" RESOLUTIOi'l NO. 874 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCA1JIA GRANTING A CONDITIONAL USE PERMIT FOR A WEIGHT CONTROL SCHOOL AT 1145 WEST HUNTINGTON DRIVE. WHEREAS, on October 28, 1974, Constance Levy filed an application to operate a weight control school, Planning Department Case No. C.U.P. 74-22, on the property commonly known as 114'5 West Huntington Dri~e, more particularly described as follows: Lot 3 of Tract No, 14846 in the City of Arcadia, County ,of Los Angeles, State of California, as per map recorded in Book 314, Pages 8 and 9 of Maps in the office of the Los Angeles County Recorder. IVHEREAS, a public hearing was held on said lTIatter on November 12, 1974 at which time all interested persons' were 'given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLAi'lNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1.. That the factual data submi tted by the Planning Department in the attached report is presumed to be true and correct, SECTION 2. This Commission finds that: I. The granting of a conditional use p~rmit as herein- after provided will not be detrimental'to the puhIic health or welfare ot injurious to the property or improvements in such zone or vicinity. -1- 874 " . . . 2, The use applied for at the location'indicated is properly one for which a condition~l use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, including all yard's, parking. loading, landscaping and other features required to adjust said 'use with the land and uses in the neighborhood. 4. The site abuts streets and highways.adequate in width and pavement type to carry the' kind of traffic generated by the proposed use. 5. The granting of such conditional us~ permit will not adversely affect the General Plan. . , 6, The use applied for will not have a sub~tantial adverse impact on the environment. SECTION 3. That for the foregoing reasons; subject to approval of the City Council, this Commission grants a conditional use permit for a weight control school upon the following conditions: 1.' The property shall be improved and maintained in accotdance with the plans which are on file in the subject Case No. C.U.P. 74-22. 2. 'One drinking fountain or water cooler be provided within the school. 3. All signs conform to code requirements. November 12, 1974 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 74-22 1145 WEST HUNTINGTON DRIVE CONNIE LEVY'S REFORM SCHOOL FOR THE OVERWEIGHT APPLICATION This application for a conditional:use permit was filed on October 28, 1974 by Constance Levy and proposes to conduct a weigh~ control school at l145 West Huntington Drive. PRESENT LAND USE AND ZONING The subject property is part of the El Rancho Shopping Center, is zoned C-2 and is. developed with commercial uses, properties to the north, east and west are zoned C-2 and developed commercially; properties to the south across Huntington Drive are zoned R-3 and developed with multi- family dwellings. PROPOSAL AND ANALYSIS The applicant proposes to utilize a portion of an existing building to conduct weight control classes. The school would occupy a store approxi- mately ll' 6" by 53', containing approximately 609 square feet of gross floor area. The classes will consist of lectures and discussion, and will not in- clude an exercise, program, The only equipment to be used besides chairs and some tables will be a sc~le. The applicant anticipates approximately 30 to 50 studen.ts per, class" including men, women and children. Classes will be held from 10 a.m. until noon, and from 7 p,m. Until 10 p,m. on weekdays. Under the provisions of the Zoning Ordinance, this business is being considered a school, Under the provisions of the Uniform Plumbing COde, however, this type of use is -considered "public assembly" in terms of occupant type and load, Thus, seven square feet of floor area per occupant would be required, placing the occupant load for the school ~~ . . . Appendix C of the Uniform Plumbing Code outlines the restroom requirements, for this occupancy type for 1- 200 persons as: Males: two water closets,.two urinals, one lavatory; Females: two water closets, one lavatory; and, one drinking fountain, The store presently has only one restroom containing one' water closet and one lavatory, ,The Planning,.Department feels that while these re-, quirernents may be somewhat stringent ,for the proposed use,at least one separate facility for each sex should' be provided. Because the location of the proposed use is,within the El Rancho Shopping Center, the parking facilities are believed to be adequate..'to accommodate this use, Pursuant to the provisions.of the.California EnvironmentaLQuality Act, the Planning Department, reviewed~.the proposed conditional.use permit and determined that, the proposal would' not' have a significant effect on the environment. A Ne,gative Declaration has'been"'prepared, and filed for this project, The Planning Commission.in its approval or denial.of this.proposed con- ditional use permit must make the determination that the proposed project would or would not have a sUbstantial adverse impact on th~ environment. RECOMMENDATION The Planning Department recommends approval of C,U.P. 74-22 subject to the following conditions: 1. Separate restroom.facilities be provided'for males and females, each containing a minimum of one' water closet' and one lavatory. 2.
