RESOLUTION NO. 877
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT TO :OPERATE AN OUTDOOR EATING
ESTABLISHMENT AT' l2l2-'SOUTH 'BALDWIN AVENUE.
WHEREAS" on November' 25.. "1974, Ahthony' s . Italian Gourmet
filed an application for"an'.outdoor eating'establishment, Planning
Department Case No. C.V.P. 74-25, on the property commonly known
as 1212 South Baldwin Avenue, more 'particularly described as follows:
Lot 2, the north 56' of said lot, of Tract 5659 per
map recorded in' Book 115,' Page' 100, in the office
of the Records.'of~'bos" Angeles County.
WHEREAS.. a public hearing was held -on' said matter on
December 10, 1974, at which time all interested persons were given
full opportunity to be heard and to present ev,idence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
SECTlON 2'. This Commission finds that:
1. The granting of a"conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.

3, The site fer the propesed use is adequate'in size
and shape to. accemmedate"said use, including all yards; parking,
loading, landscaping and "ether features required to. adjust. said
use with the land and us es' in' the' neighberheed.
4. The site abuts streets and highways adequate in
width and pavement type to.' carry"the kind ef traffic generated
by the prepesed use.
5. The granting"ef'such'cenditienai use permit will net
adversely affect the General' Plan.
6. The use applied fer will not have-a"substantial
adverse impact en the envirenment.
SECTION 3. That for the foregeing reasons, subject to
. appreval ef the City Ceuncil, this Commission grants a conditional
use permit for an eutdeer eating 'establishment ,upen,..the follewing
cenditions:

1. The property sha11 "be 'improved-and maintained in
accordance with the plans which are on'file'.in' the subject
Case No.. C.U.P. 74-25.
2. The trash area shal1',be. subj-ect to the Planning
Director's appreval.
3. The parking spaces immediately'behind and adjacent
to. the patio. be striped aild whee'l"steps shall be- required.
4. Any eutdeer lighting be'ne mere thail 15 feet abeve the
patio. grade and be directed' away" frem adjoining parking and circu-
latien areas.

5. The patio area and wall shall be inspected and approved
by the Building and Safety Division prior to publi~ use.
SECTION 4. The Secretary shall certify to-the adoption
of this resolu~ion and shall' cause a copy tq be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTJFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission held on
the 14th day of January, 1975, by the following vote;
