RESOLUTION NO, 872
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A RESTAURANT
AT 400 SOUTH BALDWIN AVENUE
WHEREAS, on October 28, 1974, Richard L. ,Daugherty
filed an application to construct and operate a restaurant,
Planning Department Case No. C.U.P. 74-21, on the property
commonly known as 400 South Baldwin Avenue, more particularly
described as follows:
Parcel 1 of Parcel Map 4626, C~ty of Arcadia, County
of Los Angeles, State of California, as per Parcel
Map Book 50-51 in the office of the Los 1\ngeles
County Re,corder.
WHEREAS, a public hearing was held on said matter on
November 12, 1974 at which time all interested persons were given
full dpportuni ty to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF'
ARCADIA HEREBY RESOLVES AS FOLLO~S:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff report is presume~ to be true
and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to th,e public health or
welfare or injurious to the property or improvements in such zone
or vicinity.

2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate s,aid use, including all yards, parking,
loading, landscaping and other featutes required to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial
adverse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Gouncil, this Commission gra,nts 'a conditional
use permit for a restaurant provided that the property shall be
improved and maintained in accordance with the plans which are on
file in the subject Case No. C.U.P. 74-21 and applicab~e provisions
of Resolution No. 4185.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

I HEREBY CERTIFY that the foregoing resolution was adopted

APPLICANT
This application was.filed'on'October 28~ 1994j by 'Richard
Daugherty and proposes to construct and 'operate"a restaurant
in Santa Anita Fashion Park Shupping Center.
PRESENT LAND USE AND ZONING
.
The subject site is zpned C-2 D & H and is presently being
developed with a regional shopping center (Santa Anita Fashion
Park).
The property imme'diately to the north and east is z.oned R-l
and 5-1, and developed with the Santa Anita race trlick
st~bles and parking area.
The properties to the south across' Huntington Drive, are zoned
R-3 and.C-O and developed with mixetl"low.to high density
residential uses.
The properties located on the southeast and southwest corners
of Huntington Drive and Baldwin Avenue are zoned C-'2 and de-
veloped with mixed commercial uses and a service st'ation
respectively.
The property on the northwest corner of Huntington ~rive and
Baldwin Avenue is zoned C-O and developed with a se:rvice
station.
The properties to the west across Baldwin Avenue are zoned
R-l and developed with medium density single story residential
uses. Properties further west.are zoned R-l & D and developed
0ith low density residential uses.

HISTORY
The proposed restaurant is located within the shopping mall of
Santa Anita Fashion Park which was approved ~y the voters of
Arcadia in a special election and subj ect to regula,tions and
conditions set forth in Resolution 4185, controlling the de-
velopment and use of said site. Condition 7 of Resolution
418'5 establishes the need to o,btain a condi tiomil u1se permi t
for this proposed use.
PROPOSAL AND ANALYSIS
.
The proposed 197 seat restaurant islocated.oa the upper level
floor on the west side of the mall, south of the central
court area in spate E-5 of the Santi Anita Fash~on Park
Shopping Center. The restaurant and cocktail lounge contain
6,244 square feet and will have both table and booth seating
arrangements in,a~ English atmosphere. There will be 167
seats in the dining areas and 30 seats in the pub-type cock-
tail lounge.
The restroom facilities. for .the '. restaurant and cod;tai 1 lounge
comply with the Uniform Plumbing Code.
By existing C-2.zone code .standards 62.parking.spaces are
required, for the propos'ed rest'aurant: "'The uses ,which are
proposed to.be'located in the matI,buiIdings and in Broadway,
Penney's and Buffums buildings have adequate-parking available
in the proposed parking lot to accommodate said uses.
Pursuant to the'provisions of the California EnviTonmental
Quality Act, the Planning Department reviewed the proposed
conditional.use permit and d~termined that the proposal would
not have a' significant.adverse impact 'on the environment.
A Negative Declaration has been'prepared and filed for this
project.
The PlanningCommisston in its ,approval or 'denial of the
proposed project must.make.the determination that the project
would or would.not have a substantial 'adverse impact on the
environment.
RECOMMENDAT ION
The conditions for development as se,t forth in City Council
Resolution 4185 specify the criteria for the development

of the entire shoppini center, and, therefore, no additional
conditions are proposed.
The Planning Department recommends"approva1 of conditional
use permit C.,U.P. 74-21.
