HomeMy WebLinkAbout0890 . . . , ' .r . . ~ ~ " RESOLUTION NO. 890 A RESOLUTION OF THE PLANNING' COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 850 SOUTH BALDWIN AVENUE WHEREAS, on April 7, 1975, South Pacific Restaurant, Inc. filed an application to construct and operate a restaurant" Planning Department Case No. C.U.P. 75-7, on the property commonly known as 450 South Baldwin Avenue, more particularly described as follows: Lots 11 and 12 of Tract Number 6985, City of Arcadia, County of Los Angeles, as per Map recorded in Book 106, Page 53. WHEREAS, a public hearing was held on said matter on April 22, 1975 at which time all interested persons were given f.ull opportunity to'be heard and to present evidence; NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is presumed to be true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not, be detrimental to the public health ~r welfare or injurious to the property or improveme~ts in such zone or vicinity. -1- 890 .. .. . . ., . 2. The use applied for at the location indicated is prop~rly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and'pavement type to carry the kind of traffic generated by the prbposed'use. 5; "The'granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial ~ adVerse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional us~ permit for a restaurant upon the following conditions: 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 75-7. 2. All signs shall comply with code. 3. That Section 9263.3.15 of the Arcadia Municipal Code be modified to permit a three foot high landscaped berm along Baldwin Avenue side of the parking lot in lieu of a three foot high block wall required by code. ~ 4. That a revised parking plan be submitted for approval of the Planning Director. ,-2- 890 . . ." ". . . 5. That all existing walls over six feet in height be reduced tc a maximum of six feet. 6. That a landscaping and irrigation plan shall be sub- mitted for approval of the Planning Director. 7. That all mechanical equipment shall be completely screened from view. 8. That low~level lighting be used in t~e parking area subject to the approval of the Planning Department. 9. 10. That utility easements be provided as necessary. , That a six foot high wall will be maintained between the parking area and all ~djacent residential properties. 11. April 22, 1975 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 75-7 850 SOUTH BALDWIN AVENUE SOUTH PACIFIC RESTAURANT APPLICATION This applicatiGn was filed on April 7, 1975 by -South Pacific Restaurant, Inc., for property locateda~ 850 South Baldwin Avenue. The applicant proposes 'to construct a" restaurant. PRESENT LAND USE AND ZONING . The subject site is developed 'with an existing 'vacant building (formerly auto showroom and shops)' constructed "'in 1954 and zoned C-2 and PR-2. Property to" th'e north,' south and west is zoned C-2 and developed with commercial uses, property to the east is zoned R-3 and developed with older residential uses. PROPOSAL AND ANALYSIS The subject property is irreguiar in shape, conta!i:ning approxi- mately 31,568 square feet.' 'The app:1:icant plans to remodel the existing building, enclose a portion'of the old auto ser- vice bays and 'demolish the remaining service bays. The applicant plans to utilize the old auto showroom for the dining area and convert'the remaining ,auto service bays into a kitchen area. The, total building area would be 4,590 square feet, ,and "the, ,total seating' capacity is' projec,ted by the applicant to be 167 (:158 in the. dining area and 9 at the bar). Proposed landscaping for the site includes several large plan- ters and 3~ foot wide planters adjacent to the perimeter of the parking area. On-site landscaping consists of approximately 3,000 square feet or 12,.4% of the parking ?rea i which exceeds code requirements by 9.4%. The 'proposed plan for- the parking lot provides for 49 parking spaces (three more' than required by code). Staff feels the proposed parking lot could be re- vised to create additional parking spaces and facilitate im- proved vehicular access to the parking spaces. . . . . c . U . P. 75- 7 2 Pursuant to the prov~s~ons of the California Environmental Quality Act, the Planning Department,reviewed the ,proposed conditional ,use permit and determined that the proposal would not have a significant effect on the environment. A negative declaration has been prepared and filed for" this proposal. 'the Planning Commission in its approval, or, :denial of the pro- posed conditional use ,permit ,must" make ,:the determination that the proposal would"or'would not 'have a substantial'adverse impact on the environment. RECOMMENDATION The Planning Department recommends approval of'C.U.P. 75-7 subject to the following conditions: 1. Conditions as' outl,ined in the attached report from the Department of,Public'Works shall be complied with to the satisfaction of the Director of Public Works. 2. All signs shall comply with code. . 3.
