January 13, 1976 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 75-22 1025-1025~ SOUTH BALDWIN AVENUE APPLICATION This application was filed on December 17, 1975 by A. H. Tsui and requests to operate a restaurant at 1025-1025~ South Baldwin Avenue. LAND USE AND ZONING The subject site is located in the Baldwin Square Shopping Center and is zoned C-Z & Hand PR-3. , The shopping center is composed of three lots which are under two separate ownerships. Other uses which occupy the shopping center are two cleaners, an optical service, tax consultant office, guitar shop, King Arthur's eating establishment (C.U.P. 71-7), dress sh6p, two beauty shops, a bar, flower shop, medical supply store and the Burger Forum eating establishment. Property to the north is zoned C-2 & Hand PR-3 and developed with offices; properties to the east across Baldwin Avenue are zoned C-2 & H and developed with a bowling alley and bank; property to the south across Arcadia Avenue is zoned C- 2 & H and developed with the Goodyear tire service; and properties to the west are zoned R-3 and developed with multiple-family dwellings (see the attached Land Use and Zoning Map). PROPOSAL AND ANALYSIS The applicant requests to operate a restaurant at 1025-1025~ South Baldwin Avenue. The restaurant is presently conducting business at this site. The China Inn was originally located at 1025 South Baldwin only and was a legal nonconforming use. (Previous eating facilities had operated in that location since 1965.) In July 1975, the China Inn expanded its present opera- tion to 1025~ South Baldwin. The applicant did not apply for a conditional use permit nor a building permit. The main dining area is now located at 10Z5~ with the kitchen and additional eating area located at 1025 South Baldwin. (See the attached floor plan.) . . C.U.P. 75-22 2 . The shopping center complex contains approximately 49,594 square feet with the existing buildings occupying 23,666 square feet. The applicant's restaurant occupies 2,175 square feet and seats approximately 50 person. Present restroom facilities for the China Inn are substandard. The shopping center is substandard in terms of parking spaces and landscaping. Present Code requirements as applied to this shopping center complex would require 186 parking spaces; 55 parking spaces exist. The shopping center contains three lots which have two separate ownerships (see Map 1). Lots A and B are owned by Fr~nk Gioia and Lot C is owned by Henry Sharp. The follow~ng table indicates the parking available and the required parking for each lot: . Lot A B C Existing Parking lOl:! 25l:! 19 'IT Required Parki:ng 54 73 59 no The shopping cent.er is located in an area where further expan- sion of the parking area is impossible. The lot on which the China Inn is located was improved with landscaping and a wall as required by C.U.P. 71-7 for King Arthur's eating establi~hment. The remainder of the complex is substandard in regard to landscaping. Signing for the be brought into Municipal Code. nonconforming. shopping complex is nonconforming and must conformance as per Section 9262.4.3F of the The China Inn has a freestanding sign which is The ~pplicant has indicated that the major portion of his business is in the evening when most of the other shops are closed, and that luncheon trade is minimal. Staff does not feel that the expansion of the restaurant would create a greater parking problem than what presently exists. However, if the use of this restaurant should be terminated and another restaurant occupy said area, the parking problem could be compounded. . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department reviewed the proposed con- ditional use permit and determined that the proposal would not . . . . . c. U . P. 7 5 - 22 3 have a significant effect on the environment. A Negative Declaration has been prepared and filed for this project, The Planning Commission in its approval or denial of the pro- posed conditional use permit must make the determination that the proposed project would or would not have a substantial adverse impact on the environment. RECOMMENDATION The Planning Department does not feel that the expansion of this restaurant would be detrimental to the area and, therefore, recommends approval of C.U.P. 75-22 subject to the following condi, tions: 1. That the existing expansion meet the Building Code require- ments and a building permit be obtained. 2. That restroom facilities shall comply with the Uniform Plumbing Code. 3. That all freestanding nonconforming signs shall comply wi th Code.. 4. Conditions as outlined in the attached report from the Department of Public Works shali be complied with to the satisfaction of the Director of Public Works. D NNA L.
