RESOLUTION NO. 848 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR AN EATING ESTABLISHMENT AT 400 SOUTH BALDWIN AVENUE. WHEREAS, on March 25, 1974, Bob's Big Boy Restaurants of Glendale, California, filed an application to construct and operate an eating establishment, Planning Department ,Case No. C.U.P. 74-4, on the property commonly known as 400 South Baldwin Avenue, more particularly described in Exhibit "A" attached to Resolution No. 847 and incorporated herein by reference; and WHEREAS, a public hearing was held on said matter on April 10, 1974, at which time all interested persons were given . full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: l. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size . and shape to accommodate said use, and all yards, parking, loading, -1- 848 .. ..... .~ . . . landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for an eating establishment provided that the property shall be improved and maintained in . accordance with the plans which are on file in the subject Case No. C.U.P. 74-3 and applicable provisions of Resolution No. 4185. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. PRESENT LAND USE AND ZONING --- I The subject site is zoned CO'2 developed with a regional shopping , Park). D,& H and presently being center (Santa Anita Fashion The property immediately t'o the north and' east is zoned R-l and S-l, and developed with the Santa Anita Race Track stables and parking area. The properties to the south across Huntington Drive, are zoned R-.3 and CO'O and, developed with mixed low to' high density residential uses. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) Pursuant to the provision of the CEQA, ,the,Plannirrg Department reviewed the proposed, :condi tional use permi t and determined that the proposal would not have a significant effect on the environment. A ,Negative Declaration has been prepared and filed for this project. The Planning Commission in its approval' or-:denial of the proposed_conditional use permirmust make the determination that the proposed project would or ,would not have a substan- tial adverse impact on the environment. RECOMMENDATION The conditions for development ,as ,set forth in City Council Resolution 4185 specify the criteria for the de- velopment', of the entire' shopping' center'!and.,- therefore. no additional tonditions ar~proposed. . . . .
