RESOLUTION NO. 490 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE FOR THE ERECTION OF A CHURCH AND RELATED FACILITIES ON LOTS 11 AND 12 AND PORTIONS OF LOTS 10 AND 13 OF TRACT NO. 6074 ON THE SOUTH SIDE OF DUARTE ROAD WEST OF SANTA ANITA AVENUE IN SAID CITY. WHEREAS, pursuant to Section 9291.1 of the Arcadia Munici- pal Code the City Planning Commission on its own motion initiated proceedings for the purpose of ~o~sidering and making recommendations It'.o;vr. V- tN/I) concerning the granting of a variahce for church purposes upon the following described property in the City of Arcadia, described as follows: . Lots 11 and 12, the west 10 feet of Lot 10, and the east 9 feet of Lot 13, of Tract No. 6074, as shown on map recorded in Book 67, page 83, of Maps in the office of the Recorder of Los Angeles County; Except the northerly 12 feet thereof measured at right angles to the northerly lot lines; and, WHEREAS, after notice required by the Zoning Ordinance of said City, as amended, a public hearing was duly held on the matter by and before this Commission on the 23rd day of July, 1963, at which time all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETERMINES AND RESOLVES AS FOLLOWS: . SECTION 1. That the American Lutheran Church has hereto- fore obtained a variance for church purposes on property owned by it on the south side of Duarte Road westerly of City-owned property in said location. That the City is desirous of acquiring said church property in exchange for City-owned property hereinbefore described and the American Lutheran Church of Arcadia is Willing to make such exchange of properties. -1- 'J- ~~ ~"(J1 490 v . . . . SECTION 2. That the above-described property is proposed to be developed in a manner identical to the plan and elevation heretofore approved with respect to the Church's present site with two exceptions: a. The parking has been rearranged to facilitate the continuation of a thirty (30) foot wide alley; such alley to con- sist of a six (6) foot high wall and a five (5) foot wide planting strip on the south property line to provide a protective buffer and barrier for the single family residential uses south and twenty-five (25) feet of paving to facilitate a secondary supplemental means of traffic circulation for this and other similar developments that are . likely to materialize in the future. The new parking arrangement, although not taking full advantage of the available space for park- ing in terms of the potential number of parking stalls, nevertheless provides sixty-three (63) spaces and exceeds the previously approved plan which proposed fifty-seven (57) spaces. b. The educational building is proposed to be two (2) stories in height whereas a one (1) story educational building was originally proposed and approved. That the plan and elevation pro- posed for subject property are in the opinion of the Planning Depart- ment and Planning Commission an improvement over the original plot plan and elevation and will provide for better integration of the facilities in the neighborhood and provide better use of subject property. . SECTION 3. That for the foregoing reasons such plot plan except as hereinafter specifically modified elevation are hereby approved/and this Commission hereby recom- and mends to the City Council of the City of Arcadia that a zone variance be granted, subject to the following conditions: a. That the variance shall not be operative until complete working drawings including landscape planting plans and irrigation plans prepared by a qualified landscape architect are submitted to and approved by the Planning Commission, which shall be within one -2- 490 . . . . . . . year from the date of City Council approval of this variance. b. That no building permit shall be issued until such time as the plans have been approved by this Planning Commission. c. That the working drawings shall indicate construction of a six (6) foot high wall on the west property' line running from the north setback line to a point forty (40) feet north of the south property line, at which point the wall height shall be reduced to a height of three (3) feet and shall run to the north boundary of the alley; and that construction of not less than six (6) tree cut-out areas in the parking area in locations be completed and planted with tree types which screen the two (2) story educational building from the residential properties south of subject property. d. That the water services shall meet with the standards set forth in the Uniform Plumbing Code. e. That grading and drainage plans shall be submitted to and approved by the Department of Public Works. f. That no parking lot illumination shall exceed six (6) feet maximum height, and ~ll building and parking illumination be designed to be and shall be directed away from the adjoining prop- erties. g. That the south thirty (30) feet of the above-described property shall be offered to the City for alley purposes, accompanied by tender of deed for such purpose. h. That all windows on the south side of the second-story buildings shall have a minimum sill height of six (6) feet, and no balconies or exterior exit ways from the second story on the south side of such buildings. shall be permitted. i. That the City Planning Commission shall reserve the right, without necessity of further notice or hearing, to make minor modifications of any of the foregoing conditions, if such modifica- tion will achieve substantially the same results and will be no more detrimental to adjacent properties or improvements than will the trict compliance with said conditions. -3- 490 { . . . . . j. That construction plans shall be submitted to and approved by the Planning Commission prior to the issuance of a building permit therefor, which plans shall be substantially in compliance with the plot plan and elevation submitted by applicant in July of 1963 and hereby approved. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 23rd day of July, 1963, by the following vote: AYES: Commissioners Forman, Hanson, Kuyper, Norton, Parker and Ferguson . To: Planning Commission From: Planning Department Subject: Variance Application - American Lutheran Church Application: The Planning Commission on its own motion has initiated proceedings for the purpose of considering and making recommendations concerning the granting of a variance for church purposes on property known as the west 10 ft. of 56 West Duarte Road, all of 68 and 72 West Duarte Road, and the east 9 ft. of 82 West Duarte Road. Background: The original variance granted the American Lutheran Church on Feb- ruary 20, 1962 to allow construction of church facilities concerned property at 110-118 West Duarte Road. In August 1962, the applicants were granted a six months' variance extension. In January 1963, the applicants were granted another six months' extension. . In February 1963, public hearings were conducted in order to consider and act upon new plot plan and elevations representing a substantial departure from those upon which the variance was granted. The revised drawings were approved. The City is, because of recently developed plans for the south side of Duarte Road, desirous of acquiring the American Lutheran Church property. The Church has expressed a willingness to exchange their present holdings for the property described earlier in this report provided that this ex- changed property may be developed for church purposes as shown on attached plot plans. The Planning Commission at its meeting of July 9th granted the appli- cants another six months' extension on the existing variance. Proposed Use: The new site is to be developed in a manner identical to that illustrated by the plot plans and elevations approved in February of 1963 with two exceptions: . A. The parking has been rearranged to facilitate the con- tinuation of a 30 ft. wide alley; such alley to consist -1- ~ 't . . B. of a 6 ft. high wall and a 5 ft. wide planting st~ip on the south property line to provide a protective buffer and barrier for the single family residential uses south and 25 ft. of paving to facilitate a secondary supplemental means of traffic circulation for this and other similar developments that are likely to materialize in the future. The new parking arrangement, although not taking full advantage of the available space for parking in terms of the potential number of parking stalls, nevertheless pro- vides 63 spaces and exceeds the previously approved plan which proposed 57 spaces. The plans currently being considered indicate that the educational building is to be two stories in height whereas the previously approved plan proposed a one-story educational building. . . Analysis: The Planning Department considers this proposed development a signi- ficant improvement over the first proposal upon which the variance was granted and recommends that the variance be granted subject to the following conditions: 1. The variance not to be operative until complete working drawings including landscape planting plans and irri- gation plans prepared by a qualified landscape architect have been submitted to and approved by the Planning Commission, which shall be within one year from the date of City Council approval of this variance. 2. No building permit shall be issued until such time as the plans have been approved by the Planning Commission. 3. The working drawing shall indicate the following: A. Construction of a six foot high wall on the west property line running from the front setback line to a point 40 ft. north of the south property line at which point the wall height shall be reduced to a height of 3 ft. and shall run to the north boundary of the alley. . B. Construction of not less than 6 tree cut out areas in the parking area in lo~ations and to be planted with tree types which would screen the two-story educational building from the residential properties south of subject property. 4. The water services shall meet with the standards set up in the uniform plumbing code. 5. Grading and drainage plans shall be submitted to and approved by the Department of Public Works as part of the working drawing package. -~ . . . 6. All parking lot illumination and building illumination shall be designed and directed away from the adjoining properties. 7. The Planning Commission or City Council may grant minor modifications, without further public hearings or notice thereof, of the conditions set out above to the extent necessary to accomplish the purpose of this variance.
