RESOLUTION NO. 508 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A ZONE VARIANCE TO ALLOW THE CONSTRUCTION OF A TEMPLE AND RELIGIOUS SCHOOL ON PROPERTY LOCATED AT 1111, 1115, 1119, 1121, 1125, 1133, 1203 AND 1205 SOUTH FIRST AVENUE IN SAID CITY. WHEREAS, there was filed with this Commission on the lOth day of February, 1964, the application of the Foothil~ Jewish Temple- Cente~, as optionee, and signed by Frank R. Ackerman, for a zone variance to allow the construction of a temple and religious school on property known as 1111, 1115, 1119, 1121, 1125, 1133,,,1203 and 1205 South First Avenue in the City of Arcadia, County of Los Angeles, ~ state of California, described as follows: Part of Lots No. 6 and 9, Arcadia Acreage Tract, per map recorded in Book 10 of Maps, page 18, in the office of the Recorder of said County; and, WHEREAS, after notice duly given as required by the Zoning Ordinance, a public hearing was duly held on the matter by and before this Commission on the 25th day of February, 1964, at which time all interested parties were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That the entire site is in Zone R-l and is en- . tirely surrounded by Zone R-l property. That the proposed facility is intended to serve not only Arcadia residents but residents of neighboring communities as well as representing a regional facility. That a Junior High SChool exists several hundred feet south of the proposed subJec~ site; that several hundred feet to the north is a church on the northwest corner of First Avenue and Christina Street -1- 508 v . . . ... . . on R-2 property zoned for church purposes. That the granting of the requested variance would provide an additional traffic generator in this single family neighborhood which would cause an excessive amount of automobile and pedestrian traffic in a purely residential neigh- borhood. SECTION 2. That there are no exceptional or extraordinary cirCumstances applicable to the property involved that do not apply g~nerally to the property or class of use in the same zone or vicinity; that the requested variance is not necessary for the preservation and enjoyment of a substantial property right of either the owner or the applicant possessed by other property in the same zone and vicinity; that the property is properly zoned and usable for single family resi- dential purposes; that the statement in the application "that as to the present owners. . the granting of this variance will permit them to realize more than the present fair market value for their property" is doubtless true but is not of itself a proper ground for granting the requested variance; that most R-l property would sell for more if usable for less restrictive purposes; that as to applicant- optionee, the requested variance is unnecessary as applicant owns other property in the City for which a variance for similar purposes was requested and two times granted, the first variance having been twice extended upon applicant's request and the second variance being still in effect. That the granting of the requested variance and the construction of a temple and religious school as proposed will be injurious to other properties in the same vicinity and zone. SECTION 3. M-64-12, 1050 San Carlos Road In April of 1961, the lot known os 320 West Foothill Boulevard was officially split into two parcels. A condition of approval of this lot split required that any new house constructed on the vacant lot fronting on San Carlos Road should maintain a minimum of 30 foot setback from Foothill Boulevard. The Planning Commission considered this setback appropriate for the following reasons: I. House on similar lot across San Carlos Road has a 30 foot setback on Foothill Boulevard, 2. Foothill Boulevard is a major arterial highway with heavy traffic loads. 3. Foothill Boulevard may require widening in the future. 4. Visual appearance of area will be better if this house conforms with minimum setbacks of other houses in the area. 5. On a 95 ft. wide lot a 30 ft. setback on a side yard would still allow for a proper building. On February 2, 1964, a modification application was filed with the City requesting relief from the special 30 ft. setback established by virtue of the lot split to allow construction of a house within 12 ft. of the Foothill Boulevard property. The Modification Committee denied this request and the decision was subsequently appealed to the Planning Commission. The properties for many thousands of feet to the south, east, and west of the subject site, with the exception of Dana Junior High School, are zoned for single family residential purposes. The properties immediately to the north are used for residential purposes until the northwest corner of Christina Street is reached wherein a church exists. North of the church, along First Avenue, the properties are zoned and used for commercial purposes. The site proposed for the subject temple and religious school presents several problems from a planning viewpoint. First and foremost of these relates to the subject's site location in the center of a single family area. The proposed facility is intended to serve not only Arcadia residents but residents of neighboring communities as well as representing a regional facility. Such facilities typi cally generate large volumes of automobile and pedestrian traffic. Good planning practice seeks ta separate those kinds of facilities from within single family areas and further seeks to place them in locations where they will have no detrimental effects whatsoever upon single family areas. The fact that an elementary school exists several hundred feet south of the proposed subject site and a church several hundred feet to the n orth,from a planning viewpoint:,only further demonstrates the need to preclude development of any additional traffic generators into this single family neighborhood. - 2 - . . . V-64-4 February 25, 1964 Page ~ Another problem concerning the site proposed for the subject development relates to the isolation of two large parcels of land, the total width of which is not wide enough to facilitate the installation of a cul-de-sac. A similar situation will exist south of the proposed subject site in the sense that (Ilthough six R-l lots are left between the proposed site and the Dana Junion High School, the total frontage of these six lots is far too much to be orderly developed into one cul-de-sac, (Ind far too I ittle to facil itate installation of two cul-de-sacs. Consequently, some of these large R-l lots could be precluded from orderly development and to make matters worse, they would be sandwiched between two, heavily used semi-public facilities. The Planning Commission is in sympathy with the growing needs for such a facility in the Arcadia area and is much impressed with the design layout and qual ity of the proposed development. On the other hand, the Planning Department considers the proposed location as inappropriate for this or any similar such development. If, however, the Planning Commission decides to approve the subject application, the following conditions should be mode a part of such approval: 1. The entire site shall be developed contempora'neously as a unit and as one building site. 2. Prior to any construction on the site all existing structures shall be removed or demolished in accordance with applicable codes. The structures located at 1125 South First Avenue shall also be removed or demol ished. 3. All utilities, including electrical and telephone lines, shall be installed underground, meeting with the approval of the Department of Public Works. 4. All curb cuts proposed for the site shall be in accordance with the standards on file in the Department of Public Works. These curb cut locations shall meet with the approval of the Department of Public Works. 5. Any service facilities placed an the roof shall be adequately screened and not exceed a height of five (5) feet. 6. The illumination of the buildings and parking areas shall be directed away from the neighboring properties and the public right-of-way. The parking lot I ight standards' shall not exceed six (6) feet in height. - ~ - . . . V-64-4 February 25, 1964 Page ~ 7. Install street I ights and street trees in the locations and to the standards meeting the approval of the Department of Publ ic Works. 8. Construct a six (6) ft. high ornamental masonry wall along the north, south, and west boundaries of the site. The height of the wall shall be reduced to a height not to exceed three (3) feet in the front yard area. The wall heights shall be measured from the adjoining properties. The wall shall measure not less than five feet six inches (5' 6") when measured within the site at points adjacent to the wall. 9. The height of the wall in front of the parking area abutting First Avenue shall be three (3) feet high and be of ornamental masonry materials. It shall be constructed ten (10) feet from and parallel to the east property line. The ten (10) foot strip between the wall and the east property line shall be landscaped and maintained. A five (5) foot wide planting area shall be located adjacent to all walls located on the exterior of this site. . 10. All planting areas shall be irrigated by means of a permanent underground sprinkler system. II. Curbed landscaped areas,!,not less than five (5) feet wide shall be I,ocated at the ends of all parking tiers in a manner approved by the Planning Department. 12. All planting areas shall be separated froin the parking lot paving by concrete curbing. 13. Sidewalks, five (5) feet wide, shall be constructed and installed, meeting with the approval of the Department of Public Works. 14. The parking lot layout, including width of aisles, size of stalls, direction of traffic flow, shall meet with the approval of the Department of Public Works. 15. The variance shall not be operative until complete working drawings have been submitted to and approved by the Planning Commission which shall be within one year of City Council approval of this application. These plans sholl be prepared by persons licensed in the State of California. 16. The City Planning Commission shall reserve the right, without necessity of further notice of hearing, to make minor modifications of any of the foregoing conditions, if such modification will achieve substantially the same results and will in no way be detrimental to adjacent properties or improvments than will the strict com- pliance with said conditions.
