RESOLUTION NO. . '~64 .
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, DENYING THE REQUESTED
MODIFICATION OF DRIVEWAY REQUIREMENTS
FOR REAL PROPERTY LOCAT~D AT 41 ALTA
STREET IN SAID CITY.
WHEREAS, there was filed with the Modification Committee
of the City of Arcadia on'the 11th day of October, 1962, the appli-

cation of Carl Thomason, as owner, for a modification of driveway
requirements to allow the projection of an eave twenty-four (24)
inches into the driveway at a height of eight (8) feet, in the con-
struction of a four (4) unit apartment building at 41 A1ta Street on
property in the County of Los Angeles, ,State of, California, de-
scribed as Lot 11, Block 73, Santa .Anita Tract, as shown on map re-
corded in Book 15, pages 89 and 90, of Miscellaneous Records in the
office of the County Recorder of said County; and,
WHEREAS, after due notice as required by the Zoning Ordi-
nance of said City, a public hearing was duly held on the matter by
and before the Modification Committee on October 23, 1962, at which

time the requested modification was denied; and,
WHEREAS, on October 30, 1962, an appeal from said decision
of the Modification Committee was duly filed by the applicant with
this Commission; and,
WHEREAS, after notice duly given such appeal from said de-
cision was duly heard by and before this CommiSSion on the 13th day
of November, 1962, at which time all interested persons were given
. full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE CITY'PLANNING COMMISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS:
SECTION 1. That Section ,9254.2.9 of the Arcadia Municipal
Code provides in part that each driveway".

than thirteen (13) feet above the pavement, may overhang any suchdrive-

projection was first detected and called to the building contractor's

attention while the building was in the framing ~tage; that at that
time and subsequently the contractor was notified to remove the pro-
jecting eave or to apply immediately for a modification; that the
, "
projecting eave was not removed and no application for modification
was made until the building was completed. That the removal of that
portiqn of the eave which is in violation of Section 9254.2.9 of the
Arcadia Municipal Code will not materially affect the esthetic looks
of the building. That it has not been shown that the requested modi-
fication of Section 9254.2.9 of the Arcadia Municipal Code is neces-
sary either to secure an appropriate improvement of subject lot, or
to prevent unreasonable hardship or to promote uniformity of develop-
ment.

SECTION 2. That for the foregoing reasons, the decision of
the Modification Committee is hereby affirmed, the appeal therefrom
is hereby denied, and the requested modification of driveway require-
ments is hereby denied.
SECTION 3. The Secretary shall certify to the adoption of
this resolut:).on.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Planning Commission held on the
