RESOLUTION NO. 881
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT TO EXPAND AN
EXISTING RESTAURANT AT 226-230 NORTH
FIRST AVENUE.
WHEREAS, on January 13, 1975, Acapulco Mexican Restaurants,
filed an application to enlarge and remodel the res,troom facilities
at an existing restaurant, Planning Department Case No. C.U.P. 75-2
on the property commonly known as 226-230 North First Avenue, more
particularly described as follows:
Lots 34, 35 and 36, Block 79 of Arcadia Santa Anita Tract,
in the City of Arcadia, County of Los Angeles, State of
California, as per map recorded in Book 15 Pages 89 and
90 of Miscellaneous Records, in the office of the County
Recorder of said County. Except the easterly 40 feet of
said Lots 34, 35 and 36.
WHEREAS, a public hearing was held on said matter on
January 28, 1975, at which time all interested persons were given
full opportunity to be heard and to' present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION L That the factual data submi'tted by ,the Planning
Department in the attached staff report is true 'and correct.
SECTION 2. This Commission finds that:
1. The granting'ofa conditional 'usepermit as hereinafter
provided will not be detrimental to the public'hearlth'or welfare or
injurious to the property or improvements in such zone or vicinity.

2. The use applied for at the :Cocation indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use'is adequate in size
and shape to accommodate s,aid use, including all yards, parking
loading, landscaping and other features required to adjust said use
with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of'such conditional"use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial
... adverse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council," this Commission grants a conditional
use permit to enlarge and remodel the restroom'facil~ties at an
existing restaurant upon the following conditions:
1. The property shall be improved and maintained in
accordance with the plans which are on file in Case No. C.D.P. 73-13
and 74-2.
2. Except a's herein modified, all regulations' of the
Arcadia Municipal Code shall be complied with.
3. That S,ection 9266.2.8. of the Arcadia Municipal Code
be modified to permit one wall sign on the west side of the building
to be 174 square feet in lieu of 41 square 'feet allowed.

. 4. That Section 9266.4.4 of the Arcadia Municipal Code be
modified to permit 21 feet of backing distance in lieu of 25 feet
required by code for two spaces adjacent to the pro~osed addition,
and that these two spaces be designated 'employee parking only.
5. All remodeling must comply with Building' Code 'require-
men ts .
6. The property shall be improved "and maintained in
accordance with the plans' which are' on, -file 'in the' subject Case No.
C.U.P. 75-2.
SECTION 4. The Secretary shall certify.to.the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

I HEREBY CERTIFY that the foregoing resolution' was adopted
at a regular meeting of the Planning Commission held on the 11th day
of February, 1975, by the following vote:
