RESOLUTION NO. 8~6
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A RESTAURANT
AT 218-230 NORTH FIRST AVENUE.
WHEREAS, on March 25, 1974, Acapulco Mexican Restaurants,
Inc., filed an application for a conditional use permit to construct
an addition to the existing restaurant building, Planning Department
Case No. C.U.P. 74-2, on the property commonly known as 218-230 North
First Avenue, more particularly described as follows:
Lots 34, 35 and 36 of Block 79 of Arcadia Santa
Anita Tract, in the City of Arcadia, County of
Los Angeles, State of California, as per map
recorded in Book l5, pages 89 and 90, of Miscel-
laneous Records, in the office of the County
Recorder of said County. EXCEPT the easterly
40 feet of said Lots 34, 35 and 36.
WHEREAS, a public hearing was held on said matter on
April lO, 1974 at which time all interested persons were given full
opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION l. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is

properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
arid shape to accommodate said use, and all yards, parking, loading,
landscaping and other features required to adjust said use with
the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by
the proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial adverse
impact on the environment.
SECrION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the constr.uction of an addition to the existing
restaurant building upon the following conditions:
1. The property shall be improved and maintained in
accordance with the plans and prior approved conditions which are on
file in the subject Case No. C.U.P. 73-1,3.
2. The addition shall comply with the plans on file
in the subject Case No. C.U.P. 74-2.
3. Landscaping and irrigation plans shall be submitted
for approval of the Planning Department prior to the issuance of
any building permits.
4. All roof mounted mechanical equipment on the site
shall be screened from view.

5. Low level lighting shall be provided in all parking
lots containing the required'parking spaces. Said lighting shall
be subject to the approval of the Planning Department.
6. Delete one additional parking space from C.U.P. 73-13.
7. Except as herein modified, all regulations of the
Arcadia Municipal Code shall be complied with.
8. Conditions outlined in the attached repo!t shall be
complied with to the satisraction of the Director of Public Works.
9. Signs shall be approved as shown in modification
application M~73-67.
10. Landscaping shall be provided between parking spaces
14 and 15, and between the alley and parking space 9.
SECTION 4. The Secretary shall certify to the adoption
of this resoluti?n and shall cause a cOEY to be forwarded to the
City Council of the City of Arcadia.

This application was filed on March 25, 1974, by
Acapulco Mexican Res taurants, 'Inc. , -and proposes ,an ilddi-
tion to the existing restaurant building at 218-230 North
First Avenue.

The subject site is zoned M-l and developed with, an
existing restaurant. The surrounding properties are zoned
M-l and developed with industrial uses and single family
dwellings.

This application was approvedhy the Planning Commission
on October 9, 1973. Revised plaITS were approved by the
Plann~ng Commi~sion on November 27:'i'9J~ and approved by
the C1ty Counc11 on January 15, 1974. ~_

The proposed addition would be located,on the south side
of the existing ,building and ,east of the new eating area.
This addition will be used as an ,employee passageway and pro-
vide space for some restaurant equipment. The addition will
not increase the seating capacity of the restaurant.

The exterior of this addition would be in the same style
as the previously approved addition.
~ The construction of this room would result in the elimi-
\ nation of 60 square feet of landscaping and one' 'parking space. ~
\ The restaurant with the proposed 100 square foot addition (
) would contain a total ,gross area of 5,877 square feet, which, I>.

The applicant has signed 'an agreement with th~city for V /I,

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
Pursuant to the provision of the CEQA, the Planning De-
partment reviewed the proposed conditional use permit and
determined that ,the ,proposal wouldnct have a significant effect
on the environment. A Negative Declaration has been prepared
and filed for this proposal.
The ,Planning Commission ,in ,its' approval oy'denial ,of the
proposed conditional .use .permit must ,make .the',deteI:mination
that the,pI:oposal would.or,woul~ not have a substantial adverse
impact on the environment.

Erickson - I think because of the recentcie of our other actions? both the c.u.p
and modification regarding the signs, I think we are in a position to stick with those.
It seems to me we ought to be able to',live with what we did before.
Mr. Witte read the conditions of approval on C.U.P. 73-13 as recorded in
Resolution 834. which was approved by City Council on January 15, 1974.
Discussion ensued regarding various condit.ions of approval which should be
added.

following changes and additions. CondHion 1 to read "The property shall be improved
and maintained in accordance with the plans and prior approved conditions which are
on file in the subject case no. C.U.P. 73-13. Condition 6 to read "Delete one additional
parking space from C.U.P. 73-13." Add condition 9 "Signs shall be approved as shown
. in modification application M-73-67." Add condition 10 "Landscaping shall be provided
between parking spaces 14 and 15, and between the alley and parking space 9."

impact. Motion was passed by voice t vote with none dissenting.
Jack Lieubau asked if it was possible for this resolution to be imnlediately
forwarded to the City Council? Mr. Huddy t said no because it was supposed to be
forwarded at 5:00 o'clock this afti1ernoon.

The Planning Conmission of the City of Arcadia, California, will
hold a public hearing on Wednesday, April 10, 1973, at 7:30 p.m. in
the Council Chambers of the Arcadia City Hall, 240 West Huntington
Drive, Arcadia, California.

The purpose of the public hearing will be to afford the public
an opportunity to be heard concerning the"proposed use of the property
commonly known as 226-230 North First Avenue.
The legal description of the'subject site is as follows:
Lots 34, 35 and 36: Block 79 of'Arcadia Santa Anita Tract, in
the City of Arcadia, County of Los Angeles, Stateof'California,
as per map recorded in Book 15 Pages 89 and 90 of Miscellaneous
Records, in the office of the County Recorder of said County.
