RESOLUTION NO. 925
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A RESTAURANT
AT l025-l025~ SOUTH BALDWIN AVENUE.
WHEREAS, on December 17, 1975, A. H. Tsui filed an
application for a restaurant, Planning Department Case No. C.U.P.
75-22, on property commonly known as 1025-1025l::i South Baldwin
Avenue, more particularly described as fOllows:
Lots 3 and 4 of Tract 5220 in the City of Arcadia,
County of Los Angeles, State of California, as
per map recorded in Book 55, page 2 of Maps in
the office of the Recorder of said County.
WHEREAS, a public hearing was held on said matter on
. January 13, 1976, at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Plan-
ning Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.

3. The site for the proposed use is adequate in size

. and shape to accommodate said use including all yards, parking,
loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated
by the proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial

adverse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for a restaurant upon the following conditions:
1. The property shall be improved and maintained in
accordance with the plans which are on file in the subject Case
No. C.U.P. 75-22.
2. The existing expansion shall meet the Building Code
requirements and a building permit shall be obtained.
3. Restroom facilities shall comply with the Uniform
Plumbing Code.
4. All freestanding nonconforming signs shall comply
with Code.
5. China Inn shall join in as a co-applicant in M-75-155
for all existing freestanding nonconforming signs.
6. The northerly parking area shall be restriped to
. meet the requirements of Section 9263.3.8 of the Arcadia Municipal
Code.

7. This restaurant is in an existing shopping center on
Baldwin Avenue. One of the driveway aprons to the parking lot
has an eight to ten foot long jagged crack that creates a 1/2 to 3/4
inch "toe clip." To eliminate potential liability to the property
owner, it is recommended that the apron be repaired.
SECTION 4. The Secretary shall certify to th~adoption
of this resolution and shall cause a copy to be forwarded to
the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission of the
City of Arcadia held on the 27th day of January, 1976, by the

APPLICATION
This application was filed on December 17, 1975 by A. H. Tsui
and requests to operate a restaurant at 1025-1025~ South
Baldwin Avenue.
LAND USE AND ZONING
The subject site is located in the Baldwin Square Shopping
Center and is zoned C-Z & Hand PR-3. , The shopping center is
composed of three lots which are under two separate ownerships.
Other uses which occupy the shopping center are two cleaners,
an optical service, tax consultant office, guitar shop, King
Arthur's eating establishment (C.U.P. 71-7), dress sh6p, two
beauty shops, a bar, flower shop, medical supply store and the
Burger Forum eating establishment. Property to the north is
zoned C-2 & Hand PR-3 and developed with offices; properties
to the east across Baldwin Avenue are zoned C-2 & H and developed
with a bowling alley and bank; property to the south across
Arcadia Avenue is zoned C- 2 & H and developed with the Goodyear
tire service; and properties to the west are zoned R-3 and
developed with multiple-family dwellings (see the attached Land
Use and Zoning Map).
PROPOSAL AND ANALYSIS
The applicant requests to operate a restaurant at 1025-1025~
South Baldwin Avenue. The restaurant is presently conducting
business at this site. The China Inn was originally located
at 1025 South Baldwin only and was a legal nonconforming use.
(Previous eating facilities had operated in that location since
1965.) In July 1975, the China Inn expanded its present opera-
tion to 1025~ South Baldwin. The applicant did not apply for
a conditional use permit nor a building permit.
The main dining area is now located at 10Z5~ with the kitchen
and additional eating area located at 1025 South Baldwin.

The shopping center complex contains approximately 49,594 square
feet with the existing buildings occupying 23,666 square feet.
The applicant's restaurant occupies 2,175 square feet and seats
approximately 50 person.
Present restroom facilities for the China Inn are substandard.
The shopping center is substandard in terms of parking spaces
and landscaping. Present Code requirements as applied to this
shopping center complex would require 186 parking spaces;
55 parking spaces exist.
The shopping center contains three lots which have two separate
ownerships (see Map 1). Lots A and B are owned by Fr~nk Gioia
and Lot C is owned by Henry Sharp.

closed, and that luncheon trade is minimal.
Staff does not feel that the expansion of the restaurant would
create a greater parking problem than what presently exists.
However, if the use of this restaurant should be terminated
and another restaurant occupy said area, the parking problem
could be compounded.

Pursuant to the provisions of the California Environmental
Quality Act, the Planning Department reviewed the proposed con-
ditional use permit and determined that the proposal would not

have a significant effect on the environment. A Negative
Declaration has been prepared and filed for this project,
The Planning Commission in its approval or denial of the pro-
posed conditional use permit must make the determination that
the proposed project would or would not have a substantial
adverse impact on the environment.
RECOMMENDATION
The Planning Department does not feel that the expansion of this
restaurant would be detrimental to the area and, therefore,
recommends approval of C.U.P. 75-22 subject to the following
condi,tions:
1. That the existing expansion meet the Building Code require-
ments and a building permit be obtained.
2. That restroom facilities shall comply with the Uniform
Plumbing Code.
3. That all freestanding nonconforming signs shall comply
wi th Code..
4. Conditions as outlined in the attached report from the
Department of Public Works shali be complied with to the
satisfaction of the Director of Public Works.
