RESOLUTION NO. 855 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 400 SOUTH BALDWIN AvENUE. WHEREAS, on April 29, 1974, Broadway-Hale Store, Inc., of LoS Angeles, filed an application to construct and operate a restaurant within a department store, Planning Department Case No. C.U.P. 74-9, on the property described in Exhibit "A" attached hereto and incorporated herein by reference; and WHEREAS, a public hearing was held on said matter on May 28, 1974 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF . ARCADIA HEREBY RESOLVES AS FOLL0WS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3,. The site for the proposed use is adequate in size, and shape to accommodate said use, and all yards, parking, loading, landscaping and other features required to adjust said use with . the land and uses in the neighborhood. -1- 855 '. . . . . . 4. The site abuts streets and highwa~s adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied Ior will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for a restaurant provided that the property shall be improved and maintained in accordance with tl1e plans which are on file in the subject Case No. C.U.P. 74-9 and applicable provisions of Resolution No, 4185. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the Planning Commission of the City of Arcadia held on the day of , 1974, by the fOllowing vote: AYES: NOES: ABSTAIN: ABSENT: ATTEST: -2- 855 .-' . . . . . 4. This is a continued item from the May 14, 1974, Planning Com- mission meeting. The applicant, Broadway-Hale S'tores, proposes to construct and operate a 125 seat restaurant within a depart- ment store. The revised plans which were submitted provide for two water closets and two lavatories in the Ladies' restroom and one water closet, a urinal, and a lavatory in the Men's restroom. May 14, 1974 TO: PLANNING COMMISSION PROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 74-9 '" BROADWAY-HALE STORES, ,INC. 400 SOUTH BALDWIN APPLICATION This application,was filed on April 29,,1974, by Broadway- Hale StOres, Inc. of Los Angeles, and propose~ to construc~ and operate a department store which includes ,a garden theme restaurant in Santa Anita Fashion Park Shopping Center. . PRESENT LAND USE AND ZONING The subject site is 'zoned C-2 D & H and is presently,being developed with a regional'shopping center '(Santa'Anita Fashion Park). f The !lnd !lnd property.immediately,to S-l, and,developed with parking area. the: north ,and east is zoned R-l the Santa Anita Race Track stables The properties to the south across HUntington Drive, are zoned R-3 and c-o and developed with mixed low to high density resi- dential uses. The prope,rties located' on"the southeast',and southwest corners, of Huntington Drive 'and Baldwin are zoned C--2 'an'd',developed wi th mixed commercial uses-'and"a service' stat ion respective ly. The property on the northwest corner of Huntington' Drive and Baldwin Avenue is zoned C~O and developed with a service station. . The properties' to the west '.across ,Baldwin Avenue are zoned R-l and developed with:medium'density single story residential uses. Properties ,further west are zoned,R'-l &"D--and' developed with low density residential uses. . . . C.U.P. 74-9 2 HISTORY The proposed restaurant ,is located within the shopping mall of Santa Anita Fashion Park,which.was approved ,by' the voters of Arcadia in a special election and subject to regulations and conditions set forth in Resolution,4l85, controlling the development and use of sa,id site. Condition 7 of Reso- lution 4185 establishes ,the need,to obtairr a conditional use permit for this proposed use. PROPOSAL AND ANALYSIS . The proposed,125 ,seat restaurant is located on the third floor of the Broadway, department store, in' the Santa Anita Fashion Park ,Shopping Center. The restaurant area contains 4,350 square feet.. ,The restaurant will contain a booth table, and counter seating arrangements in a garden atmosphere. By existing C-2 zone code standards 44 parking spaces are re- quired for the proposed restaurant. The uses which are proposed to be located in the mall buildings and.Broadway, ,Penneys and Buffums buildings ,have adequate parking,available in the proposed 'parking lot to accommodate said uses. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) Pursuant ,to ,the ,provision of ,the ,CEQA, the Planning Department reviewed the proposed conditional use permit and determined that the ,proposal would not have a significant effect on the environment. ' ,A Negative'Declaration has been prepared and filed for this project. The Planning Commission in its approval or denial of the proposed ,conditional use',permit ,must make ,the determination that the ,proposed project'would~or would not have a substantial adverse impact on the environment. RECOMMENDATION The conditions for development as set forth in City Council Resolution 4185 specify the criteria,for,the development of the entire shopping center, and, therefore', no' 'addi tional con- ditions are proposed. . . .
