RESOLUTI.ON 864
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR AN EATING
ESTABLISHMENT AT 1429 SOUTH BALDWIN
WHEREAS, on August 26, 1974, Woodrow Fonteno filed an
application for an eating establishment, Planning Department Case
No. C.U.P. 74-16, on the property commonly known as 1429 South
Baldwin Avenue, more particularly described as follows:
Lot 3 of Parcel Map 1411, in the City of Arcadia,
County of Los Angeles, State of California, as re-
corded in Parcel Map Book 23, Page 84.
WHEREAS, a public hearing was held on said matter on
. September 24, 1974, at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTI.ON 1. That the factual data submitted by the Planning
Department in the attached staff report is presumed to be true and
correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.

2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3, The site for the proposed use is adequate in size
and shape to accommodate said use, including all yards, parking', loading
landscaping and other ,features, required t9 adjust said use with the
land and uses in the neighborhood.
4. The site abuts streets and. highways adequate"in '
width and pavement type to carry the kind of traffic generated by
the proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial
a4verse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Comrnis~ion grants a conditional
use permit for an eating establishment upon the following conditions:
1. ,The property shall be improved and maintained in
accordance with the plans which are on file in the subject Case No.
C.U.P. 74-16.
2. All outside trash and garbage collection areas shall
be paved and enclosed on at least three (3) vertical s.ides by a
five (5) foot high solid impact resistance wall constructed of
easily cleanable material.
3. All signs shall comply with code requirements.
4. All exterior mounted mechanical equipment shall be
screened from public view.

SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the Planning Commission held on the 8th day
of October, 1974 by the following vote:

SUBJECT: CONDITIONAL USE PERMIT C.U.P. 7~-16
1~29 SOUTH, BALDWIN AVENUE
APPLICATION
This application was filed on August 26, 197~ by Woodrow
Fonteno and proposes to operate an eating establishment
(donut shop) in the shopping center located at the south-
west corner of Baldwin and Naomi Avenues.
LAND USE AND ZONING

The subject property is part of the Fazio/Sav-On Community
Shopping Center and is zoned C-2. Commercial uses occupy
the other shops in the shopping center. The areas to the
north and east are zoned C-2 and are developed commercially.
Property to the south is zoned C-2; C-O and R-3 and is de-
veloped with commercial and residential uses. Property to
the west is zoned C-2 and R-3 and is developed with a
Hinshaw's warehouse building and residential uses.
PROPOSAL AND ANALYSIS
The applicant proposes to operate a donut shop with inside
seating for approximately 12 patrons.
The proposed use would occupy 1,200 square feet of gross
floor area, thus requiring 2~ parking spaces, calculated at
20 spaces per 1,000 square feet of gross floor area. There
are 31~ parking spaces for the entire shopping center. If
the parking requirements of all uses are considered (in-
cluding the proposed use and one existing eating establish-
ment), the existing parking facilities lack approximately
three spaces. This is not considered to be a significant
deficiency. Existing parking spaces are standard size,
but are not hairpin stripped. In addition, the layout of
the lot is confusing, especially the first row adjacent to
the proposed eating establishment. If access to these spaces

was reversed to accommodate those cars entering that aisle
from Baldwin Avenue, the parking area would be less con-
fusing.
Pursuant to the provision of the California Environmental
Quality Act, the Planning Department reviewed the proposed
conditional use permit and determined that the proposal would
not have a significant effect on the environment. A Negative
Declaration has been prepared and filed for this project.
The Planning Commission in its' approval or denial of the
proposed conditional use permit must make the determination
that the proposed project would or would not, have a substan-
tial adverse impact on the environment.
RECOMMENDATION
.
The Planning Department recommends approval of C.U.,P. 74-16
subject to the following conditions.
1. All outside trash and garbage collection areas shall
be paved and enclosed on at least 3 vertical sides
by a five (5) foot high solid impact resistant wall
constructed of easily cleanable material.
2. All signs shall comply with code requirements.
3. All exterior mounted mechanical equipment shall be
screened from public view.
