RESOLUTION NO. 930 A RESOLUTION OF THE PLAN.NING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDI- TIONAL USE PERMIT TO OPERATE A MUSIC SCHOOL AT 56 LA PORTE STREET. WHEREAS, on February 10, 1976, an application was filed by Dorothy Jane Ulinski to operate a music school, Planning Department Case No. 76-5, on property commonly known as 56 La Porte Street, more particularly described as follows: Lot 19, Block 80 of the Arcadia Santa Anita Tract as recorded in Book 15, pages 89 and 90, of Miscellaneous Records. in the office of the Los Angeles County Recorder. WHEREAS, a public hearing was held on said matter on February 24, 1976, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Plan- ning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property. or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. -1- 930 . . . . . 3. The site for the proposed use is adequate in size and shape to accommodate said use including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this commission grants a conditional use permit for a music school upon the following conditions: 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 76-5 and applicable regulatio~s of the Arcadia Municipal Code. 2. A covenant shall be recorded in the office of the County Recorder in a form approved by the City Attorney indicating that the owner of the property located at 53 La Porte Street shall continue to maintain such parking area for the use of the music school as long as said use is maintained. 3. That the parking area shall be maintained in accordance with Section 9266.4.6 and Section 9266.4.8 of the -2- 930 . . . Arcadia Municipal Code and that the required ten~foot front' yard setback shall be landscaped and irrigated as per Section 9266.2.9 of the Arcadia Municipal Code and shall be submitted to " the Planning Department for rev~ew and approval. 4. That the five-foot side yard setback on the westerly side of the subject site shall be maintained in accordance with Section 9266.2.9 of the Arcadia Municipal Code. or shall be paved to eliminate future maintenanc.e problems.. Such land- scaping or paving plan shall be submitted to the Planning Depart~ ment for review and approval. 5. That the following sections shall be modified: a. Section 926.6.2.2 to allow a 3' 8" front yard . setback in lieu, of 10 feet required. b. Section 9266.2.3 to allow an 8,000 square foot lot in lieu of 15,000 square feet required. c. Section 9266.2.4 to allow 87 percent lot coverage in lieu of 60 percent required. d. Section 9266.2.2.1 to allow a three~foot side yard setback on the easterly portion of the lot in lieu of five feet required, and allow a zero side yard .setback for the first 88 feet in lieu of five feet required on either side. e. Section 9266.2.6 to allow no off-street loading space in lieu of one space required. ,6. Repair damaged sections of sidewalk adjacent to the . -3- 930 '/ . . . . . . parking lot and remove excess weeds and vegetation from parkway area. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. February 24. 1976 TO: FROM: PLANNING COMMISSION PLANNING DEPARTMENT SUBJECT: C.U,P. 76-5 56 LA PORTE STREET APPLICATION This application was filed on February 10, 1976.by Dorothy Jane Ulinski and proposes to operate a music school at 56 La Porte Street. LAND USE AND ZONING The subject ~ite is zoned M-l and developed with industrial buildings. Properties to the north, south, east and west are zoned M-l and developed with'mixed residential dwellings and in- dustrial uses. (See the attached Land Use & Zoning Map.) PROPOSAL AND fu~ALYSIS The subject site contains 8,000 square feet and is developed with two attached buildings. The front building is occupied by a machine shop which contains 2,200 square feet and the pro- posed site for the music school which contains 2.,200 square feet. A metal fabricator shop is located in the back of this building, and contains 2,5,20 square feet. The total floor area for both buildings is 6,920 square feet. The applicant proposes to op~rate the music school from 4 p.m. to 9:30 p.m. Classes would be conducted by two instructors with five pupils each. The average age of the students range from ten to fifteen years. The students would be accompanied by an adult to the class. Restroom facilities are adequate for the proposed use. The proposed site is substandard in regards to the following items: 1. The building is located 3 feet 8 inches from the front property line in lieu of 10 feet required. Landscaping is provided ad- jacent to the building in this area. . . . C.li.P. 76-5 2 2. A 5 foot side yard ,setback is required on each side of a building in an M-l zone. The front building is built on the property line and the rear building has a 5 foot set- back on the westerly side and a 3 foot setback on the easterly side. The westerly side yard is overgrown with weeds. 3. The minimum lot size in an M-l zone is 15,000 square feet; the subject site contains only 8,000 square feet. 4. The site has a lot coverage of 87 percent; the maximum allowed is 60 percent. 5, Every main building must have a mln1.mUm of one off-street/off- alley loading spaci; the subject site has none. There is no parking on the subject site. Parking is located directly across the street at 53 La Porte. Twenty-eight parking spaces are provided in this lot; twenty-two parking spaces are required for the uses on the subject site; ten for the industrial uses and twelve for the proposed music school. . This parkin~ area is in a state of disrepair. There are several large holes and grass and weeds are growing in the parking area. A ten foot landscaped front setback area is required on St. Joseph Street, there is no landscaping in the iot. The Planning Department does not believe that the use of the music school would be detrimental to the area; the hours of operation are during nonbusiness hours'and this school would be a less in- tensive use of the property than a normal industrial facility. Pursuant to the provision of the California Environmental Quality Act, the Planning Department ,reviewed the proposed conditional use permit and determined that the proposal would not have a signifi- cant effect on the environment, A Negative Declaration has been prepared and filed for this conditional use permit. The Planning Commission in its approval or denial of the proposed conditional use permit must make the determination that the pro- posed condit.ional use permit would or would 'not have a s.ubstantial adverse impact on the environment, RECOMMENDATION . The Planning Department'recommends approval of C.li.P. 76-5 subject to the following conditions: 1. Conditions as outlined in the attached report from the Depart- ment of Public Works shall be complied with to the satisfaction of the Director of Public Works. . . . C.U.P. 76-5 3 2. A coven~nt shall be recorded in the office of the County Re- corder in a form approved by the City Attorney indicating that the owner of the property located at 53 La Porte Street shall continue to maintain such parking area for the use of the music school a~ long as said use is maintained. 3. That the parking area shall be maintained in accordance with Section 9266.4.6 and Section 9266.4.8 of the Arcadia Municipal Code and that the required ten foot front yard setb~ck shall be landscaped and irrigated as per Section 9266.2.9 of the Arcadia Municipal Code and shall be submitted to the Planning Department for review and approval. 4. Section 92662.2 to allow a 3' 8" front yard setback in lieu of ten feet allowed. b. Section 92662.3 to allow an 8,000 square foot lot in lieu of 15,000 square feet required. c. Section 9266.2,4 to allow 87 percent lot coverage in lieu of 60 percent required. d. Section 9266.2.2.1 to allow a three foot side yard setback on the easterly portion of the lot in lieu of five feet required. And allow a zero side yard setback for the first eighty-eightf~et in lieu of five feet required on either side. e.
