RESOLUTION NO. 873
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A RESTAURANT
AT 400 SOUTH BALDWIN AVENUE.
WHEREAS, on October 18, 1974, Pete Luras filed an
application to construct and operate a restaurant, Planning
Department Case No. C.U.P. 74-20, on the property commonly known
as 400 South Baldwin Avenue, more particularly described as
follows:
Parcell of Parcel Map 4626, City' of , Arcadia,
County of Los Angeles, State of California, as
per Parcel Map Book SOCSl in the office of the
Los Angeles County Recorder.
WHEREAS, a public hearing was held on said matter on
November 12, 1974 at which time all interested persons were given
full opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSlONOF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the'fattfiil data submitted by the
Planning Department in the attached report is presumed'to be true
and correct.

SECTION 2. This Commission finds that:
1. The granting oJ aconditional"use-'permit' as herein-
after provided will not be detrimental to the public health or
we Hare or inj uriOllS to the property" or improvements in such zone
or vicinity.

2. The use applied for at the location indicated is
properly one for which a ~ond~tional use permit is aut~orized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, including all yards, parking,
loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by
the proposed lise.
5, The granting of such 'conditional use per~it will not
adversely affect the General Plan.
6. The use applied for will not have a s,ubstantial
advers,e impact on the environment.
SECTION 3. That for the foregoing reasons', 'subject to
approval of the City Council, this Commission 'grant:s a conditional
use permit for a restaurant provided that the property shall be
improved and maintained in accordance with the-pra~swhich are on
file in the sUbject Case No. C.U.P~ 74-21 and applicable provisions
of Resolution No. 4185.
SECTION 4. The Secre,tary shall' certify to the adoption
of this. resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia,

APPLICATION
This application was filed on October 18, 1974, by Pete Luras and proposes
to construct and operate a.restaurant and cocktail lounge with a Greek-
Italian theme in Santa Anita Fashion Park Shopping Center.
PRESENT LAND USE AND ZONING
The subject site is zoned C-2 D & H and is presently being developed with
a regional shopping center (Santa Anita Fashion Park),
The property immediately to the north and east is zoned R-l and S-l, and
developed with the Santa Anita Race Track stables and parking area. The
properties to the south across Huntington Drive are zoned R-3 and C-O and
developed with mixed low to high density residential uses. The proper-
ties located on the southeast and southwest corners of :Huntington Drive
and Baldwin Avenue are zoned C-2 and developed with mixed commercial uses
and a service station respectively,
The property on the northeast corner of Huntington Drive arid Baldwin
Avenue is zoned C-O.and, developed with a service,station. Properties to
the west across Baldwin Avenue ,are zoned.R-l and developed with medium
density single.story,resideritial uses. Properties' further'west are zoned
R-l &0 and 'developed with low density residential uses.
HISTORY
The proposed restaurant and cocktail lounge is located within the shopping
mall 'of Santa Anita Fashion Park,which was' approved by 'the voters of
Arcadia. in a special election and subject. to, regulations and conditions
set forth in Resolution 4185, controlling the development and use of said
site. Condition '7 of Resolution 4185 establishes the need to obtain a
conditional use permit for this proposed use.

PROPOSAL AND ANALYSIS
The proposed 162 seat restaurant and cocktail lounge is located in the
northeast corner of the North Mall, on the lower level" Space IIc-G, of
the Santa Anita Fashion Park Shopping Center, The restaurant and cock-
tail lounge, contain approximately 5,400 square feet and both booth
and table seating arrangements will be used,
The restroom facilities are consistent with those recently required in
other restaurants in the Santa Anita Fashion Park Shopping Center.
By existing C-2 zone code standards 54 parking spaces are required for
the proposed restaurant, The uses which, are proposed to be located in
the mall buildings and in Broadway, penneys, and Buffum's building have
adequate parking available in the proposed parking lot to accornrnodate
said uses.
Pursuant to the provJ.sJ.on of the California Environmental Quality Act,
the Planning Department reviewed, the proposed. conditional use.permit'and
determined that the proposal. would not have a.significant effect on the
environment. A Negative Declaration has been prepared and filed for this
project.
The Planning Cornrnission in its. approval or denial of the proposed project
must make the determination that. the proposal,would or 'would not have
a substantial adverse impact on the'environment.
RECOMMENDATION
The conditions for development as set. forth in City council Resolution
4185 specify the criteria, for the development of, the entire shopping
center, and, therefore, no additional conditions'are proposed.
The Planning Department recornrnendsapproval of conditional use permit
C.O.P. 74-20.
