A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, DENYING THE APPEAL FROM AND AFFIRMING THE DECISION OF THE MODIFICATION COMMITTEE CONCERNING THE REQUEST FOR MODIFICATION OF LOT REQUIREMENTS TO PERMIT THE CONSTRUCTION OF A SECOND DWELLING AND A GUEST HOUSE AT 1128 SOUTH SIXTH AVENUE IN SAID CITY. WHEREAS, there was filed with the Modification Committee of the City of Arcadia on November 6, 1962, the application of Ralph Clark, as owner, for a modification of the R-l lot require- ments to permit the construction of a second dwelling and a guest house at 1128 South Sixth Avenue on property in said City of Ar- cadia, County of Los Angeles, State of California, described as Lot 63, Tract No. 808, as shown on map recorded in Map Book 16, page 82, in the office of the County Recorder of said County; and, WHEREAS, after due notice as required by the Zoning Ordi- nance of said City, a public hearing was duly held on the matter by and before the Modification Committee on December 11, 1962, at whlch time the modification as requested was denied; and, WHEREAS, on November 21, 1962,an appeal from said deci- sion of the Modification Committee was filed by the applicant; and, WHEREAS, such appeal from said decision was duly heard by and before this Commission on the 11th day of December, 1962, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: SECTION 1. That the Modification as requested is not necessary to either secure an appropriate development of the lot -1- 467 v . . . . to prevent unreasonable hardship or to promote uniformity of de- velopment, and in view of applicant's statements would be neither proper nor lawful. SECTION 2. That for the foregoing reasons, the appeal from the said decision of the Modification Committee is hereby de- nied and this Commission does hereby affirm the decision of the Modification Committee approving the construction of a second dwell- ing at the location on the above-described property shown on the plot plan submitted by applicant and disapproving the request as to the proposed guest house, the approval as to the second dwelling being upon the condition that the owner of said property execute and record a covenant, in the form approved by the City Attorney, . that no guest house or other accessory structure designed, intended or capable of being used for sleeping or living quarters or accom- modations shall at any time be constructed on the property. SECTION 3. The Secretary shall certify to the adoption of this resolution. ATTEST: lVILLIAi.j PF.ELPS Secretary -2- 467 ~ . -, . . , December 6, 1962 TO: PLANNING COMMISSION FROM: PLANNING OEPARTMENT SUBJECT: Y-62-12 The San Gobriel y..lley Water Company has filed an application for a variance and/or special use permit to use the property situoted on the south side of Clark Street about 400 feet east of Peck Road for the following purposes: . I. The drilling of two (2) water wells 2. The erection of a ground level, welded steel woter storage tank eighty-eight (88) feet in diameter by forty (40) feet in height with 0 capacity of approximotely 1,819,&92 gallons. 3. The erection of one concrete block booster pump building sixteen (16) feet by thirty-six (36) feet. 4. The erection of two (2) ten (10) by ten (10) feet corrugoted metal turbine pump buildings and the installation of pumps ond appurtenant equipment therein. 5. To maintain and operate said wells, tanks, buildings, booster pumps, turbine pumps and equipment in connection with the applicants business of supplying water for domestic, industrial, fire protection and other flsei as a public utility water corporation. 6. As 0 part of this application the applicant also requests 0 permit, os provided by Section 6431 of the Arcadia Municipal Code to drill two wells on the property. Section 6431 referred to above in Item Six is not a part of the Zoning Ordinance but rather 0 Section of the Arcodia Municipol Code which states: "6431: PERMIT REQUIRED: No person, either as a principal or agent shall drill, bore or sink, or cause to be drilled, bored, or sunk, any well for water, oil or other similor substonce within the City, without first having obtained a permit from the Council so to do pursuant to Port 1 of Chapter 3 of this Article. The Council shall have the power in its discretion to grant or deny such a permit." Permission to drill or not to drill two wells can only be given by the City Council; however, the Planning Commission may desire to make a recommendation to the Council on the obove matter thereby fully replying to the application and making a complete recommendation to the City Counci I. CHARACTERISTICS OF THE SUBJECT PROPERTY . I. It contains five lots each 25 ft. 2. It has an area of 16,625 sq. ft. 3. ItisinZoneM-l-D 4. It is owned by the oppl icants 5. Enough of the lots ore owned by the same persons to make industrial sites possible. 4. Most of the property in the area is vacant. RECENT DEVELOPMENT TRENDS I. Two new modern industrial buildings have been constructed on the west side of Peck Road opposite McBean Street 2. One of the two bui Idings is presently occupied by the Moody Rainmaster Sprinkler Company and the Nees Turf Supply Company. The other building is still in the construction stage. 3. A new industrial building has been constructed (and is occupied) ot the southwest corner of Myrtle and Clark Street. 4. Water mains ond Fire hydrants have been installed on Clark Street. OTHER CONSIDERATION The Water Department of the City of Arcodia has submitted a report which should be considered by the Plann ing Comm ission in deciding whether or not to recommend approval or disapproval of this appl icatian. A copy of the report is attached. RECOMMENDA TI ONS: . The planning Stoff has reviewed the application, studied the plot plans, and visited the area and recommends that the application not be approved for the following reasons: I. The development af the subject property with sheds, and a water storage tank would not be in keeping with the applicable architectural overlay regulations which were developed to encourage and protect industrial development in the area. 2. The proposed improvements ore not likely to encourage additional types of de.-elopment in the area such os the three recently constructed. 3. The comprehensive general plan for the area would, from a planning viewpoint, be adversely affected. However, if the Commission decides to approve the application, the ;following conditions of approval ore recommended: WP:mo I. . Clark .Street shall be improved, meeting with the approval of the Director of Public Works, 2. Dedicate five (5) feet for the widening of Clark Street. 3. The locotion and construction of the proposed tronsmission system leading away from the pumping plant shall be subject to the approval of the Director of Public Works, 4. All motors and equipment shall be enclosed within masonry buildings. 5. December 6, 1962 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: ADDITIONAL INFORMATION - V-62-12 SAN GABRIEL VALLEY WATER COMPANY This application is strongly recommended for disapproval by the administrative stoff of the city, because the city-owned and operated water depa~tment could be adversely affected. In the Water Deportment's report it is pointed out that taxpayers of Arcadia have invested 0 considerable amount of money into its water system to insure the production and distribution of water at a reasonable cost. This investment should not be overlooked by the Commission in considering the appl ication. From a planning viewpoint one of the important benefits accruing to a city with an active planning program is the efficient, economical programming of necessary capital improvements, (water lines, streets, etc.) . Once a plan for an area is developed and subsequently implemented by the odoption and enforce- ment of oppropriate zoni rg regulations, considerable amount of guesswork is eliminated in deter- mining the location and size of the publ ic improvements necessary to serve the area. I submit that such 0 plan was developed for the industrial area on both sides of Peck Road when it was annexed to the City ond that this plan is being implemented with appropriate zoning regulations, and consequently the publ ic improvements in the area ore adequate to serve the present develop- ment and as new development occurs additional facilities can be properly installed. Normally,. a", unbolance in the programming of capitol improvements results from changes in land use but in the case before the Comm ission an unbalance cou Id be created by 0 dupl ication of water facilities.vying for the industrial customers in the area. It is conceivable that under the con- ditions the facilities presently installed in the area would not be used to their maximum capocity. If this were the case, public money would be wasted.
