RESOLUTION NO. 941 A RESOLUTION OF THE PIANNING COMMISSION OF THE CITY CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO CONSTRUCT AND OPERATE A RESTAURANT AT 101 NORTH FIRST AVENUE . WHEREAS, on May 10, 1976, Jerry and Lynn Enterprises filed an application to construct and operate a restaura~t, Planning Department Case No, C.U.P. 76-10 ,on the property commonly known as 101 North First Avenue, more particularly des- cribed as follows: Lots 13, 14, 15; 16 and 17 of Block 76 of Arcadia Santa Anita Tract in the City of Arcadia, County of Los Angeles, State of California as per map recorded in Book 15, page 89. WHEREAS, a public hearing was held on said matter on May 25, 1976 at which time all interested persons were given full .opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ,ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommo- date said use including all yards, parking, loading, landscaping and other features ~ required to adjust ~aid use with the land and uses in the neighborhood. 1. 941 ., . . 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adverse1y affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of th~ City Council, this Commission grants a conditional use permit to construct and operate a reataurant upon the following conditions: 1. The property shall be improved a.nd maintained ,in accordance with the plans which are on file in the subject Case No. C.U.P. 76-10 and applicable regula- tions of the Arcadia Municipal Code. 2. The Public Works Department recommends that 'approval of C.U.P. 76-10 . be conditioned upon the recordation of a covenant maintaining the lots as a single unit in a form acceptable to the City Attorney and/or a parcel map for Lot Split L-76-ll. 3. That the final parking plan and landscape plan be submitted to the Planning Department for its review and approval. 4. That a modification be granted to allow a minimum 7,-foot landscape berm three feet high between the parking area and the street in lieu of a three foot high wall. 5. That a modification be granted .to allow the building to be located adjacent to the rear property line in lieu of 20 feet required. 6. Remove existing asphalt parkway pavement and construct eight foot P.C.C. sidewalk on Wheeler Avenue. . 2 941 .. .. .' . 7. The existing A.C. drive apron on Wheeler Avenue shall be closed or . . constructed in accordance with City S,tanda,rd Plan S-ll. 8. Dedicate a l5-footradius corner cutoff for street purposea at the northwest corner of Wheeler Avenue and First Avenue. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City'Council of the City of .Arcadia. May 25, 1976 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 76-l~ 101 NORTH FIRST AVENUE APPLI CATION This application was filed on May 10', 1976 by Jerry and Lynn Enterprises, Inc. and proposes to operate a restaurant at 10l North First Avenue (the northwest corner of Wheeler and First Avenues). LAND USE AND ZONING The subject site is zoned C-2 H and developed with a real estate office, interior decorator store, storage building and a showroom. Properties to the north" south, east and west are zoned C- 2 Hand developed wi th vacant lots and mixed commercial uses. (See attached Land Use and Zoning Map~) PROPOSAL AND ANALYSIS The subject site contains 43,504.2 sqUare feet. The real estate office and showroom are to be removed. The remaining building which contains 4,992 square feet will be remodeled, and the proposed restaurant will contain a total floor area of 7,463 square feet. On March 16, 1976, the City Council approved variances from the Building Code to allow the use of the existing building with the alternate "proposals as approved by the Director of Public Works, Building Superintendent and Fire Department with the condition that "strict compliance with all other applicable Building and Fire Codes" be adhered to. The restaurant will have a seating capacity of 207 people (in- cluding the bar and lounge). The existing building will be used for the dining room, banquet room and bar area. The kitchen area and restrooms will occupy the new portion of the restaurant. Seventy-seven parking spaces are proposed; 75 are required. Ingress and egress to the property will be from two 2S-foot wide driveways; one off of First Avenue and the other from Wheeler Avenue. . . . C.U.P 76-10 2 Landscaping exceeds the mlnlmum three percent required. The applicant is requesting a modification to allow 7~-foot wide berms between the parking and the street in lieu of a three-foot high wall. The C-2 code requires that ther~ be a 20-foot rear yard setback. The building as it presently exists meets Code requirements. However, when the lot consolidation (L-76-ll) is filed for the subject site, the front of the new lot will be un First Avenue and the existing building and proposed addition will be located in this 20-footrear yard area. A modification should be granted for this encroachment. The building will be 32 feet in height and the exterior will be rough sawn paneling. Pursuant to the provision of the Californ,ia Environmental Quality Act, the Planning Departm~nt reviewed the proposed project and determined that the proposal would not have a significant effect on the environment. A Negative Declaration has been prepared and filed for this project. ... The Planning Commission in its approval or denial of the proposed conditional use permit must make the determination that the proposed project would or would not have a substantial adverse impact on the environment. RECOMMENDATION The Planning Department recommends app.roval of C.U.P. 76-10, subject to the following conditions: l. That the final parking plan and landscape plan be submitted to the Planning Department for it'S review and approval. 2. That a modification be granted to allow a minimum 7~-foot landscape berm between the parking area and the street in lieu of a three-foot high wall. 3. That a modification be granted to allow the building to be located adjacent to the rear property line in lieu of 20 feet required. 4. That the property shall be improved and maintained in sub- stantial accordance with the plans on file, and with all applicable regulations of the Arcadia MuniCipal Code. . . . . . . C.U.P. 76-10 3 S.
