RESOLUTION NO. 866
A RESOLUTION OF THE PLANNING CO~iMISSION
OF THE CITY OF ARCADIA GRANTING A
CO~DITIONAL USE PERMIT FOR AN EATING
ESTABLISHMENT AT 147-149 EAST DUARTE ROAD.
WHEREAS, on September 20, 1974, Pioneer Take Our Corpor-
ation filed an application for an eating establishment, Planning
Department Case No. C.U.P. 74-18, on the property commonly known
as 147-149 East Duarte Road, more particularly described ~s
follows:
Lot 18, except therefrom the easterly 27 feet thereof
and all of Lot 17 in B 1.0 ck' 62 of part of Arcadia
Santa Anita Tract, City of Arcadia as recorded in
Book 16, Page S8 of Miscellaneous Records, Los Angeles
County.
WHEREAS, a public hearrng was held on s.aid matter on

October 8, 1974, at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff report is presumed to be true and
correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.

2. The use applied for at the location indicated is
. properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in. size and
shape to accommodate said use, rncluding"all -yards, parking,
loading, landscaping and other features required to adjust said use
with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind 'of traffic generated by the
proposed use.
S. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial adverse
impact on the environment.
SECTION 3. That for the foregoing reasons, subj'ect to
. approval of the City Council, this Commission "grants a conditional
use permit for an eating es~ablishment upon the following conditions:
1. The property shall be improved and maintained in accor-
dance with the plans which are on file in the subject Case No.
C.U.P. 74-18, except that the number of parking spaces shall not be
less than required by code.
2. Landscaping and ir.rigation plans shall be submitted
concurrent with building plans for the approval of the ~lanning
Department prior to the issuance of any building permits.
.3. All signs 'shall 'comply with code. No roof mounted
signs shall be allowed.

4. All mechanical equipment shall be completely screened
. from public view.
S. rhe mansard roof shall extend around all four sides of
the building.
6. Restroom facilities shall be provided which comply with
the Uniform Plumbing Code.
7. Bicycle parking facilities shall be provided and
shall be shown on the building plans.
8. That all exterior dec~rative lighting systems shall be
subject to the approval of the Planning Director.
9. That the hours of operation of this building shall be
limited from 7:00 a.m. to 11:00 p.m.

That energy saving low level lighting be' used in the
.' parking area.

That a block ~all be provide~where none previously
exists on the north side of the alley, which the applicant; is required
to improve as per Public Works requirement.
12. Install full parkway width sidewalk, 'with tree wells,
and plant IS gallon size parkway trees conforming to the Illast,er tree
plan.
13. Install all utilities underground.
14. Submit grading and drainage plans prepared b~ a regis-
tered civil engineer. Plans submit to approval of the Director of
Public Works.

IS. That existing unimproved alley adjoining the north
property line shall be improved conforming to plans to be prepared
by developer's engineer and approved by the Director of Public
Works.
SECTION 4. The Secretary shall certify to the adoption
of this resoluti,on and shall cause a copy to be' forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the Planning Commission held on the 29th
day of October, 1974, by the following vote:

APPLICATION
This application wa's filed on September 20, 1974 by Pioneer
Take-Out Corporation, for property located at 147-149 East
Duarte Road and proposes to construc.t an eating establishment.
PRESENT LAND USE AND ZONING

The subject site is vacant and zoned C-2. Property to the
north is zoned R-3 and developed with single family dwellings;
properties, to the south are zoned C-l & D and developed with
commercial uses; property to the west is ,zoned C-2 and de-
veloped with a single family dwelling; property to the east
is zoned C-2 and developed with a Carl's Jr. (eating establish-
ment) .
PROPOSAL AND ANALYSIS
The subject property is irregular in shape, containing approxi-
mately 11,929.66 square feet. The applioant plans to oon-
struct a 30 foot by.4 0 foot building '0,200 square feet) rec-
tangular in shape with a mansard roof. The building will be
18'6" in height and have a used brick exterior. Proposed
site plans provide for 2,182 square feet in landscaping which
would, be in two 6'6" wide planters on the east and west side
of the parking lot, in addition to planters adjacent to the
front and west end of the proposed building. On-site land-
scaping will exoeed th,e code requirement by 1,900.18 square
feet.
Floor plans submitted by Pioneer Take-Out Corporation show
seating for 36 persons. However, the appl~cant has stated
that typically 80% of the food service is of a take-out nature,
where customers do not consume the food either in the building
or on the site. The food take out area consists of a counter

19' 6" long which serves as a division between the kit.chen
area and the eating area. The floor plan submitted shows
only one restroom with a water closet and lavatory, which
does not conform to the Uniform Plumbing Code for restroom
facilities as have been applied to other similar uses in
Arcadia.
The signing plans for this site indicate a double face free
standing sign with 91.11 square feet of sign area per side,
in addition to three signs mounted on the mansard roof with
100.78 square feet of copy area per sign. The free standing
sign would be 25 feet in height which is within the limita-
tions of Arcadia Municipal Code Section 9262.4.6E. Staff
feels the proposed signs for the mansard roof are inappro-
priate for the site; in the past, uses such as Carl's Jr.
and McDonalds were not permitted to have similar J;'oof mounted
signs. All proposed signs are to be internally illuminat.ed.

The plot plan submitted has 18 parking spaces, Section 9263.3.1
of the Arcadia Municipal Code requires 24 parking spaces for
a drive-in restaurant with 1,200 square feet. The applicant
has filed a modification (M-74-84) requesting a reduction in
the number of parking spaces because of limited seating
capacity and the high percentage of customers who do not
consume the product on the site. The trash enclosure is
located behind the building and would be of decorative masonry
construction.
RECOMMENDATIONS
The Planning Department recommends that application C.U.P. 74-18
be approved subject to the following conditions.
1. The conditions as outlined in the attached report from
the Department of Public Works shall be complied with
to the satisfaction of the Director of Public Works.
2. That the development shall cOmply with the plans on
file with the Planning Department.
3. Landscaping and irrigation plans shall be submitted
concurrent with building plans for the approval of
the Planning Department prior to the issuance of any
building permits.
4. All signs shall comply with code. No roof mounted
signs shall be allowed.

Recommended conditions of approval -- The developer shall comply with the following
conditions:
1. Install full parkway width sidewslk, with tree wells, and plant 15 gallon
size parkway trees conforming to the master tree plan.
2. Install all utilities underground.
3. Submit grading and drainage plans prepared by a registered civil engineer.
Plans subject to approval of the Director of Public Works.
4. The existing unimproved alley adjoining the north property line shall be
improved conforming to plans to be prepared by developer's engineer and
approved by the Director of Public Works.
