HomeMy WebLinkAbout0887 . . . . .' f, RESOLUTION NO. 887 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 1400 SOUTH BALDWIN AVENUE. WHEREAS, on March 10, 1975, Eric Greene filed an application for a restaurant, Planning Department Case No. C.U.P. 75-3, on the property commonly known as 1400 South Baldwin Avenue, more particularly described as follows: Lots 28 and 29 of Tract 4611 in the City of Arcadia as per map recorded in Book 51, Page 82 of maps, except from Lot 29 the westerly 20 'feet thereof. Also except from Lot 28 that portion described as follows: Beginning at the northwesterly corner of said lot, thence southerly along the westerly line of said lot to the southwesterly corner'thereof, thence easterly along the southerly line of said lot to a line that is parallel with and distant 20' easterly of 'said westerly line, thence northerly'14.5i feet along said parallel line to the beginning of a tangent curve concave to the southeast and having a radius of 15.00 feet; thence northerly and easterly along said curve through a central angle of 740 58" 29" a distance of 19.63 feet; thence tangent to said curve north 780 44' 29" east 161.15 feet, to the northeast corner of said lot; thence north 890 59' 30" west along the north line of said lot a distance of 187.15 feet to the point of beginning. vlliEREAS, a public hearing was held on said matter on March 25, 1975, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE pLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: -1- 887 . . . .' .' SECTION 1. That the factual data submitted by the Plannipg Department in the attached staff report is true and correct, SECTION 2. This Commis,sion finds that: 1. The granting of a conditional use permit as herein_ after provided will not ~e detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is pro- perly one for which a conditional use permit is authorized, , 3. The site for the proposed use is adequate in size and' shape to accommodate said use, inCluding all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width, and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. As a policy statement only, the Commission is of the opinion that the applicant should not be responsible for sub_ surface conditions under the, public right-of-way. SECTION 4. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for a restaurant upon the following conditions: -2- 887 . . . . .) 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 75-3.. 2. That the parking area be restriped to conform to current marking and stall size requirements. 3. That a modification of the number of parking spaces be granted for 27 spaces in lieu of'35 required. 4 . 'That a trash enclosure be provided as per code. 5. That landscape plans showing permanent irrigation system to all planting areas be submitted to and subject to approval of the Planning Department. 6. I I All remodeling must comply with Building Code require- ments. 7. Install three (3) fifteen (15) gallon liquid amber trees at locations to be approved by the Director of Public l'lorks, per City standard. 8. Remove and replace approximately 22 linear feet of ten foot wide sidewalk on Naomi Avenue that is not to correct grade. Removal limits to be approved by the Director of Public Works. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -3- 887 . '. . - . .
