RESOLUTION NO. 905 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 1409-1411 SOUTH BALDWIN AVENUE. WHEREAS, on July 28., 1975, Moffett Enterprise's, Inc. i filed an application for a restaurant, Planning Department Case No. C~U.P. 75-13, on the property commonly known as 1409-1411 South Baldwin, more particularly described-as follows: Parcel Map 1411 in the City of Arcadia, County. of Los Angeles, State of California, as per Book 23, Page 84 of Parcel Maps. - WHEREAS, a public hearing was held on said matter on August 12, 1975, at which time all interested persons were given full opportunity to be hearp. and to present evidence: NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESO~VES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff'report. is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after.provided will not be detrimental to the public health or welfare'or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. -1- 905 . . . ... 3. The, site for the proposed use is adequate in size and shape to accommodate said'use, and all. yards, parking, loading, landscaping and other features required to adjust said use with the land uses in the neighborhood. 4. The'site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the pro- posed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The' use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Counl=il, this Commission grants a conditional, . use permit for a restaurant upon the fol'lowing conditions: 1. The property shall be improved and maintained in accordance with the, plans which are on file in the subject Case No. C.U.P.75-13. 2. ' Al~ outside trash and garbage collection areas for the proposed use shall.be paved and enclosed' on, at le;;'lst three vertical sides by a five foot, high solid impact resistant,wall,constructed of easily cleanable material. 3. All signs shall comply with code. 4. All exterior mounted mechanical equipment shall be screened from public view. -2- 905 . , . . ". . . ~ 5. That a modification is. hereby granted allowing twenty- one parking spaces, in lieu of twenty-four required for the proposed use (314 for the total site in lieu of 317 required). SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City council of the City of Arcadia.
