RES.OLUTION NO. 931 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A ZONE VARIANCE FOR A LOT OF SUBSTANDARD WIDTH AT 1211 SOUTH SAN.TA ANITA AVENUE. WHEREAS, on February 11, 1976, Mr. I. S. Longo filed an application for a lot split (Planning'Department Case No. L-76-6) accompanied by a variance for a lot (Parcel No. 1) with a width of 65.40 feet in lieu of 75 feet required (Planning Department Case No. V-76-2) on property commonly known as 1211 South Sa~ta Anita Avenue, more particularly described as foliows: Lot 14, Tract No. 15582, Map Book 350, page 33. EXCEPT the north 100.00 feet of the east 135.00 feet thereof. WHEREAS, a public hearing was held on said matter on Feb- ruary 24, 1976 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE" THE PL.ANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. SECTION 2,. This Commission finds that: 1. That there are exceptional or extraordinary circum- stances or conditions applicable to the property involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity. 2. That the granting of such variance will not be materially detrimental to the public health or welfare or injurious -1- 931 . . . . . to the property or improvements in such zone ot vicinity in which the property is located. 3. That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and. vicinity. 4. That the granting of such variance will not adversely affect the comprehensive general plan. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a variance for a lot of substandard width at 1-211 South Santa Anita Avenue, Planning Department Case No. V-76-2. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. February 24, 1976 TO: PLANNING CO~lISSION FROM: SUBJECT: PLANNING DEPARTMENT LOT SPLIT L-76-6 AND ZONE VARIANCp V-76-2 1121 SOUTH SANTA ANITA AVENUE APPLICATION This application was filed by Sam Longo and proposes to create two lots from one lot at 1121 South Santa Anita Avenue. The applicant is also requesting a zone varianc.e to allow one of the new'lots to have a width of 65.45 feet in lieu of 75 feet req'ui red i~ a R-l zone. LAND USE AND ZONING The subject site is zoned R-l, 7,500 a.nd developed with a single family dwelling. All adjacent properties are zoned R-l, 7,500 and developed with single-family residential uses. HISTORY The Planning Commission approved a similar proposed lot split (L-64-l4) in August 1964. The applicant did not take the appropriate steps to complete the approved lot split and the approval expired. PROPOSAL AND ANALYSIS The applicant proposes to create t~o lots from one lot which is located on the northwest corner of Santa Anita Avenue and La Sierra Drive. The existing lot contains 26,775 square feet of lot- area. The two new lots would have the following approximate characteristics: LOt 1 2 WIDTH DEPTH TOT AL AREA 201..25 135.00 13,165 square feet , 13,610 square feet 65.40 101. 25 Lot No. 1 does not meet the minimum lot width requirement of 75 feet. Lot No.2 meets all code requirements. . . . .. . The requested variance, if granted, would provide for lots more consistent with other lots in the area. Pursuant to the provision of the California Environmental Quality Act, the Planning Department reviewed the proposed lot split and determined that the proposal would not have a significant effect on the environment. A Negative Declaration has been prepared and filed for this lot split. The City Council in its approval or denial of the proposed lot split and variance must make the determination that the proposed lot split and variance would or would not have a substantial adverse impact on the environment. RECOMMENDATION The Planning Department recommends approval of Lot Split L-76-6 sub- ject to the attached conditions. 1. Conditions as outlined in the attached report from the Depart- ment of Public Works ~hall be complied with to the satisfaction of the Director of Public Works. 2. That all existing buildings and structures be removed. 3. Approval of Variance V-76-2. The Planning Department recommends approval of Variance V-76-2 with the following findings: 1. SANTA ANITA AVENUE The following items should be made condLtions of approval of the subject lot split: 1. The preparation and recordation of a parcel map in accordance with the requirements of the State Subdivision Map Act 4nder the Government Code. The map shall be submitted to the County Engineer for checking, and after checking, the County Engineer "s letter recommending approval and map shall be submitted to the City Engineer for map certification. Concurrent with the map being submitted to the County Engineer for checking, the applicant should submit a copy of the City's conditional requirements to enable the County Engineer to check for applicable conditions. 2. The existing block wall on La Sierra Drive, in front of Parcel I, exceeds the height allowed by Section 9283.8.7 of the Arcadia 'Municipal Code. It should be removed or reduced in height to four feet to comply with the Code. 3. Remove all buildings and walks from both parcels. 4. Provide the necessary easements for rear property utility service to both parcels. 5. Close existing curb depression in front of Parcell or construct P.C.C. drive aprons per City Standards. 6.
