RESOLUTION NO. 861 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING AMENDMENT TO THE ARCADIA MUNICIPAL CODE EXPANDING THE AUTHORITY OF THE ADMINISTRATIVE MODIFICATION PROCEDURES TO ALLOW FOR MODIFICATION OF EXISTING GARAGES WHEREAS, the Planning Commission on its oWIi motion held a public hearing on August 27, 1974, to consider amending the Administrative Modification procedures to allow certain modifications to be granted to existing nonconforming garages of the Arcadia Municipal Code; and WHEREAS, all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDS TO THE CITY COUNCIL: SECTION 1. That Section 929'2.2.3 of the Arcadia Municipal Code be amended to read as follows: "9292.2.3. AUTHORITY. Administrative Modification may be granted upon the joint approval of the Planning Department and Building Division. Administrative modification may permit such modification of the side yard, rear yard, dis~ance between buildings and existing garage sizes as may be necessary to secure an appropriate improvement." SECTION 2. The Planning Commission finds ,that the public necessity, convenience, general welfare and good zoning practice justify the above recommendations. -1- 861 .," .,. '10- . . . .. . SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. August 27, 1974 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: TEXT AMENDMENT T.A. 74-3 In the past six months the Modification Committee has re- ceived eleven applications for a modification to Section 9251.2.12 of the code, which requires two parking spaces 10 feet by 20 feet each in conjunction with single family residential uses. This code section became effective M~rch 7, 1967; prior to 1967 only one and one-quarter parking spaces were required (8 feet by 20 feet each). Because of the large number of dwellings constructed prior to 1967 in Arcadia there ~re a substantial amount of garages which do not meet the current code standards for single family residential zones and must receive a modification for this deficiency prior to any new construction on the lot. In cases which have recently come before the Modification Committee, the applicant has needed only to have the size of their existing garage modified before proceeding with a residential addition which meets code. This action now takes a minimum of three weeks in processing, hearing and appeal period time. Staff feels a solution to this situation would be to place the size of the existing garage ~ith the items which can now receive an administrative modification. This process permits all adjacent neighbors to review the applicant's proposed plans before they are reviewed by the Planning Department and Building Division. By placing nonconforming existing garages under an admini- strative modification, the total processing time could be reduced to three days in most cases.
