RESOLUTION NO. 939
A .RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR AN AUTOMOBILE
REPAIR GARAGE AT l13~ ST. JOSEPH STREET.
WHEREAS, on April 23, 1976, Vernon Crowder, on behalf
of Arcadia Brake Shop, filed an application to operate an automobile
repair shop, Planning Department Case No. C.U.P. 76-9, on the
property commonly known as l13~ St. Joseph Street, more particularly
described as follows:
Lot 4 of Block 81 of Arcadia Santa Anita Tract
in the City of Arcadia, County of Los Angeles,
State of California as per map filed in Book 15,
page 89, of Maps, as,~ecorded in the Recorder's
Office of said County.
WHEREAS, a public hearing was held on said matter on
May 11, 1976 at which time all interested persons were given full
opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the
Planning Department in the attached report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is

properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to adcommodate said use including all yards, parking,
,
loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highwa,Ys adequate in
width and pavement type to carry the kind of traffic generated
by the proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial
adverse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants. a conditional
use permit for an automotive garage upon the following conditions:
1. That the property shall be improved and maintained
in accordance with the plans on file in the subject Case No.
C.U.P. 76-9 and applicable regulations of the Arcadia Municipal Code.
2. That all repair work be done inside the building.
3. That the parking area in the rear be striped as per
Section 9266.4.9 and wheel stops be provided where these parking
spaces abut walls.
4. That a modification be granted to allow eight parking
spaces in lieu of nine required.
5. That all signs shal'l comply with Code.

SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

City of Arcadia held on the 25th day of May, 1976, by the following

APPLICATION
This application was filed on April 23, 1976 by Vernon Crowder,
dba Arcadia Brake Shop, and requests a conditional use permit
for an automobile repair garage at l13~ St. Joseph Street.

LAND USE AND ZONING
The subject site is zoned M-l and developed with M-H Products
Co. and the Arcadia Brake Shop. Properties to the north, south,
east and west are zoned M~l and developed with mixed commercial,
industrial and residential uses. (See attached Land Use and
Zoning Map.)
HISTORY
The Arcadia Brake Shop was originally located at 4Ql North First
Avenue. In February 1976, Mr. Crowder moved his business to
ll3~ East St. Joseph without ~btaining a conditional use permit
for an automotive garage.
PROPOSAL AND ANALYSIS
The applicant is operating the repair shop to the rear of the
building at ll3 St. Joseph Street.
The subject site contains 8,000 square feet. The building con-
tains 3,550 square feet; 1,050 square feet is comprised of
office space and the remaining 2,500 square feet is shop area
which is shared by the fork lift company and the Arcadia Brake
Shop. The garage area contains approximately 700+ square feet.
... Mr. Crowder is the only employee of the brake shop.

Four marked parking spaces are located in the front and there
are five unmarked spaces in the rear. There is adequate space
for only four parking stalls to the rear of the building.
The applicant is operating the garage in the area designated
on the plan. Vehicles which are not being worked on are parked
in the rear yard. Access to the shop is from St. Joseph Street
or from the alley.
A five-foot high.wall exists along the easterly and westerly
property lines and a chain link, fence and gate runs along the
northerly property line adjacent to the alley.
The site has no designated loading space nor is a trash enclosure
located on the site. Trash is stored inside the building in
metal trash containers. The Planning Department ha's received
a written memo from the Fire Department i~dicating there is no
problem with inside trash containers as long as they are metal
containers with lids.

The Planning Department does not believe it is necessary that
there be a designated loading space as there is adequate rear
yard area to allow for off-street and off-alley loading.
The Code allows for property outs,ide a building to be used
for parking and storage provided that all such storage activities
are screened from view from adjoining properties and public
rights-of-way.
Pursuant to the provision of the California Environmental
Quality Act, the Planning Department reviewed the proposed
application and determined that the proposal would not have a
significant effect on the environment. A Negative Declaration
has been prepared and filed ~or this project.
The Planning Commission in, its approval or denial of the proposed
conditional use permit must make the determination that the
proposed project would or would not have a substantial adverse
impact on the environment.
.RECOMMENDATION
.
The Planning Department believes that this use would be compatible
with the existing area and, therefore, recommends approval of
C. U.P. 76-9 subject to the following conditions:
1. That all repair work shall be done inside the building.
2. That the parking area in the rear be striped as per

4. That the parking area fronting on the alley be screened from
view and that the screening be subject to the approval of
the Planning Department,

and with all applicable regulations of the Code.
