RESOLUTION NO. 876 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING DENIAL OF TEXT AMENDMENT 74-5 RELATING TO A TEMPORARY REDUCTION IN REQUIRED PARKING AND FURTHER RECOMMENDING CONDI- TIONS IN THE EVENT SUCH TEMPORARY PARK- ING REDUCTION IS APPROVED BY THE CITY COUNCIL. WHEREAS, a public hearing was held on Novemb,er 26, 1974 for the purpose of considering T.A. 74-5 which was proposed to read as follows: "Amend Sections 9292.3.1, 9263.3.1 and 9265.3.1. Space Required: No less than the number of parking spaces shall be provided and maintained for each of the following . uses except those temporary reductions permitted by Business Permit and License Review Board for parking lot sales and for promotional entertainment events." In connection with the foregoing text amendment, the City Council had requested the Planning Commission to consider a recommendation for conditions to be imposed in the event temporary parking reductions were permitted; and WHEREAS, all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That the Planning Commission recommends to . the City Council that T.A. 74-5 be denied on the grounds that the parking requirements presently established are correct and any -1- 876 ~. . I. . . reduction would result in adequate parking. SECTION 2. In the event the City Council finds that . temporary reduction in required parking 'be ~ermitted, th'e ,Planning Commission recommends to the City Council the adoption of the following conditions in permitting such parking reduction: A. Promotional Entertainment Events, (1) Applications shall be reviewed by the newly fo~ed Business Permit and License 'Review Board. In reviewing each application, the Board shall evaluate' the prevailing parking situation of the bus'iness involved and of the general area. '(2) Promotional entertainment events may be allowed in any C-l or less restrictive commercial zone. (3) No event shall run for more than nine (9) days and shall be held between the.hours of 9:00 a.m. and' 9: 00 p,m, only'. No ,liusi'ness shall sponsor more than four (4) promotional entertainment events per year. . By way of limi ta tion and wi,thout expanding the' fore;going, where parking is shared by two (2) or more businesses there shall be no more than a combined total of eight (8) parking lot events, including promotional entertainment 'and/or sales,; per year. (4) No such event nor any equipment or apparatus related thereto (includin~ signs) shall be.placed or maintained wi thin .one hundred feet q,oo ') of any residen~ially zoned property. -2- 876 (I . 6 . '(5) Twenty-five percent (25%) of the required parking area or twenty-five percent (25%) of the existing parking area if less than.the.prescribed number of spaces are provid~d may be utilized for theprbmotion in addltion to the drivewa~ area adjacent thereto, provided'that ingress and egress to'and from all other parking ,spaces is maintained. If parking provided exceeds code r.equirements, those additional spaces may be utilized. 'In no event shall any promotional entertainment, event held i,n a parking area, whether 'by single business or combination of businesses" exceed 5,400 ~quare feet. (6) Temporary, wi.ndow' signs shall comply,witl:l code requirements. Any additional signs shall be permitted only during the, co~duct of the event and shall be approved as to size and placement by the Business Permit and License ~eview Board at the time of application approval. B. Parking Lot Sales (1) 'Applications shall be reviewed by the newly formed Business Permit ~nd License, Review Board. In reviewing each application, the Board sha'll evaluate the prevailing parkingsituation'of the businesses involved and of the general area. (2) Parking lot sales may be held inC~l or any less restrictive commercial zone. Participating .. -3- 876 . . I businesses must be a use permitted in the zone in which it is located. (3) No business shall participate in more than two (2) parking lot sales per year. By way of limitation and without expanding the foregoing, where parking is shared by two (2) or more busi- nesses, there shall be no more than a combined total of eight (8) parking lot events, including promotional entertainment and/or sales, per year. (4) No sale may run for more than two (2) days and shall be held between the hours of 9:00 :a.m. and ~:OO p.m. only. (5) Only goods, wares or merchandise of the type normally sold on the premises may be offered for sale. (6) No merchandise or signs shall be placed or maintained within one hundred feet (100') of any residentially zoned property. (7) A maximum of twenty-five percent (25%) of the parking spaces may be utilized for the sale in addition to the driveway area adjacent thereto, provided that ingress and egress to and from all other parking spaces is maintained. If a business has parking in excess of the required number, twenty-five percent (25%) of the required parking spaces plus any additional spaces may be uti,lized. . . -4- 876 , . . . . . In no event shall any parking lot sale held in a parking area, whether by a single business or combination of businesses, exceed 5,400 square feet. (8) Temporary window signs shall comply with code 'requirements. Any additional signs shall be, permitted only during the conduct of 'tqe event and shall be 'approved as to size and placemen,t by the Business, Permit and'License Revi.ew Board at the time of application approval. SECTION 3" The Secretary Shall 'certify to the adoption of this resolution and shall cause a copy to ?e forwarded to the City Council of the City of Arcadi~.
