RESOLUTION NO. 847
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A RESTAURANT
AT 400 SOUTH BALDWIN AVENUE.
WHEREAS, on ~rch 25, 1974, Magic Pan, Inc. of San
Francisco filed an application to construct and operate a restaurant,
Planning Department Case No. C.U.P. 74-3, on the property commonly
known as 4'00 South Baldwin Avenue, more particularly described in
Exhibit "An attached hereto and incorporated herein by 'reference; and
WHEREAS, a public hear-ing was held on said matter on
April 10, 1974 at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIJ\. HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properlY one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, and all yards, parking, loading,

landscaping and other features required to adjust said use with
the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by
the proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial adverse
impact on the environment.
SECTION 3. That, for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the use of said property for a restaurant provided
that, the property shall be improved and maintained in accordance
with the plans which are on file in the subject Case No.C.U.P. 74-3
and applicable provisions of Resolution No. 4185.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

400 SOUTH BALDWIN AVENUE
APPLICATION
This application w~s filed on March 25, 197~, by Magic
Pan, Inc. of San Francisco, and proposes t.o construct and
operate a 140 seat restaurant and bar' in Space #F~17, Santa
Anita Fashion Park Shopping Center.
PRESENT LAND USE AND ZONING
! The subject site is zoned C-Z D &.H and presently being
; developed with a regional shopping center'{Santa Anita Fashion
Park) .
The property immediately to the north and eas.t is zoned
R-l and S-l, and developed with the Santa Anita Race Track
'stables and parking are~.
The properties to the south acr.oss Huntington Drive, are
I zoned R-3 and CO'O and developed with mixed low to high density
,residential uses.
The properties located on the southeast and southwest
I corners of Huntington Drive and Baldw,in are zoned ,C-Z, and de-
veloped with mixed commercial uses and' a service station
\ respectively.
The property on the northwest corner of Huntington Drive
and Baldwin Avenue is zoned CO'O and developed with a service
station.
The properties to the west across Baldwin Avenue are
I zoned R-I and developed 'with medium density single story resi-
I dential uses. Propertiea further west are zoned R-l & D and
1 developed with low density residential uses.

will be entered from the Mall and will contain a main dining
room which seats 80, a bar, and the garden dining area which
seats 60 persons.

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
Pursuant to the provision of the CEQA, the Planning De-
partment reviewed the proposed conditional use permit and
determined that the proposal would not have asignfficant
effect on the environment. ,A Negative Dec lara t'ion has been
prepared and filed on this project.
The Planning Commission in its approval or denial of the
proposed conditional ,use permit must make the determination
that the proposed project woulu' or:would not have a substan-
tial adverse impact on the' environment.
RECOMMENDATIONS
The condi tions, fo.r development'.as set forth. in ,Ci ty
Council Reso.1ution', 418 5 specify' the ,cri teria for the develop-
ment of ,the .entire ,shopping-,center and therefore" no additional
conditions are proposed.

BEFORE THE
ARCADIA CITY PLANNING COMMISSION
C.U.P. 74-3
TO PROPERTY OWNERS WITHIN A 300-FOOT RADIUS
The Planning Commission. of the City of Arcadia,
California, will hold a public hearing on Wednesday, April
10, 1974, at 7:30 p"m. in the Council Chamb.ers of the
Arcadia City Hali, 240 West Huntington Drive, Arcadia,
California.
The purpose of the public hearing will be to afford
the public an opportunity to be heard concerning the pro-
posed use of the property commonly known as 400 South
Baldwin (Fashion Park).
The legal description of the subj ect site is on the
attached sheet.

The applicant requests a conditional use permit to
construct and operate a restaurant (Magic Pan). '
The proposed plan may be seen in t.he offi,ce of the
Planning Department, 240 West Huntington Drive, Arcadia,
California, Monday through Friday between the hours of
8:00 a.m. and 5:00 p.m.
