RESOLUTION NO. 853
.
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A RESTAURANT
AT 400 SOUTH BALDWIN AVENUE.
WHEREAS, on April 26, 1974, Anna Miller's Coffee Shop of
San Francisco filed an application to construct and operate a
restaurant, Pl~nning Department Case No. C.U.P. 74-7, on the property
described in Exhibit "A" attached hereto and incorporated herein
by reference; and
WHEREAS, a public hearing was held on said matter on
May 28, 1974 at which time all interested persons were given full
opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF

ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size,
and shape to accommodate said use, and all yards, parking, loading,
landscaping and other features required to adjust, said use with the
4It land and uses in the neighborhood.

4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of' traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial adverse
impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the use of said property for a restaurant provided
that the property shall be improved and maintained in accordance
with the plans which are on file in the subject Case No. C,U.P. 74-7
and applicable provisions of Resolution No. 4185.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

This item is continued from the May 14; 1974, P~anning Com-
mission meeting. The applicant, Anna Miller's Pies, proposes
to construct and operat~ a 120 seat restaurant.
Revised pI ans indicating addi tional res troom fad li ties which
are convenient fo,r their patrons have been submitted. The
Ladies' restroom now contains two water closets and two ,lava-
tories and the Men's restroom c;ntains a water ~loset, urinal,
and two lavatorieS.
Attached are the revised plans and the initial staff report.

APPLICATION
This application was filed on April 26, 1974, by Anna Millers,
Inc., of San Francisco, and proposes to construct and operate
a 120 seat restaurant in Space IIC-12, Santa Anita Fashion
Park Shopping Center.
PRESENT LAND USE AND ZONING
.
The subject site is zoned C-2 D & H and is presently being de-
veloped with a regional shopping center (Santa Anita Fashion
Park).
The property immediately to the north and east is zoned R-l
and Sol, and developed with the Santa Anita Race Track stables
and parking area.
The properties to the south across Huntington Drive, are zoned
R-3 and G-O and developed with mixed low to high density resi-
dential uses.
The properties located on the southeast and 'southwest corners
of Huntington Drive and Baldwin are zoned C-2 and developed
with mixed commercial uses and a service station respectively.
The property on the northwest corner of Huntington Drive and
Baldwin Avenue is zoned C-Oand developed with a service sta-
tion.
The properties to the west across Baldwin Avenue are zoned R-l
and developed with medium density' single story residential
uses. Properties further west are zoned R-l & D and developed
with low density residential uses.

HISTORY
The proposed restaurant is located ~ithin the shopping mall
of Santa Anita Fashion Park which was approved by the voters
of Arcadia in a special election and subject to regulations
and condi tions set fo,rth- in Resolution 4185, controlling the
development and use,of said site. Condition~7"df.Resolution
4185 establishes the need to obtain a conditional use permit.
for this proposed use. '
PROPOSAL AND ANALYSIS
.
The proposed 120 seat restaurant is located in-the northeast
corner of the North Mall, on the lower .l'evel, Space #C-12, of
the Santa Anita Fashion Park Shopping Center. The restaurant
area contains 5,416 square feet. Entrance to the restaurant
is from the mall and will contain a counter 'seating area,
table seating area, and a bakery area 'for the sal,e of pies.
By existing C"l zone code standards 54' parking spaces are re-
quired for the proposed restaurant.
The uses which ,are proposed to be located "in thenmaU buildings
and in Broadway, penneys' and Buff1..lll1's buildings have adequater
parking available in the proposed parking lot to accommodate
said uses.
CALIFORNIA ENVIRONMENTAL QUALI~Y ACT (CEQA)
Pursuant to the provision of the CEQA, the Planning Department
reviewed the proposed"cond,i tional use permIt and ,determined
that the proposal would not have' a significant effect on _ the
environment. A Negative' Declaration has "'been 'prepared and
filed for-this project.
The Planning Commiossion in its approval ,or- denial of ,the
proposed, condi tionai':'use'permtt:mus tmake', the 'determination,
that the proposed proj ect would-or' would not' have a 'substantial
adverse impact on the environment.
RECOMMENDATION
The conditions for' development as set forth in 'City Council
Resolution,4l85 specify the criteria fOT the development of
the entire shopping center and, therefore,- 'no"additional
conditions are proposed.
