RESOLUTION NO. 940 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING APPROVAL OF A TEXT AMENDMENT TO DELETE S?~TION 9252.1.2 FROM THE '~ADIA MUNICIPAL CODE. WHEREAS, a public hearing was held on May 11, 1976 before the Planning Commission to consider removing Section 9252.1.2 from the Arcadia Municipal Code which permits twp-family dwellings in an R-l Zone if the lo~ to be developed is adjacent to property zoned R-3, P, dommercial or industrial; and WHEREAS, all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the present Code section allowing an R-2 type use in an R-l zone (double the density) is inconsis,tent with the established General Plan designation of Single Family (0-6 du/ac); NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDS TO THE CITY COUNCIL: SECTION 1. That Section 9252.1.2 of the Arcadia Municipal Code be deleted. SECTION 2. The Planning Commission finds that the public necessity, convenience, general welfare and good zoning practice justify the above recommendation. SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the. City of Arcadia. -1- 940 , .. . . . . . May 11, 1976 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: TEXT AMENDMENT 76-6 TWO-FAMILY DWELLINGS IN AN R-l ZONE The Arcadia Municipal Code Section 9252.1.2 now provides for two-family dwellings in s.inl?;le-family zones if the lot to' be developed is adjacent to property zonedR-3, P, commercial or industrial. The possible intent of the aforementioned Code section could have been to provide a transition in the land use intensity. However, Section 9252.1.2 predates the more recent require- ments for buffers between uses now in the existing multip1e- family, commercial and indus'tria1 zones. For example, C- 2 zone developments constructed since 1967 adjacent to any type of residentially zoned property are required to have a six- foot high block wall and five feet of landscaping to buffer the effects of commercial uses from residential property. The present Code section allowing an R-2 type use in an R-l zone (double the density) is inconsistent with the established General Plan designation of Residential Single-Family (0-6 du/ac). Pursuant to the provision of the California Environmental Quality Act, the Planning Department reviewed the proposed text amendment and determined that the proposal would not have a significant effect on the environment. A Negative Declaration has been prepared and filed for this text amendment. The City Council in its approval or denial of the proposed text amendment must make the determination that the amendment would or would not have a substantial adverse impact on the environment. Staff feels that Section 9252..1.1... of the Arcadia Municipal Code is obsolete and inconsistent with current City development /' . . . . . . Text Amendment 76-6 2 standards.
