RESOLUTION NO. 863
A RESOLUTION OF THE PLANNING CO~~ISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR AN OUTDOOR
EATING ESTABLISHMENT AT 31 EAST HUNTINGTON
DRIVE.
WHEREAS, on August 26, 1974, Jose and Viola Solis filed
an application for an outdoor eating establishment, Planning
~epartment Case No. 74-17, on the property commonly known as 31
East Huntington Drive, more particularly described as follows:
Lot 8, Block 74, Arcadia Santa Anit.a Tract, City
of Arcadia, County of Los Angeles, State of California,
as per map recorded in Book IS, Page 89 6f Maps in
the office of the Los Angeles County Recorder.
WHEREAS, a public hearing was held on said matter on
4It September 10, 1974, at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff report is presumed to be true and
correct.
SECTION 2. This Commission finds that:
1. The granting of a conditienal use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.

2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size,
and shape to accommodate said use, and all yards, parking, loading,
landscaping and other features required to adjust said use with
the land and uses in the neighborhood.
4. The site abuts streets and highways ad.equate in
width and pavement type to carry the kind of traffic generated
by the proposed use.
S. The granting of such conditional use permit will not
advers,ely affect the General Plan.
6. The use applied for will not have a substantial
adverse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for an outdoor eating establishment upon the, following
condi tions:
1. The property shall be improved and maintained in
accordance with the plans which are on ~ile in the subject Case
No. C.D.P. 74-17.
2. That all signs shall comply with code requirements.
3. The trash area shall be enclosed on at least three
sides by a five (S) foot high solid impact, resis,tant wall constructed
of easily cleanable material.

SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission held on
the 24th day of September, 1974, by the fOllowing vote:

31 EAST HUNTINGTON DRIVE
APPLICATION
This application was filed on August 26, 1974 by Jose and
Viola Solis and requests a conditional use permit to operate
an outdoor eating establishment at 31 East Huntington Drive.
PRESENT LAND USE AND ZONING
The subject property is zoned C-C D & H, and is presently
developed with a brick building,. On the same site is the
Steerburger Restaurant. Surrounding properties are also
zoned C-C D & H and are developed with commercial and office
uses. The rear of the subject property abuts an alley. To
the north of the alley is a public parking lot.
HISTORY
An outdoor eating establishment previously occupied the sub-
ject building. Although an outdoor eating establishment is
a conditional uSe in a C-C zone, the business was a noncon-
forming use because it did not have a conditional use permit.
According to the Arcadia Municipal Code, Chapter 9249, any
nonconforming use which is not actively participated in for
90 days is considered discontinued.

PROPOSAL AND ANALYSIS
The applicant proposes to utilize an existing building to
conduct an outdoor eating es tablishment. The subject
building, which was formerly utilized for a similar business,
contains 328 ~q. ft. of floor area. The interior of the
structure would be used solely for food preparation space.

Customers would place orders and be served at an existing
stainless steel counter which runs around part of the
building's perimeter. Stools will probably be provided
along the counter.
The pa,rking lot in the rear of the property has spaces
marked for four cars. Because the lot is shared with the
adjoining eating establishment this does not meet parking
requirements. However, parking needs are met by the public
parking facility located on the other side of the alley.
In addition, it is expected that most customers will not
park specifically for the eating establishment, but will
be customers and employees of the adjoining businesses.
Pursuant to the provision of the California Environmental
Quality Act, the Planning Department reviewed the proposed
conditional use permit and determined that the proposal
would not have a significant effect on the environment. A
Negative Declaration has been prepared and filed for this
project.

The Planning Commission in its approval or denial of the
proposed conditional use permit must make the determination
that t,he proposed project would or would not have a substan-
tial adverse impact on the environment.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 74-17
subject to the following conditions:
1. All signs coftform to code requirements.
2. The trash area shall be enclosed on at least three
sides by a S foot high solid impact resistant wall
constructed of easily cleanable material.
