RESOLUTION NO. 470
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING THE DENIAL
OF AN APPLICATION FOR CHANGE OF ZONE
FROM ZONE R-2 TO ZONE C-2 AND D ON
PROPERTY LOCATED ON THE NORTHWEST
CORNER OF DUARTE ROAD AND FIFTH AVENUE
IN SAID CITY.
WHEREAS, there was filed with this Commission on the 15th
day of November, 1962, the application of Ethlyn Grobmeier, as owner,
for a change of zone from Zone R-2 to Zone C-2 and D on property
located at 423, 425, 433 and 435 Duarte Road in the City of Arcadia,
descrlbed as follows:

Those portions of Lot 1 of Tract No. 3522 in
the City of Arcadia, County of Los Angeles,
State of California, per map recorded in Book
38, Page 27, of Maps in the office of the
County Recorder of said County described as
follows:
Parcell. Beginnlng at a point in the easterly
line of said Lot 1, distant southerly thereon
224.78 feet from the northeasterly corner of
said lot; thence westerly parallel with the
northerly line of said lot, 112.5 feet; thence
southerly parallel with said easterly line of
said lot to a point in the southerly line
thereof; thence easterly along said southerly
line of said lot to the southeasterly corner
thereof; thence northerly along said easterly
line to the point of beginning.

Parcel 2. Commencing at the northeast corner
of said Lot 1; thence South 0028' East along
the easterly line thereof 226.3 feet and South
89032' West parallel with the northerly line of
said Lot 1, 110 feet for the true point of
beginning for this description; thence South
89032' West parallel with said northerly line,
72.72 feet, more or less, to a point distant
easterly measured along said parallel line 68
feet from the westerly line thereof; thence
South 0056'39" East parallel with the westerly
11ne of said Lot 1 to a point in the southerly
line thereof; thence North 80035' East along
said southerly line to a point which bears
South 0028' East from sald true point of
beginning; thence North 0028' West along said
11ne so bearing to the true point of beginning.
EXCEPT the east 30 lnches thereof, said 30 inch
strip of land being shortened or extended to
terminate in the northerly and southerly line of
above described real property.

WHEREAS, after notice required by the Zoning Ordinance of
said City, as amended, a public hearing was duly held on said matter
by and before this Commission on the 8th day of January, 1963, and
duly continued to January 22, 1963, at each of which times all inter-
ested persons were given a full opportunity to be heard and to pre-
sent eVidence;
NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DE-
TERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. That subject properties are located in a block
every lot of which is zoned R-2 and used exclusively for residential
purposes. That properties on the south slde of Duarte Road from
Fifth Avenue to a point west of Third Avenue are in Zone R-l and
used exclusively for that purpose. That there is no commercial zon-
ing or commercial use of land on the north and south sides of Duarte
Road from the Arcadia City boundary at Fifth Avenue to a point west
of Third Avenue. That every lot between Third Avenue and Fifth Ave-
nue from Duarte Road to California Street is zoned R-2 the same as
subject property, and every lot between Third Avenue and Fifth Ave-
nue south of Duarte Road all the way to Camino Real is zoned R-l.
SECTION 2. That the requested application, if granted,
would Constitute objectionable spot zoning and is not justified by
good zoning practice, public necessity, convenience or general wel-
fare. That subject property is located adjacent to the easterly
city boundary. That somewhat to the east of the city boundary there
is some commercial development in another city. That this fact alone
neither justifies nor requires the requested reclassification of sub-
ject property. That if commercial encroachment into purely resi-
dential zones is to be prevented, this can best be accomplished
at the city boundary.

SECTION 3. That subject property with respect to its
zoning, use and alleged incipient deterioration, is no different
than any other property in the general area. That although the
reclassification to some less restricted zone of subject property
or of the properties surrounding would probably tend to revitalize
and redevelop the area, subject property alone should in no event
be slngled out for reclassification. That what area should be re-
classified and into what zone such area should be placed are mat-
ters that can be properly determined only by an intensive study of
the entire area.
SECTION 4. That for the foregoing reasons this Commis-

sion recommends that the requested reclassificatlon of the above
described property be denied at this time, without prejudice to
any future consideration of said or any similar application after
completion of an intensive study of the entire area of which sub-
ject property is but a part.
SECTION 5. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Planning Commission held on the 13th
day of
February, 1963, by the following vote:

SUBJECT: REZONING ON EAST DUARTE ROAD
APPLICATION:
Th is appl ication of Ethlyn Grobmeier, requests the rezoning of approximotely the south two-th irds
of Lots 1 and 2, Tract No. 3522, located on the northwest corner of Duarte Road and Fifth Avenue
to Zone C-2 and D. The two lots are commonly known os 423, 425, 433 and 435 Duarte Road and
Lot No. I obuts the eastern Arcadia City Boundary.
CHARACTERIS TICS OF THE SUBJECT PROPERTIES.
I. Both lots ore in Zone R-2
2. Lot I is improved with two houses in fair condition.
3. Lot 2 is improved with one house in fair condition and one
duplex in fair condition.
CHARACTERISTICS OF THE AREA
.
I. The subject properties are located in a block which is zoned R-2
and used exclusively for residential purposes.
2. The properties on the south side of Duarte Road from Fifth Avenue to
a point west of Third Avenue are in Zone R-I and used exclusively
for that purpose.
3. There is no commercial zoning or fond use on the north ond south
sides of Duarte Road from Fifth Avenue to a point west of
Th ird Avenue.
4. The property directly east of Fifth Avenue on the north side of Duarte
Road within Monrovia's City Limits is zoned for commercial development
and a portion of it is improved with 0 neighborhood shopping center.
5. The property east of Fifth Avenue on the South side of Duarte Road
within Monrovia's City Limits is in Zone R-2 and is mostly single-
family use at present.
6. It is quite likely that Monrovia will rezone 011 of the property fronting
on Duarte Road from the Arcadia City Boundary on the west to the
Santa Anita Wosh on the East to R-4 (Hi-Density Multiple Dwell ings)
within the next month.
ANALYSIS AND CONCLUSIONS
.
There appears to be l.ittle or no justification for the spot rezoning of these lots for commercial purposes
at this time. The surrounding Arcadia zoning and land use is almost exclusively devoted to residential
and 0 piecemeal rezoning af the subject property would constitute objectionable spot zoning and is
not justified by good zoning practice.

However, the Planning Department does recognize the existence of a deteriorating condition of
some properties in the area and realizing that rezoning could constitute a force for their
e lirrtinationond/or rev italization does recommend that it be directed to undertake 0 zoning
study that would not only include the subject property but an area encompassed by Diamond
Street on the north, Santa Anita Avenue on the west, Duarte Road on the south and Fifth
Avenue on the East. Such a study would supplement the Downtown Consultants' study which
terminates at Diamond Street and would provide a complete and comprehensive basis for
sound planning ludgment.
The Planning Commission has three al ternatives regarding this application:
I. To deny it.
2. To hold it in obeyance by continuing the public hearing
until a zoning study of the entire area can be completed
3. To approve it.
NOTE:
If the Commission decides to opprove the application the Staff should be instructed to develop
specific conditions of approval to be incorporated in the Commission's Resolution.

NOTICE OF PUBLIC HEARING
BEFORE THE
ARCADIA CITY PLANNING COMMISSION
WHEREAS, ETHL YN GROBMEIER, the owner of the property located within the
City of Arcadia, Cal ifornia, and hereinafter described, have filed with the Planning Commission
of the City of Arcadia, 0 petition requesting the following zone change:
The South two-thirds (approximately) of Lots I and 2 of Tract
No. 3522. os shown on map recorded in Book 38, page 27
of Maps, Records of Los Angeles County, being the property
located on the northwest corner of Duarte Road and Fifth
Avenue.
The above property has been requested to be changed from
Zone R-2 to Zone C-2-D.
NOW, THEREFORE, NOTICE IS HEREBY GIVEN that on Tuesday, January
8, 1962, at the hour of 8:00 o'clock P.M. , in the Council Chamber of the City Hall,
240 West Huntington Drive, Arcadia, Californio, said Plonning Commission will hold
a publ ic hearing on the question of soid proposed zone change, and an opportunity
will be afforded to persons particularly interested, and the public generally, to be
heard on all matters concerning soid zone chonge.
