RESOLUTION NO. 875
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR A CLASSROOM AND DAY CARE
CENTER ADDITION AT 66 WEST DUARTE ROAD.
WHEREAS, on November 12, 1974, the American Lutheran
Church of Arcadia filed an a~plication to construct a two-story
classroom and day care center addition, Planning Department
Case No. C.U.P. 74-23, on the property located at 66 West Duarte
Road, Arcadia, and with a legal description as follows:
Lots 11 and 12, the West 10 feet of Lot 10,
and the East 9 ,feet of Lot 13, of Tract
No. 6074 per map recorded in Book 67, page 83,
in the office of the Records of Los Angeles
County; and
WHEREAS, a public hearing w~s held on said matter on
November 26, 1974, at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the
Planning Department in the attached staff report is true and correct.
SECTION 2. This Commis,sion finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in' such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.

3, The site for the proposed use is adequate in size
and shape to accommodate said use" and all yards, parking, loading,
landscaping and other features required to adjust said use with the
land and uses in the neighborhood.
4, The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6, The use applied for will not have a substantial
adverse impact ,on the environment.
SECTION 3. That fo~ the foregoing reasons, subject to
4It approval of the City Council, this Commission grants a conditional
use permit for the use of said property for a two-story classroom
and day care center addition provided that the propertY,shall be
improved and maintained in accordance with the plans which are on
file in the subject Case No. C.U.P. 74-23.
SECTION 4. The Secretary shall certify to the adoption
of this reSOlution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted ata regular meeting of the planning Commission of the
City of Arcadia held on the 10th day of December, 1974, by the

APPLICATION
This application was filed on November 12, 1974, by Homer
Paulson, for the American Lutheran Church of Arcadia located
at 66 West Duarte Road, which proposes to build ~'two story
classrOom addition.
PRESENT LAND USE AND ZONING
The' subject site is zoned R-l and is presently developed
with a church complex., Property to ,the north is z.oned R- 2
and developed with Arcadia High 'School.
Property to the immediate east of the subject site is zoned
R-l and developed with a fraternal'order meeting hall.
Further to the eas t ,the property ,is 'unzoned and'developed
with the Arcadia Public Library. Properties -to' the south
are zoned R-l and developed with single family res'idences.
Properties to the west of the subJect site are' zonea R-l
and developed with two other- la,rge church complexes.
HISTORY
The American Lutheran Church of Arcadia (Lut)1e.ranChurch of
the Cross) was granted a zone variance (V"6l"14) for the
erection of a church and related facilities. City Council
Resolution No. 3609, which stipulated the conditions to be
met when building the church, was adopted on August 6, 1963.
Churches and telated facilities are regulated under the
condi tionaluse permit sec.tion of the municipal code, there-
fore, this application is necessary.
PROPOSAL
The applicant proposes to build a 'twos,tory 'addition which
will consist of approximately 5,400 square feet. The proposed

first floor is intended to qualify as a day care center for
a maximum of 42 children. The bupding plans show a total
indoor play area of 1,.565 square .feet which when divided by
the State and Arcadia Municipal Code requirement of 35
square feet indoor play.area per.child results in a maximum
enrollment of 44 children for ..the day care center,. The
Sta ie and Arcadia Municipal Code ,requirement of 7'5 square
feet of outdoor play area per :child- resul ts in' a maximum
enrollment of -42 children for the 3,240 ,:suqare feet _of out-
door play area which the plans ,show ,In addition" the
required 6 foot high masonry wall to enclose all outdoor
play areas is included in the plans. Thus, the proposed
first floor plans do meet the necessary requirements for
a day care center for 42 children.
The proposed second floor will consist of Sunday school
classrooms for the upper grades,
Pursuant to the provision of the' California Environmental
Quality Act, the Planning Department reviewed ,the proposed
conditional use _permit_and determiited that the'proposal
would not have a significant effect on,the environment. A
Negative Declaration has been prepared and' filed for this
project.
The Planning Commission,in its.approval or"denial.of the
proposed conditional.use,permit,must make .the determination
that the proposed project would or would not have, a substan-
tial adverse impact on the environment.
RECOMMENDATIONS
The Planning Department' recommends approval of C. U. P. 74 - 23
subject to the following conditions:
1. Conditions as outlined in the attached report from
the Department of Public Wor,ks shall be" complied
with to the satisfaction of the Director of Public
Works.
2. No more than 42 students shall utilize the day
care center at any one time.

3. Per Section 9275.3.2 of the Arcadia Municipal Code,
the day care center shall be $~bject to an annual
inspection.
