HomeMy WebLinkAbout0484 .: ~... . . . / /~ /,5- , RESOLUTION NO. 484 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE TO PERMIT A HOME FOR THE AGED DEAF AT 529 WEST LAS TUNAS DRIVE IN SAID CITY. WHEREAS, there was filed with this Commission on May 17, 1963, the applicatlon of Ralph D. and Lu1a P. Stogsdill, as owners, for a zone variance to permit the constructlon of a home for the aged deaf-on property located at 529 West Las Tunas Drive in the City of, Arcadia, described as follows: Lot 17 and the westerly 25 feet of Lot 16, Tract No. 6641, per map recorded in Book 126, page 67, of Maps, Records of Los Angeles County; . and, WHEREAS, after notlce duly given as required by the Zoning Ordinance, a publiC hearing was duly held on the matter by and be- fore this Commission on the 28th day of May, 1963, which hearing was duly continued to June 11, 1963, and again contlnued to June 25, 1963, at which times all interested parties were given a full oppor- tunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That subject property is 100 feet by 191 feet with an area of 19,100 square feet. That the westerly 25 feet of subject property is in Zone C-2 and D with the remaining easterly 50 feet in Zone PR-l and D. That the four corners of Baldwin Avenue ~ and Las Tunas Drive are in commercial zones and developed with com- mercial land uses. On the south side of Las Tunas Drive the com- mercial zoning changes to Zone R-1. That ample landscaping is pro- posed on all sides of the proposed building. That on the north and east sides a minimum landscaped area of ten (10) feet is proposed a masonry wall six (6) feet in height enclosing the site. That -1- 484 / / '1. . . . .~~ . . nineteen (19) off-street parking spaces will be available with two (2) under cover. That a new two-story structure containing 6500 square feet will be constructed and will contain seventeen (17) bedrooms. SECTION 2. That this type of use will prOVide a transi- tion from the commercial uses to the single-family residential uses. That adequate buffering by landscaping and walls is prOVided to effectively screen this use from the adjoining R-1 properties. That the general location of the site ls ideal due to its proximity to stores and bus transportation for the proposed use. SECTION 3. That the intended use of subject property for a home for the aged deaf does not apply generally to the class of use in the same zone or viclnity; that the grantlng of such variance will not be materially detrimental to the public health or welfare or injurious to the property or improvements in the zone or vicinity in which subject property is located; that subject property is so located with respect to adjacent commercial uses, some by variance, that such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone or vicinity; that the granting of such variance will not adversely affect the general plan. SECTION 4. That for the foregoing reasons, this Commis- sion recommends to the City Council of the City of Arcadia that a variance be' granted to permit the use of the above-described prop- erty for a home for the aged deaf upon the follOWing conditions: a. That complete working drawlngs of the proposed build- ing, walls, landscaping and irrigation system, in substantial com- pliance with the revised plot plan submitted by app11cant and pre- sented to this Commission on June 25, 1963, be submitted to and approved by the P1ahning Commission together with evidence of approval thereof by the appropriate County and State agencies having jurisdiction over the proposed use of the property. -2- 484 ~ . . - .. . b. That the final plans include as part of the working drawings a landscape plot plan and irrigation plan prepared by a qualified landscape architect. c. That the off-street parking requirements shall be one (1) space for each bedroom plus one (1) additional space for each employee. d. That the exterior of the entire structure be of masonry construction and that the separation between the first and second story conform to requirements of the two-hour fire rating. e, That sidewalks shall be constructed and that the height of the block wall on the front of the property shall be increased to four (4) feet. f. The City Planning Commission shall reserve the right, . without necessity of further notice or hearing, to make minor modi- ftcations of any of the foregoing conditions, if such modification will achieve substantially the same results and will be no more detrimental to adjacent properties or improvements than will the strict compliance with said conditions. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded to the City Council of the City of Arcadia. Both of these tracts were reviewed by the Committee with the d~velopers. The"Committee recomrilends that these tracts be approved subject to the conditions of approval set forth in the Staff Report with the possible modification of some the conditions depending on the results of the Commission's discussion of pad sizes, slope banks and screening devices. Las Tunas Drive - Size: !OO ft. x. 191 ft. Area 19,100 sq. ft. PROPOSEO USE: Home for the Aged Deaf The existing house on the subject property is proposed to be removed and a new structure con- structed containing 6500 sq. ft. The new building will be two stories and contain 19 bedrooms. Ample landscaping'is proposed on all sides of the proposed building.. ,On the north ond 'east side a minimum landscaped area of ten feet is proposed. In addition a masonry wall 6 ft. in height will enclose the site. The activity area for this building is located on the west side of the lot and is next to the property in Zone C-2 and D. The overoge bedroom size is approximately 15 ft. by 17 ft. A common or community kitchen, dining room and living room is proposed,. Space within the building is allocated for a matron's quarters, infirmary and laundry. The refuse area is well screened from the street and adjacent property. 14 offstreet parking spaces are shown on the plan. Two of these will be under cover .EXISTlNG ZONING: The westerly 25 ft. of the subject property is in Zone C2 ond D. The remaining easterly 50 ft. is in Zone PR 1 and D. (NOTE: The partian of the subject property in Zone C 2 is in Fire Zone No. I. The portion in PR-l and D is in Fire Zone No.3. In Fire Zone No. I ;buildings must be constructed of incombustible materials. Frame and stucco construction is permitted in Fire Zone Na. 3. The proposed building is frame and stucco. CHARACTERISTICS OF THE AREA The four corners of Baldwin and Las Tunas Drive are in commercial zones and developed with commercial land uses. At the time the northeast corner was placed in commercial zoning the Commission emphOlJi2led that this area should be restricted to neighborhood commercial uses. Commercial zoning on either side of Los Tunos, east of the present zoning was not considered necessary nor desirable. on the south side of Las Tunas Drive the commercial zoning changes to Zone R-l after the Playtime Nursery which is somewhat of a buffer between the R-l and commercial uses. . . ,. . . . . . . . RECOMMENDATION: The Planning Department recommen~s that the variance be approved because: I. This type of use will provide a transition from the commercial uses to the single family residential uses. 2. Adequate buffering by landscaping walls, etc. is provided to effectively screen this lJse from the adjoining R-l properties. 3. The general location of the! s:ite is ideal due to its proximity to stores ,!nd bus transportation for the proposed use,~' However, the Deportment alsa recommends that approval be granted, subject to the condition that complete working drawings of the proposed building, walls, and landscaping, including irrigation systems, be in substantial compliance with the submitted approved plot plans, and that these drawings be approved by the Planning Commission. STOGSDILL, the owners of the real property located within the City of Arcadia, California, and hereinafter described has filed with the Planning Commission of the City of Arcadia, a petition requesting a zoning variance as follows: 0Lot 17 and the westerly 25 feet of Lot 16, Tract No. 6641, Map Book ) 126, page 67; property commonly known as 529 Las Tunas Drive. / . NOW, THEREFORE, NOTICE IS HEREBY GIVEN that on Tuesday, May 28, 1963, at the hour of 8:00 o'clock P. M., in the Council Chamber of the City Hall, 240 West Hun'tington Drive, Arcadia, Califomia, said Planning Commission will hold a public hearing on the question of said proposed variance, and an opportunity will be afforded to persons pornculofly interested, and the public generally, to be heard on all matters concerning voriance.
