RESOLUTION NO. 926
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR AN EATING
ESTABLISHMENT AND EXISTING ATTACHED DWELL-
ING IN A C-2 ZONE AT 1011 SOUTH BALDWIN
AVENUE.
WHEREAS, on December 30, 1975, Paul Leone filed an appli-
cation for an eating establishment and existing attached dwelling in
a C-2 zone, Planning Department Ca~e No. C.U.P. 76-2, on property
commonly known as 1011 South Baldwin Avenue, more particularly
described as follows:
Lot 2 of Tract 5220 in the City of Arcadia, County
of Los Angeles, State of California as recorded in
Book 55, page 2 of Maps described as follows:
Lot commencing north 3043' east 50.43 feet from
the southeast corner of Lot 2, then north 3043'
east 50.43 feet, then west on ngrth line of said
lot 163.70 fe5t, thence south 3 50' east 50 feet,
then north 86 10' east 157.07 feet to the begin-
ning of Lot 2.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Plan-
ning Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional usepermi t as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicini ty.
2. The uses applied for at the location indicated are
properly ones for which a conditional use permit is authorized.

3. The site for the proposed use is adequate in size
and shape to accommodate said uses including all yards, parking,
loading, landscaping and other features required to adjust said
uses with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated
by the proposed uses.
5. The uses applied for will not have a substantial
adverse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a ,conditional
use permit for an eating establishment and existing attached dwell-
ing in a C-2 zone subject to the following conditions:
1. The property shall be improved and maintained in
accordance with plans on file in the subject Case No. C.U.P. 76-2.
2. The seating shall be limited to 12 people.
3. Four parking spaces shall be provided to the rear of
the existing house and shall be striped as per the requirements of
Arcadia Municipal Code Section 9263.2.9.
4. Landscaping and irrigation shall be provided along
the southerly property line adjacent to the parking spaces, subject
to the review and approval of the Planning Director.
5. A trash enclosure shall be provided as per Section
9263.6.6 of the Arcadia Municipal Code adjacent to the s~orage
building and subject to the approval of the Planning Director.
6. A modification shall be granted to allow the
existing storage unit with attached roof to be located adjacent

to the property line in lieu of 20 feet required.
7. The area behind the storage building shall be properly
maintained.
8. A six-foot high block wall shall be constructed
along the westerly property line.
9~ All signs shall comply with Code.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to
the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission of the
City of Arcadia held on the 27th day of January, 1976, by the
following vote:

1011 SOUTH BALDWIN AVENUE
APPLICATION
This application was filed on December 30, 1975 by pjul Leone
and requests to operate an eating establishment and allow an
existing residence in a C-2 zone.
LAND USE AND ZONING
The subject site is zoned C-2 & Hand PR-3 and developed with
Leone's De,licatessen and an attached dwelling. Property to the
north is zoned C-2 & Hand RR-3 and developed with a 7.Eleven
Store. Properti.s to the east are zoned C-2 & H and developed
with offices, bowling alley and other general cOmmercial uses.
Properties to the south are zoned C- 2 & H and developed wi th
offices, Properties to the west are zoned PR-3 and R-3 and
developed ~ith multiple-family dwellings.
PROPOSAL AND ANALYSIS
The applicant requests a conditional use permit to op~rate an
eating establishment and to allow the existing house in the
C-2 & H zone. The subject site contains approximately 7,011
square feet. The delicatessen contains 880 square feet and
the house contains 1,188 square feet. A stOrage building
located in the rear of the lot contains 1,196 square feet,
The delica,tessen presently has four tables which seat a total
of 1-2 people. A conditional use permit was not obtained to
allow the addi,tion of the tables. There al'e no res troom
facilities in the delicatessen. The house contains two baths
and the applicant has stated that he does allow patrons to use
the restroom facilities located in the house. The applicant
has indicated he would be willing to remodel the restroom
facilities in the house to meet current Code requirements for
an eating establishment.
As per Code requirements, 20 parking spaces are required; 18
parking spaces for the eating establishment and two spaces for

the dwelling uni t, Parking is located to the rear of the
building and the applicant proposes five parking spaces, one
of which does not meet Code requirements in that it obstructs
egress from the lot. Access to the parking area is from a
10~-foot wide driveway off of Baldwin Avenue. Entrance to the
delicatessen is from Baldwin Avenue only, and anyone wishing
to use the parking area to the rear has ~o enter the building
from Baldwin Avenue.
A gate. is located across the driveway which remains open during
business hours, and the trash bin is located directly behind
the gate.
The storage building in the rear is located 18 feet from the
property line in lieu of 20 feet required by Code.
The applicant has indicated that the majority of his business
is take-out and that most of his sit-down business is during
the lunch hour. The hours of operation are from 9 a.m. to
8 p.m.
Staff does not believe that the continued operation of this
facility as an eating establishment is detrimental to the
area. Although parking is substandard, there is no available
land in the area to expand the parking, and it is doubtful
that any additional parking to the rear of this business would
be used by the customers due to the location of the entrance
to the delicatessen.
Pursuant to the provision of the California Environmental
Quality Act, the Planning Department reviewed the proposed
conditional use permit and determined that the proposal would
not have a significant effect on the environment. A Negative
Declaration has been prepared and filed for this project.
The Planning Commission in its approval or denial of the pro-
posed conditional use permit must make the determination that
the proposed project would or would not have a substantial
adverse impact on the environment.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 76-2
subject to the following conditions:
1. That conditions as outlined in the attached report from
the Department of Public Works shall be complied with to
the satisfaction of the Director of Public Works.
2. That the se*ting be limited to 12 people.
3. That four parking spaces be provided to the rear of the
existing house and be striped as per Code requirements
(Section 9263.3.9).
