RESOLUTION NO. 852 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 400 SOUTH BALDWIN AVENUE. WHEREAS, on April 22, 1974, Buffums filed an application to construct and operate a restaurant within a specialty department store, Planning Department Case No. C.U.P. 74-6, on the property conunonly known as 4,00 South Baldwin Avenue, more particularly described in Exhibit "A" attached hereto and incorporated herein by reference; and WHEREAS, a public hearing was held on said matter on May 28, 1974 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. SECTION 2. This Conunission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size, and shape to accommodate said use, and all yards, p~rking, loading, ~ landscaping and other'features required to adjust said use with the , -1- 852 . . . . . land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECT,ION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for a restaurant provided that the property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 74-6 and applicable provisions of Resolution No. 4185. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy, to be forwarded to the City Council of the City of Arcadia. The applicant, Buffums', proposes to con- struct and operate a 125 seat restaurant 'within 'a' specialty department store. Addi tional time was provided to this app'licant, 'and the following three C.U.P~ applicants, to prepare revised plans indicating additional restroom facilities convenient for their restaurant patrons. At the request of the Arcadia Planning Commission public hearings on C. U. P. 74-6. Bufftims has made a positive effort in time, expense and architectural, assistance to comply with the request for a revised plan indicating additional re streom facilities convenient for restaurant patrons. We propose'to make available to restaurant patrons ea'sily accessible from th,e restaurant, an additional Ladies restroom with four water 9losets and three la va tories and an additional Mens restroom with one urinal, one water closet and,two lavatories. Buffums and our architectural consultants think that these additional facilities, which are located on our lower level, 'would' then be adequate for a l25-seat restaurant. ,All restroo'ins are brought to public attention by plainly' marked signing . ' We would like to review the existing restroom facilities already, available to re staurant patrons. Directly across from the restaurant in a southerly direction we have the main woman!;' powder room and restroom with' five water closets' and , fo ur lavatories making this very adequate and acc,essible to restaurant female patrons. Our restaurant is primarily occupied by 80% women so this facility, would more than accommodate a restaurant of 150 seats. The existing mens' restroom is on the upper level of the store. easily accessible by either elevator or escalator. The location of this mens' restroom is.in the menswear department. May 14, 1974 TO: FROM: PLANNING COMMISSION PLANNING DEPARTMENT , SUBJECT: C.U.P. 74-6 BUFFUMS 400 SOUTH BALDWIN AVENUE APPLICATION This application was filed on April 22, 1974, by Buffums of 155 Pine Avenue, Long Beach, and proposes to construct and operate a specialty department store which includes a restaurant with.a landscaped garden view in Santa Anita Fashion Park Shopping Center. . PRESENT LAND USE AND ZONING The subject site is zoned C-2 D & H and is presently being developed with a regional shopping center (Santa Anita Fashion Park). The property immediately to the north and east, is zoned R-l and Sol, and developed with the Santa Anita Race Track stables and parking area. The properties to the south across Huntington Drive, are zoned R-3 and CoO and developed with mixed low to high density residential uses. The properties located on the southeast and southwest corners of Huntington Drive and Baldwin are zoned C-2, and developed with mixed commercial uses and a service station respectively. The property on the northwest corner of Hunting,ton Drive and Baldwin Avenue is zoned C- 0 and developed, with a service station. . . . C.U.P.' 74-6 2 . The properties to the west across Baldwin ,Avenue ,are zoned R-l and developed "with ;medium ,densi tysingle story resi- dential uses. Properties further west are zoned R-l & D and developed with low density residential uses. HISTORY The proposed restaurant is locate~~ithin the specialty de- partment store of Buffums in Santa Anita'Fashion Park which was approved by th~ voters of Arcadia in a_special election and subject to regulations and conditions se,t forth in Reso- lution 4l85i controlling the development and use of the site. Condition 7 of Resolution 4185 establishes the need to obtain a conditional use permit for this proposed use. PROPOSAL AND ANALYSIS . The proposed 125 seat restaurant is located on the lower level of the Buffums department store building in the Santa Anita Fashion Park Shopping Center. The restaurant area contains 3,930 square feet-. The restaurant will b,e"'entered from wi thin ,the,depar,tment store and will contain a waiting area with ,seating, a counter area, and dining ,a;rea which will offer a view of a landscaped garden area.. By existing C-2 zone code standards, 39 parking spaces are required for the proposed restaurant uS,e of the building. The uses which are proposed to be located in the mall buildings and in Broadway, Penneysand Buffums buildings have adequate parking available in the proposed parking lot to accommodate said uses. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) Pursuant to the provision of the CEQA, the Planni~g Department reviewed the proposed conditional use permit and determined that the ,proposal would not have a significant effect on the environment. ' A Negative Declaration has been prepared and filed for this project. The Planning Commission in its ',approval or ,denial of the ,pro- posed conditional use" permit must make the ,determination that the proposed project would 'or would not have a substantial adverse impact on the"environment. . . . . c. U.P. 74-6 3 RECOMMENDATION The conditions for development as set forth in Ci~y Council Resolution 4185 specify ,the criteria for' the"develbpment of the entire ,shopping' center and'therefore'; no"'ildditional conditions are proposed. The Planning Commission of the City of Arcadia, California, will hold public hearings on Tuesday, May 14. 1974, at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California.
