RESOLUTI ON NO. 923 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A ZONE VARIANCE FOR THE USE OF A PORTION OF THE SANTA ANITA RACE TRACK PARKING LOT LOCATED NEAR THE INTERSECTION OF COLORADO PLACE AND HUNTINGTON DRIVE. WHEREAS, on December 18, 1975, Martin Yurich, on behalf of the Westerner Restaurant, filed an application for the use of a portion of the Santa Anita Race Track parking area to supplement the parking of the Westerner Restaurant, P,lanning Department , Case No. V-75-3, on the property located near the intersection of Colorado Place and Huntington Drive, more particularly described as follows: Part of Lot 1, Tract 949 in the City of Arcadia, County of Los Angeles, State of California, as pe,r Map Book 17 ,page 13 as recorded in the office of the Recorder of said County. WHEREAS, a public hearing was held on said matter on December 3D, 1975 at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1. That there are exceptional or extraordinary circum- stances or condi tions applicable to fhe property involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity. -1- 923 ~. ~' . . . That the granting of such variance will not be materially de,trimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which the property is located. 3. That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity, 4. That the granting of such variance will not adversely affect the comprehensive general plan, SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission. gcrants a zone variance to use a portion of the Santa Anita Race Track parking to supplement the parking of tlieWesterner Restaurant with the conditions that the property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. V-75-3, and that lighting be installed and maintained to the satisfaction of the Public Works Director. SECTION 4. December 3D, 1975 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: ZONE VARIANCE V-75-3 APPLICANT The application was filed by Martin Yurich on December 18, 1975 requesting a zone variance to use a portion of the Santa Anita Race Track parking to supplement the parking of the Westerner Restaurant. The proposed application requires a zone variinc~ from the City because the race track parking lot is zoned S-l which does not permit parking for commercial uses other than those allowed in the S-l Zone. LAND USE AND ZONING The subject site is zoned S-l and developed with a portion of the Santa Anita Race Track parking lot. Properties to the northeast are zoned C-2 and developed with the Westerner Restaurant and the Westerner Motel. Properties to the south- east are zoned S-l and developed with the race track entrance and parking area. Properties to the west are zoned R-l and developed wi th the Arcadia Wash and race track parking. (See the ittached Land Use and Zoning Map.) PROPOSAL AND ANALYSIS The site which the Western~Restaurant proposes to use is located directly actoss Colorado Place (see Map A) and will be entered from a 38-foot driveway located approximately 65 feet south of the center line of San Juan Drive. This parking area contains 76 parking spaces, The Westerner Restaurant site con- tains 52 parking spaces which would create a total of 128 spaces. Landscaping is located along Colorado Place, the Wash, and along the southerly and easterly boundary of the area. The applicant proposes to use this area in addition to the parking at the restaurant in order to alleviate the parking . . . . . V-7S-3 2 problems on San Juan, Santa Cruz and Santa Rosa Drives. Other methods attempted to ease the parking problem in the area such as "No Parking" signs, red curbing and policing have not been totally successful. The property on which the Westerner Restaurant is located is landlocked with no possibility for expansion of the parking area. The only nearby parking is the race track which is in the wrong zone and, therefore, creates an exceptional circumstance which requires a zone variance. The restaurant would utilize this parking area during evening hours and its use would not conflict with that of the race track. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department reviewed the proposed zone variance and determined th~t the proposal would not have a significant effect on the environment. A Negative Declaration has been prepared and filed for this project. The Planning Commis.sion in its approval or denial of the pro- posed zone variance must make the determination that the 'proposed variance would or would not have a substantial adverse impact on the environment. RECOMMENDATION The Santa Anita Race Track is a permi,tted activity in the Sol Zone and is a commercial/recreational use. The subject site is presently used for parking by this facility. The Planning Department believes the use of this parking area by the Westerner Restaurant would be consistent with its present use ~nd consis- tent with the General Plan and, therefore, recommends approval of V-7S-3. Should the Planning Commission wish to approve this application for a zone variance, the Commission should make the following findings: 1. That t,here are exceptional or extraordinary circumstances, or conditions applicable to the property involved, or to the intended use of the property, that do not 'apply generally to the property or class of use in the same zone or vicinity. 2. That the granting of such variance will not be materially detrimental to the public health or welfare or injuriouS to the property or improvements in such zone or vicinity in which the property is located, 3. That such variance is necessary for the preservation and enjoyment of a substantial property right of the . . . .. . V-75-3 3 4. applicant possessed by other property in the same zone and vicinity.
