HomeMy WebLinkAbout0854 " '. . . . RESOLqTION NO. 854 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 400 SOUTH BALDWIN AVENUE. WHEREAS, on April 29, 1974, Kaplan's Anita-Restaurant and Delicatessen, Inc., filed an application to construct and operate a restaurant, Planning Department Case No. C.U.P. 74-8, on the property described in Exhibit "A" attached hereto and incorporated herein by reference; and WHEREAS, a public hearing was held on said matter on May 28, 1974 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF . ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data ~ubmitted by the Planning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size, and shape to accommodate said use, and all yards, parking, loading, landscaping and other features required to adjust said use with the ... land and uses in the neighborhood. -1- 854 . . . , ',' . . 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for a restaurant provided that the property' shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 74-8 and applicable provisions of Resolution No. 4185. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. This item is continued from the May 14, 1974, Planning Com- mission meeting. The applicant, Kaplan'sAnita Restaurant and Delicatessen, proposes to construct and operate a 300 seat restaurant. Revised plan~ for restroom faci Titles were submItted and indicated that 26 seats Inthe 326 seats of the original pro- posal have been removed in order to increase restroom faci- lities, Thus, the testaurant which will now seat 300 patrons includes a Ladies' restroom with three water closets and two basins, and a Men's restroom with two urinals. one water closet and two basins. May 14, 1974 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 74-8 SPACE IID-S, 400 SOUTH BALDWIN KAPLAN'S ANITA RESTAURANT AND DELICATESSEN APPLICATION This application was filed on April 29, 1974, by Kaplan's Anita-Restaurant and Delicatessen, Inc., and proposes to con- struct and operate a 326 seat restaurant in Space IID-5~ Santa Anita Fashion Park Shopping Center. , PRESENT LAND USE AND ZONING The subject site is zoned C-2 D & H'and is presently being developed with a regional shopping center (Santa Anita Fashion Park). . The property immediately' to the north and east is zoned R-l and S-l and developed 'with the, Sant,a Anita Race Track stables and parking area. The properties to the south across Huntington Drive, are, zoned R-3 ahd,C-O and devei'oped with mixed low to high density residential us~s. The properties 10cate4 on the southeast and southwest corners of Huntington Drive and Baldwin are zoned C-2 and developed with mixed commercial uses and a service station respectively. The property on the northwest' corner of Huntington ,Drive and Baldwin Avenue is zoned C-O and developed with a service station. The properties to the west across Baldwin Avenue are zoned R-l and developed 'with medium'density single s,torY'resid'ential uses. Properties further west .re zoned R-l & Dand developed with low density'residential .uses. HISTORY The proposed restaurant is located within the shopping mall of Santa Anita Fashion Park which was approved by the voters of . . . . C.U.P. 74-8 2 Arcadia in a special election and subject to regulations and condi tions ,set ,forth' in Resolution 4185, controlling the ,deve lop- ment and ,use of said site". Condition 7 of Resolution 4185, establishes the need to obtain a conditional use permit for this proposed use. PROPOSAL AND ANALYSIS The propqsed 326 seat restaurant is located in the southeast corner of the South Mall, ,on the lower level, Space #D-5 of the Santa Anita Fashion Park Shopping Center. The restaurant area contains 6,666 square feet. The restaurant will be entered from the mall and will contain both booth and table seating arrangements. Sandwiches will also be sold for con- sumption off the premises. By existing C-2 zone code standards 67 parking spaces are re- quired for the proposed restaurant. The uses which are proposed to be located"in the mall buildings and in Broadway, Penneys and Buffums buildings have adequate parking available in the proposed parking lot to, accommodate said uses. . CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) Pursuant to the provision,of the CEQA, the Planning Department reviewed the proposed conditional use permit and determined that t'he proposal would not have a significant effec,t on the environment. A Negative 'Declaration has been prepared and filed for this project. The Planning Commission in its approval or denial of the pro- posed conditional use permit must make the'determination that the proposed project would or would not have a substantial adverse impact on the environment. RECOMMENDATION The conditions for development as set forth in City Council Resolution .4185 specify the criteria for the development of the entire shopping center, and, therefore, no additional conditions are proposed. . . .
