RESOLUTION NO. 509
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, DENYING THE APPEAL FROM
AND AFFIRMING THE DECISION OF THE
MODIFICATION COMMITTEE DENYING THE
REQUEST FOR MODIFICATION OF THE SET-
BACK REQUIREMENTS ON PROPERTY LOCATED
AT 1050 SAN CARLOS ROAD IN SAID CITY.
WHEREAS, there was riled with the Modification Committee of
the City of Arcadia on February 2, 1964, the application of E. A.
Daniell, Jr., as owner, for modification of the setback requirements
to permit the construction of a house within twelve (12) feet of Foot-
hill Boulevard on property located at 1050 San Carlos Road in the City
of Arcadia, County of Los Angeles, State of California, described as
follows:

That portion of lot 7 of Tract No. 948, in the City of
Arcadia, County of Los Angeles, State of California,
as shown on map recorded in Book 17, page 21, of Maps,
in the office of the County Recorder of said County,
including a portion of San Carlos Road (60 feet wide)
as shown on and dedicated by the map of Tract No.
15430 recorded in Book 470, pages 37 and 38, of Maps,
in the office of the County Recorder, bounded as
follows:
On the North by the north line of said lot 7; on the
South by the north line and west prolongation thereof,
of lot 1 of said Tract No. 15430; on the East by the
north prolongation of the east line of said lot 1 of
Tract No. 15430; and on the West by the center line and
north prolongation thereof, of said San Carlos Road.

EXCEPT that portion of said land described in the deed
to John Fiore and wife, recorded on November 1, 1962,
as Instrument No. 2174, in book D-1810, page 7,
official records; in said Recorder's office, more
particularly described as follows:
That portion of lot 7 of Tract No. 943, in the City
of Arcadia, County of Los Angeles, State of California,
per map recorded in Book 17, page 21, of Maps, in the
office of the County Recorder of said County, described
as follows:
Beginning at the intersection of the 'southerly line of
Foothill Boulevard, 80 feet in width, and the northerly
prolongation of the easterly line of lot 1 of Tract No.
15430, as shown on a map of said tract, recorded in

Book 470, pages 37 and 38, of Maps, records of said county;
thence South 880 41'10" West along said southerly line
of Foothill Boulevard, 105.00 feet to the beginning
of a tangent curve, concave to the southeast and having
a radius of 15.00 feet; thence southwesterly and southerly
along said curve, 23.56 feet; thence South 1018'50"
East 80.00 feet along the easterly line of San Carlos
Road, 60 feet in width, to the true point of beginning;
thence North 88041'10" East 120.00 feet to a pOint in
said northerly prolon~ation of the easterly line of lot
1 ,or said Tract No. :5430; distant thereon South 1018'50"
East 95.00 feet from the point of beginning; thence South
1018'50" East along said northerly prolongation 119.58
feet to the northeast corner of lot 1 of said Tract No.
15430; thence South 88041'10" West along the north line
of said lot 1, 120.00 feet to the northwest corner of
said lot 1; thence North 1018'50" West 119.58 feet to the
point of beginning;
and,

WHEREAS, after due notice as required by the Zoning Ordinance
of said City, a public hearing was duly held on the matter by and before
the Modification Committee on February 25, 1964, at which time the
requested modification was denied; and,
WHEREAS, on February 25, 1964, an appeal from said decision
of the Modification Committee was filed with this Commission by the
applicant; and
WHEREAS, such appeal from said decision was duly heard by and
before this Commission on the lOth day of March, 1964, at which time
all interested persons were given full opportunity to be heard and to
present evidence;
NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETERMINES
AND RESOLVES AS FOLLOWS :

SECTION 1. That relief has already been afforded the owner of
above described property in April of 1961 by modifying from 45 feet to
30 feet the setback applicable to said property; that with such modified
setback subject property can readily and properly be used and developed
the same as other lots similarly located. That the requested further
modification is not necessary to secure an appropriate improvement of a

lot, or to prevent unreasonable hardship.
That adherence to the present
setback rather than the modification thereof is necessary to promote
uniformity of development in the area.
SECTION 2. That for the foregoing reasons, the appeal from
the said decision of the Modification Committee is hereby denied and
this Commission does hereby affirm the decision of the Modification
Committee disapproving the request for a modification of the setback
requirements of the above-described property.
SECTION 3. The Secretary shall certify to the adoption of
this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
