RESOLUTION NO. 479 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOl'-IMENDING THE DENIAL OF A ZONE VARIANCE TO ALLOW A THREE STORY BUILDING ON PROPERTY LOCATED AT 1102 FAIRVIEW AVENUE IN SAID CITY. WHEREAS, there was filed with this Commission on April 29, 1963, the application of William J. Knight, as owner, for a zone variance 'to permit the construction of a third story penthouse above a proposed two-story apartment building on real property located at 1102 Fairview Avenue in the City of Arcadia, described as follows: The northerly 150 feet of Lot 53, Tract No. 2731, Map Book 33, Page 29, Records of said County; . and, WHEREAS, after notice duly given as required by the Zoning Ordinance, a public hearing was duly held on the matter by and before this Commission on the 28th day of May, 1963, at which time all interested parties were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That subject property is in Zone R-3 which , allows a maximum height limit of two stories or 35 feet. That there are no exceptional or extraordinary conditions applicable to the property involved or to the intended use of the property that do not apply generally to other properties or classes of use in the immediate . vicinity and in the same zone. That the granting of the requested variance would adversely affect the comprehensive general plan and would be materially detrimental to the public health and welfare and injurious to properties and improvements in the zone or vicinity in which the property is located. That a study of the described area indicates that -1- 4'79 v w . . . . only two story buildings are appropriate now and for the forseeab1e future. That to permit one building to be three stories would set an undesirable precedent in this area and accord subject property an advantage not enjoyed by adjacent properties. That the requested variance is not necessary for the preservatlon or enjoyment of a sub- stantial right of applicant possessed by other property in the same zone or vicinity. On the contrary, thls Commission recently granted a modification to allow construction of the proposed apartment build- ing within ten (10) feet of the side property line, thereby increasing the building site on subject property. SECTION 2. That for the foregoing reasons, this Commission recommends to the City Council of the City of Arcadia that a variance . to allow the construction of a third-story penthouse above a proposed two-story apartment building at 1102 Fairview Avenue be denied. SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded to the City Council of the City of Arcadia. June 6, 1963 TO: PLANNING COMMISSION FROM: ZONING COMMITTEE SUBJECT: V-63-17 The Zoning Committee has reviewed the request to construct 0 th ird story pent house obove a proposed two-story apartment building on the property at 1102 Fairview Avenue. As the Commission knows, the Zoning Committee hos been studying whether or not the height I imitations presently in effect should be changed to provide 0 more compatible relationship between buildings. This study is not completed. However, it has proceeded to the point where the Committee can use it as an evaluation device. For example, in the area in which this building is proposed the Committee has determined that only two story buildings are appropriate now and for the foreseeable future. To permit one building to be three stories would undoubtedly set a precedent in this orea which is not desirable. Therefore, the Committee recommends that the appl ication not be approved. TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: VARIANCE APPLICATION V-63-17 - RECUEST TO ALLOW CONSTRUCTION OF THIRD STORY PENTHOUSE - 1102 FAIRVIEW AVENUE, ARCADIA APPLICATION: William J. Knight, owner of property located at the southwest corner of :Sunset and Fairview Avenue and known as 1102 Fairview Avenue requests permission to construct a third story penthouse above a proposed two story opartment building, the total height of which shall not exceed 35 ft. ANALYSIS The subject property is in Zone R-3 which allows a maximum height limit of two stories or 35 feet. . A recent Commission action regarding this property granted 0 modification appeal to allow canstruction of the proposed apartment building within ten feet of the side property line on Sunset Boulevard. . The Commission at its lost meeting considered two other variance applications, which among other requests, sought permission to exceed the two story or 35 feet height limit. Both applications were referred to the Zoning Committee for further study and analysis with the object in mind that no decision be reached until a height district map could be prepared. The Planning Department recommends that this request to allow construction of a third story penthouse, a variotion.from present R-3 allowances, be catogorized with the other two similar requests and that it too be referred to the Zoning Committee for further study.
