RESOLUTION NO. 461
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, DENYING THE REQUEST FOR
MODIFICATION OF THE SIDE YARD SETBACK
REQ~IREMENTS AND ACCESSORY BUILDING
REQUIREMENTS APPLICABLE TO REAL
PROPERTY LOCATED AT 331 MONTE VISTA
ROAD IN SAID CITY.
WHEREAS, there was filed with the Modification Committee
of the City of Arcadia on August 13, 1962, the application of Mr.
and Mrs. Ernest T. Carney, as owner, for a modification of the side
yard"f3etback requirements and the accessory building requirements
to allow construction of a cabana within six (6) feet behind the
main building and thirty (30) inches from the side property line
... of property located at 331 Monte Vista Road in the City of Arcadia,
County of Los Angeles, State of California, described as Lot 26,
Tract No. 12542, as shown on map recorded in Book 259, pages 34-35,
of Maps in the office of the County Recorder of said County; and,
WHEREAS, after due notice as required by the Zoning Ordi-
nance of said City, a publiC hearing was duly held on the matter
by and before the Modification Committee on August 28, 1962, at
which time the requested modification was denied; and,
WHEREAS, on September 6, 1962, an appeal from said deci-
sion of the Modification Committee was filed by the applicant; and,
WHEREAS, such appeal from said decision was duly heard
by and before this Commission on the 9th day of October, 1962, at

which time all interested persons were given full opportunity to
be heard and to present evidence;
NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY
DETERMINES AND RESOLVES AS FOLLOWS:

SECTION 1. That the cabana overhang is within two (2)
inches of the property line whereas a minimum two and one-half (2t)
foot distance from the property line is required by Section 9283.8.3
of the Arcadia Municipal Code. That the cabana is one and one-
half (It) feet from the property line whereas a three (3) foot
minimum side yard is required by Section 9252.2.4 of said Code.
That the cabana is less than six (6) feet from the house whereas
a fifteen (15) foot separation is required by Section 9252.2.11 of
said Code. That said cabana was constructed at its location without
a permit therefor from or inspection during construction thereof by
the City, either of which would have precluded such location of the
cabana. That neither the requested modification of the side yard

requirements applicable to subject property nor the requested modi-
fication of the rear yard requirements applicable thereto are neces-
sary either to secure an appropriate development of the lot, to
prevent unreasonable hardship or to promote uniformity of develop-
ment.
SECTION 2. That for the foregoing reasons, the decision
of the Modification Committee is hereby affirmed, the appeal there-
from is hereby denied, and the requested modification of side yard
setback requirements and accessory building requirements to allow
the construction of a catana within thirty (30) inches of the side
property line is hereby denied.
SECTION 3. The Secretary shall certify to the adoption
of this resolution.
