RESOLUTION NO. 889
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PE~IT FOR A RESTAURANT
AT 400 SOUTH BALDWIN AVENUE
WHEREAS, on April 2" 1975, J. c. Penny Co., Inc. filed
,an', application to construct and operate a restaurant, Planning
'Department Case. No. C. U.P. 75'-5, on the property commonly known
as 400'South Baldwin Avenue, more particularly described as
fo1lows:

Parcel 2 of Parcel Map 4626, City of Arcadia, County of
Los Angeles, State of, California, as per Parcel Map Book
50-51" in'.the office 'of the Los Angeles County Recorder.
WHEREAS" ,a' public, hearing .was held on said matter on
April 22, '19;75 at which time all interested persons were given
full opportunity to be heard and'to present evidence;
'NOW, THEREFORf:;, ['HE PLANNJ:NG, COMMISSION OF THE CITY OF
ARCAD!I:A'HEREBY"RESOLVESAS FOLLOWS:
SECTION 1. That 'the,'factual"data. submitted by the Planning
Department in, the attached"staff report is presumed to be true
ana correct.
SECTION 2. This' Commission finds that:
l~ The granting of a conditional use permit as herein-
after provided, will not be detrimental to the public health or
welfare.- or, injurious: to, ,the property or improvements in such zone
. or vicinity.

2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and,$hape to accommodate said use, including all yards, parking,
loading, landscaping, and other features required to adjust said
use ~ith the land and uses in the neighborhood.
4. The, site abuts, streets'and highways adequate in width
and'pavement type to carry the kind of traffic generated by the
propo,sed use.
5,. The 'granting"of' 'such' conditional use permit' will not
adverseiy affect 'tne-General Plan.
6. "The',lise, applied fQr will not have a,substantial
adverse impact on the environment.
SECTION '3'. That for the foregoing reasons, subject to
