, 1964 Page Two PROPOSED DEVELOPMENT: The following uses describe the activities which are proposed to take place within Arcadia's portion of the Drag Strip: A. Ingress and egress roads for spectators and participants, B. Pit entrances. C. Classifying area. D. Trailer parking. E. De-acceleration strip with return road to pit area. The balonce of the proposed development, including the major activity areas, are located within Irwindale's baundaries. These consist of: . A. Spectator parking area - 3200 automobiles. B. Spectator bleachers - 5000 seats. C. Snack bars and rest rooms. D. Observation tower. E. Pit areas. F. The race track (1/4 mile) itself. CHARACTERISTICS OF THE USE: The following outline represents the major characteristics of the total proposed Drag Strip development: A. Use Once weekly, generally Saturdays 2:00P.M. to 10:30 P.M. - Apri I through November (2:00 P. M. to 7:00 P. M. practice) (7:00 P.M, to 10:00 P.M. trials) Sundays - 9:00 A.M. - 4:30 P.M. December through March (9:00 A. M. to 1 :00 P. M. practice) 1:00 P.M. to 4:00 P.M. trials} 2 day meets - five yearly 3 day meet - one yearly B. Charges: 25(: to park - no incame to city $1. 50 per person admission charge (NOTE: City will be given 1% of gross receipts.) There will be no alcohol ic beverages sold on entire site. Total racing time 8.9 seconds along 1/4 mile track - Engines are then cut ond auto's de-accelerate with chutes. C. Genera I . Between the dragster races, hot rod races will take place on the track. - 2 - . . . Drag Strip March 24, 1964 Page 3. ANALYSIS, Zoning is essentially a means of insuring that land uses are properly situated to one another. As an exercise of the police power, it must be based upon reasonable and substantial relationship to the public health, safety, morals and general welfare. A prime requisit in the consideration in the granting of relief from the established zoning is that such relief will not be detrimental to public health or welfare or injurious to the property or improvements in such zone or vicinity. It is considered opinion of the Planning Department that the Drag Strip is proposed in a location where there is not sufficient space for buffering the noise of the activities proposed thereon from the substantial residential areas nearby. . The Planning Department, although in full sympathy with the needs of such a faci I ity in the San Gabriel Valley, considers the proposed Drag Strip incompatible and unacceptable for this reason and, therefore, recommends its denial. If, however, the Planning Commission decides to approve Special Use Application No. V-64-2, the following conditions should be made a part of such approval: 1. The payment of a set fee to the City of Arcadia based upon a percentage of the gross receipts shall be determined by mutual agreement of the City Manager and the operators of the Drag Strip. Such agreement shall be in a form meeting with the approval of the City Attorney. 2. Disposal of drainage from this site shall be into the San Gabriel River, in a manner approved by the Los Angeles County Flood Control District and the City of Arcadia. 3. The entrances and exists shall be designed at right angles to Lower Azusa Road, and meet with the approval of the Department of Public Works. 4. All driveways, parking areas and roadways shall be paved with asphaltic concrete. ProvIsions shall be made to confine all traffic to the paved driveways and roadways, subject to the approval of the Department of Ilubli c Works. . 5. The portion of Lower Azusa Road abutting the project shall be improved with curbs, gutters and street light, as required by the Department of Public Works. -3- -- .' .. . . Drag Strip March 24, 1964 Page 4 . 6. All lighting of these facilities shall be shielded and directed away from nearby streets and residential areas. 7. All signs on the site shall be approved by Planning Department. Signs shall be so located as to provide no sight restrictions to internal or external traffic. 8. Complete working drawings, specifications, including landscaping plans shall be submitted to and approved by the Planning COrl)mission prior to the start of construction. Such plans shall include improve- ments for the entire site. 9. The City Planning Commission shall reserve the right without necessity of further notice or hearing to make minor modifications of any of the foregoing conditions, if such modification will achieve substantially the same results and will in no way be detrimental to adjacent properties or improvements than will the strict compl iance with said conditions. . PLANNING DEPARTMENT FROM: SUBJECT: SPECIAL USE APPLICATION V-64-2 DRAG STRIP - roWER AZUSA ROAD The purpose of this report will be twq-fald: 1. To provide the Commission with an up-to-date report describing the proposed use; 2. To provide the Planning Department's recommendations and appropriate development conditions. . APPLlCA TION: This is the application of Soland Corporation seeking a Special Use Permit to allow the construction of a Drag Strip for automobile racing purposes. SUBJECT PROPERTY AND SURROUNDING LAND USES: The site is proposed partially in Arcadia and partially in Irwindale. The portion of the Drag Strip proposed in Arcadia is located just north of the intersection of Lower Azusa Road with the L.A. County Flood Control channel. The entrance to the site is located in Arcadia approximately 650 ft. easterly of the intersection of Roseglen Street, Durfee Avenue and Lower Azuso Road (See maps attached). The property owned by Rodeffer Industries is presently vacant and is not being used for quarrying purposes. There are substantial county residentially developed areas both to the west and to the southwest of the subject site. . - 1 - "- ... . . . Drag Strip March 24, 1964 Page Two PROPOSED DEVELOPMENT: The following uses describe the activities which are proposed to take place within Arcadia's portion of the Drag Strip: A. Ingress and egress roads for spectators and participants, B. Pit entrances. C. Clossifying area. D. Trailer parking. E. De-acceleration strip with return road to pit area. The balance of the proposed development, including the major activity areas, are located within Irwindale's boundaries. These consist of: . A. Spectator parking area - 3200 automobiles. B. Spectator bleachers - 5000 seats. C. Snack bars and rest rooms. D. Observation tower. E. Pit areas. F. The race track (1/4 mile) itself. CHARACTERISTICS OF THE USE: The following outline represents the major characteristics of the total proposed Drag Strip development: A. Use Once weekly, generally Saturdays 2:00 P.M. to 10:30 P.M. - April through November (2:00 P.M. to 7:00 P.M. practice) (7:00 P.M. to 10:00 P.M. trials) Sundays - 9:00 A.M. - 4:30 P.M. December through March (9:00A.M. to 1:00 P.M, practice) 1:00 P.M. to 4:00 P.M. trials) 2 day meets - five yearly 3 day meet - one yearly B. Charges: 25~ to park - no income to city $1 .50 per person adm ission charge (NOTE: City will be given 1% of gross receipts.) . C. General There will be no alcoholic beverages sold on entire site. Total racing time 8.9 seconds along 1/4 mile track - Engines are then cut and auto's de-accelerate with chutes. Between the dragster races, hot rod races will take place on the track. - 2 - '" . . . Drag Strip March 24, 1964 Page 3. ANALYSIS: Zoning is essentially a means of insuring that land uses are properly situated to one another. As an exercise of the police power, it must be based upon reasonable and substantial relationship to the public health, safety, morals and general welfare. A prime requisit in the consideration in the granting of relief from the established zoning is thot such relief will not be detrimental to public health or welfare or injurious to the property or improvements in such zone or vicinity. It is considered opinion of the Planning Department that the Drag Strip is proposed in a location where there is not sufficient space for buffering the noise of the activities proposed thereon from the substantial residential areas nearby. . The Planning Department, although in full sympathy with the needs of such a foci I ity in the San Gabriel Valley, considers the proposed Drag Strip incompatible and unacceptable for this reason and, therefore, recommends its denial. If, however, the Planning Commission decides to approve Special Use Application No. V-64-2, the fallowing conditions should be made a part of such approval: 1. The payment of a set fee to the City of Arcadia based upon a percentage of the gross receipts shall be determined by mutual agreement of the City Manager and the operators of the Drag Strip. Such agreement shall be in a form meeting with the approval of the City Attorney. 2. Disposal of drainage from this site shall be into the San Gabriel River, in a manner approved by the Los Angeles County Flood Control District and the City of Arcadia. 3. The entrances and exists shall be designed at right angles to Lower Azusa Road, and meet with the approval of the Department of Public Works. 4. All driveways, parking areas and roadways shall be paved with asphaltic concrete. Provisions shall be made to confine all traffic to the paved driveways and roadways, subject to the approval of the Department of Rubli c Works. . 5. The portion of Lower Azusa Road abutting the project shall be improved with curbs, gutters and street light, as required by the Department of Public Works. -3- .'- . . . Drag Strip March 24, 1964 Page 4 6. All lighting of these facilities shall be shielded and directed away from nearby streets and residential areas. 7. All signs on the site shall be approved by Planning Department. Signs shall be so located as to provide no sight restrictions to internal or external traffic. 8. Complete working drawings, specifications, including landscaping plans shall be submitted to and approved by the Planning Commission prior to the start of construction. Such plans shall include improve- ments for the entire site. 9. The City Planning Commission shall reserve the right without necessity of further notice or hearing to make minor modifications of any of the foregoing conditions, if such modification will achieve substnntially the same results and will in no way be detrimental to adjacent properties or improvements than will the strict compl iance with said conditions. .
