RESOLUTION NO. 938 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO EXPAND THE PARKING AREA OF AN EXISTING CHURCH AND TO OPERATE A PRESCHOOL AT 805 NORTH FIRST AVEN.UE. WHEREAS, on April 12, 1976, the Victory Chapel Church of the Foursquare Gospel and Mr. and Mrs. Bernie Wijesiriwardena filed an application to expand the church parking area and to operate a preschool, Planning Department Case No.. C. U.P. 76-8 on the property commonly known as 805 North First Avenue, more particularly des- cribed as follows: . The area bounded by Forest Avenue on ~he north, First Avenue on the east, and the Foothill Freeway on the southwest, except Lots 74, 75 and 76 of Tract No. 7820, M.B. 83, page 30 and Lot 8 of Tract No. 3112, M.B. 29, page 68, in the City of Arcadia, County of Los Angeles, State of California, as recorded in the office of the County Recorder of said County. WHEREAS, a public hearing was held on said matter on April 27, 1976 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission .finds that: 1. The granting of a conditional use permit as herein- 4It after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone -1- 938 . . . . or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to aocommodate said use including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit to expand the church parking and to operate a preschool upon the following conditions: 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 76-8 and applicable regulations of the Arcadia Municipal Code. 2. That a lot consolidation be filed prior to January 1, 1979 and approved and recorded for the subject site including 723-725 North First Avenue. . 3. That an irrigation plan for the new parking area be -2- 938 . . . submitted to and approved by the Planning Department. 4. A lighting plan for the new parking area shall be submitted to and approved by the Planning Department. 5. Wheel stops shall be provided adjacent to any walls, buildings and/or property lines. 6. A revised parking plan shall be submitted to and approved by the Planning Department. 7. Painted directional signs shall be provided in the parking area and driveways. 8. A six-foot high block wall shall be built along the rear of the properties at 44 and 48 Forest .Avenue and 711 and 701 North First Avenue, and along the southerly property line at 701 North First Avenue. 9. A six-foot high block wall shall be provided along the rear property line of 723-725 North First Avenue. (However, if this lot is included in the lot consolidation, this requirement shall be waived.) 10. The vacant lot south of 701 North First Avenue shall be planted with a five-foot wide landscaped buffer along the frontage on First Avenue, and the remainder of the vacant parcel shall be maintained free of weeds and debris. 11. The enrollment of the preschool shall be limited to 15 children. 12. A trash enclosure shall be provided as per Section 9262.6.9 of the Arcadia Municipal Code. . 13. The property shall be improved and maintained in . -3- 938 . . . . . substantial compliance with the plans on file in the subject case. 14. The preschool building shall conform to the Arcadia Building Code requirements for a preschool and prior to the issuance of a business license, written proof shall be submitted from the State Department of Social Welfare verifying its approval of the site. 15. The exit driveway adjacent to the freeway shall be limited to right-hand turns only or widened to permit left-hand turns subject to the approval of the Director of Public Works. 16. P.C.C. drive apron per City standard plan 5-11 shall be constructed on First Avenue to serve exit from existing parking lot. 17. A catch basin shall be constructed and a drainage pipe shall be installed in accordance with City standard plan 5-11 at the existing paved exit driveway on First Avenue to convey drainage under the sidewalk. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. April 2'7, 1976 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 76-8 PROPOSAL TO OPERATE A PRESCHOOL AND EXPAND THE PARKING AREA FOR THE EXISTING CHURCH AT 80S NORTH FIRST AVENUE APPLICATION An appliclltion was filed on April 12, 1976 by the Victory Chapel, Church of the Foursquare Gospel, and Mr. and Mrs. Bernie Wijesiriwllrdena to expand the church parking area and to opeTate a preschool at 80S North First Avenue. LAND USE AND ZONING The subject site'is irregular in shape, composed of 16 lots. zoned R-2 and developed with the Foursquare Church, parking and a paved arell. Properties to the west are zoned R-2 and developed with ,single-family dwellings and the 210 Freeway. Properties to the north are zoned R-l and R-2 and developed with single- family dwellings. Properties to the east are zoned R-2 and R-l and developed with mixed residential uses." Properties to the south are developed with'the Foothill Freeway. (See attached Land Use and Zoning Map.) PROPOSAL AND ANAL~SIS Parking Area The applicant is proposing to add 38 parking spaces to the south of the existing parking area. The site presently has 45 spaces. The existing parking lot will be restriped to facilitate better traffic ~irculation. There will be a total of 83 parking spaces on the site. The church presently has an average attendance of 180 persons. The new parking area will be located to the rear of the properties at 701 and 711 North Pirst Avenue. Egress from the property will be from a driveway immediately south of the proposed . . I. fJ . C.U.P'. 76-8 2 preschool and a new exit adjacent to the Foothill Freeway. A 6-foot high block wall is proposed along the rear of the properties at 701 and 711 Nqrth Firs~ and along the southerly property line of 701 North First. The property to the south of 701 North First is vacant. The church is proposing a 4~-foot wide planting strip along First Avenue i~,this area. The remainder is proposed for future parking. The church is also proposing a wall along the rear of the properties at 44 and 48 Forest Avenue. There is lighting in the existing parking lot and they are proposing lighting in the new parking area. There is no landscaping proposed in the new parking lot. There are four trees which are proposed to remain. Two of the proposed parking spaces should be eliminated. Park- ing Space 83 does not allow for the proper turning area for Space 82, andSpace 70 could cause ,some traffic congestion problems for cars using the southerly exit. ,By redesigning ,the parking lot, an additional ten spaces could be provided in the north parking lot. The parking area should have directional signing to allow for proper traffic circulation within the lot. Parking spaces 47 through 58 are angled in the wrong direction and could cause serious traffic congestion. The six-foot high wall which runs through the middle of the parking area will remain. Wheel stops should be located adjacent to all walls, buildings and property lines. No trash enclos.ure is shown on the subject site. A lot consolidation would be necessary for the expansion of the parking area. The consolidation should include the property at 723-725 North First Avenue which is presently owned by the church and is included in the overall master plan for the 'church. Preschool The preschool will be located in the building immediately south of the sanctuary and will contain 1 ,953 square feet of indoor play area (excluding the porch). This building contains two restrooms, kitchen and office space and play area. The outdoor play area contains 1,160 square feet which would allow a maximum of 15 children. . . . . . C'.U.P. 76-8 3 The outdoor play area is paved with asphalt and enclosed with a three-foot high chain link fence.' Code requires a six-foot high masonry wall. Due to the location of the play area, the Planning Department does not believe that the three-foot high fence would create a problem. There is adequate off-street parking and loading area. Prior to 1968, a preschool was operated at this location. Pursuant to the provision of the California Environmental Quality Act, the Planning Department reviewed the proposed application and determined that the 'proposal w,ould not have a Significant effect on the environment. A Negative Declaration has been prepared and filed for this project. The Planning Corom!'ss ion in its approval or denial ,of the proposed conditional use permit must make the determination that the proposed project would or would not have a substantial adverse impact on the environment. RECOMMENDAT ION The Planning Department recommends approval of C.U.P. 76-8 subject to the following conditions: That a lot consolidation be filed, approved and recorded for the subject site. That an irrigation plan for the new parking area be sub- mitted to and approved by the Planning Department. That a lighting plan for the new parking area be submitted to and approved by the Planning Department. That wheel stops be provided adjacent, to any walls, build- ings and/or property lines. That a revised parking plan be submitted to and approved by the Planning Department. That painted directional signs be provided in the parking area and driveways. 7.
