RESOLUTION NO. 896
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A RESTAURANT
AT 158 WEST LAS, TUNAS. DRIVE.
WHEREAS, on May 27,.1975, La Donna Cowger, filed an application
to operate a restaurant,. Planning Department.'Case No."C'.U.P. 75-9 on
the property commonly known,'as 158, West Las,'Tunas"Drive, more particu-
larly described as. follows:
Portion of lot '68, SElIlta'. Anita. Colony,'Tract 'within the City
of Arcadia" County.'of 'Los. Angeles I 'State.'of 'California, as
per map'recorded'in Book'42;,Page 87, of. Maps in' the office
of the Los Angeles County Recorder.
WHEREAS; apubaic hearing was held~on.said matter on June 10,
1975 at which time all interested, persons,'were 'given full opportunity
to be heard and to' present evidence;
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff. report is true and correct.
SECTION 2. This Commission, finds that:
1. The granting of a.conditional use permit as hereinafter
provided will not be detrimental to the,'public: health 'or welfare or
injurious to the property or improvements' in such'zone--or vicinity.
2. The use applied for at the location indicated is
properly one forwhich:'a conditional use permit "is authorized.
3. The site for the, proposed use'is adequate in size and
shape to accornmodate, said use, 'including all yards, parking, loading,
landscaping and other features required to adjust said use with the
land and uses in the neighborhood.

4. The site abuts streets and 'highways adequate in width
. and pavement type to carry the kind of, traffic generated by the
proposed use.
5. The granting of such,conditionai use' permit will not
adversely affect the General. Plan.
6. The use applied for.'will not have a substantial adverse
impact on the environment.
SECTION 3. That for the. foregoing reasons, subject to
approval of the, City, Council"this Commission grants a conditional
use permit for a' restaurant, upon the, followincr'conditions:
1. The 'property.' shall. be improved and 'maintained in
accordance with the, plans, which are, on' file, in the subject Case No.

All-signs in the, shopping'center.'sha:1:1 conform to code.
All trash areas shall:'cornply.'with code.
All exterior mounted mechanical. equipment shall be
screened from view.
5. All parking areas shall comply with code.
6. A minimum of 3 percent of the interior of the parking
area shall be landscaped and permanently irrigated. Landscape plans
shall be submitted to the,Planning.'Department for review and approvaL
7. Staff recornrnends.'that the Commission waive the requirement
for a five foot,planting strip, along Las Tunas and Live Oak but require
the parkway areas to be landscaped and, permanently irrigated and. a three
foot high ornamental wall be installed. along this area; Said plan shall
be SUbject to the approval of the Planning Department.

8. That the Commission grant' a modification' of the parking
. requirements for 65 spaces in lieu of 107 spaces.
SECTION 4. The Secretary.shall certify to the adoption of
this resolution and shall cause a copy to be forwarded to the City Council
of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting" of the, Planning"Commission, of the, City of Arcadia
held on the 24th day of June, 1975, by the following vote:
