RESOLUTION NO. 927
.
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMI~ FOR AN EATING
ESTABLISHMENT AT 34 EAST DUARTE ROAD.
WHEREAS, on January 6, 1976, G & D 'Enterprises filed
an application for a donut shop eating establi~hment, Planning
Department, Case No. C.U.P. 76-3, on the property commonly known
as 34 East Duarte Road, more particularly described as follows:
Lot 7 and the easterly 2D feet of Lot 6 of Tract 13252
in the City of Arcadia, County of Los Angeles, State
of California as recprded in Book 345, pages 6-8, of
Maps in the office of the recorder of said County.
WHEREAS, a public hearing was held on said matter on
February 10, 1976, at which time all interested persons were given
full opportunity to be heaTd and to pTesent evidence;

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION L That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
we1 fare or inj urious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed u~e is adequate in size
. and shape to accommodate said use, including all yards, parking,
loading, landscaping and other ,features required to adjust said

use with the ~and and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of tr~ffic generated by the
propos:ed use.
S. The granting of such conditional use permit will not
adversely aff,ect the General Plan.
6. The use applied for will not have a substantial adverse
impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for an eating establishment upon the fOllowing conditions:
1. The property shall. be improved .and maintained in
accordance with the plans which are ort file in the subject Case
~ No. C.U.P. 76-3.
2. Plans shall comply with Sections 9262.4 through
9.262.4.12 and 9263.2 through 926:3.6.7 of the Arcadia Municipal Code.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commissi.on held on
the 24th day of February, 1976, by the following vote:

34 EAST DUARTE ROAD
APPLICATION
This application was filed on January 26, 1976 by G & D
Enterprises and proposes to bperate a donut shop at 34 East
Duarte Road.
LAND USE AND ZONING
The sub-j ect si te is zoned C- 2 & PR-l and develope.d wi.th a
vacant building. Propert"ies to the east are developed with an
alley and auto repair business and zoned C-2 and PR-I; proper-
ti~s to the south are developed with an alley and apartments
and zoned R-3; properties to the west are zoned C-2 and PR-3
and developed with general commercial uses; and properties to
the north are zoned C-2 & H and developed with general commercial
and residential uses. (See the attached Land Use and Zoning
Map. )
PROPOSAL AND ANALYSIS
The subject s.ite cont.ains approximately 13,350 square feet. The
proposed donut shop will contain 920 square feet and the outdoor
eating area will contain 375 square feet for a total area of
1,295 square feet.
A walk-up window is proposed to be located on the northerly
portion of the building. Six tables will be located inside the
building and two tables will be placed in the patio area. There
will be seating for approximately 30 people.
Twenty-six parking spaces are required for the proposed use; 19
spaces for the indoor eating facility and 7 additional spaces
for the outdoor dining area. The applicant is proposing 20
parking spaces.

Access to the property will be from one driveway and an alley off
of Duarte Road and from an alley to the rear of the property.
Hours of operation will be from 5:30 a.m. to 10:00 p.m.
Pursuant to the provision of the California Environmental
Quali ty Ac t" the Planning Department reviewed the proposed
conditional use permit and determined that the proposal would
not have a significant effect on the enviro~ment. A ~egative
Declaration has be~n prepared and filed for this project.
The Planning Commission in its approval or denial of the
proposed conditional use permit must make the determination
that the ~roposed project would or would not have a substantial
adverse impact on the environment.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 76-3,
subject to the following conditions:
1. Parking shall meet code requirements.
2. All mechanical equipment shall be screened from view.
. 3. All signs shall conform to co.de.
4. All planting areas shall be landscaped and provided with a
permanent irrigation system and be well maintained in
perpetui ty ,and shall be submLtted to the Planning
Department for its review and approval.
