RESOLUTION NO. 844 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A GARAGE FOR AUTOMOTIVE REPAIR AT 412 AND 418 NORTH FIRST AVENUE. WHEREAS, on J:anuary 2, 1974, P & F Motors filed an application for a garage for automotive repair, Planning Department Case No. C.U.P. 74-1, on the. property commonly known as 412 and 418 North First Avenue, more particularly desGribed as follows: Lots 3 and 34 of Block 83, Arcadia Santa Anita Tract, in the City of Arcadia, County of LoG Angeles, State of California, as recorded in Book 15, page 89, of Maps, in the office of the recorder of said County. . WHEREAS, a public hearing was held on said matter on January 22, 1974, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. The property consists of two lots separated by an alley. Both lots are zoned M-l. The lot at 418 North First is now developed with a garage use. The applicant proposes to develop the vacant lot at 412 North First with a similar facility for automobile repairs and use the two lots as one business. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or . welfare or injurious to the property or improvements in such zone or vicinity. -1- 844 r; / .," .. . ," . . , . 2.. The use applied for at the location indicated .is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping, and other features required to adjust sai,d use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. 6. The proposed use will not substantially increase . vehicular traffic on any street ina residentially zoned district. 7. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic. 8. The proposed use is not located near a place of assembly. SECTION 3. That for the foregoing reasons, subjec.t to approval of the City Council, this Commission grants a conditional use permit for the use of said property for a garage for automotive repair upon the following conditions": 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. . C.U.P. 74-1, except that five fully accessible parking spaces shall be maintained on the southerly lot (Lot 3). -2- 844 . . . . . ,- . . 2. All signs shall comply with Code. 3. The design and location of the trash enclosure shall be subject to the approval of the Planning Director. 4. All fixed mechanical equipment on the building shall be completely screened from public view. 5. Landscaping and irrigation plans shall be submitted concurrently with building plans for the approval of the Planning Department prior to the issuance of any building permits. 6. The building and all walls shall be constructed of material that matches the existing structure. 7. A three-foot high wing wall shall be constructed on the front setback line between each building and the alley. 8. No parking shall be allowed on the street or on the alley. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. January 22, 1974 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: CONDITIONAL USE PERMIT C.U.P. 74-1 412 AND 418 NORTH FIRST AVENUE APPLICATION This appl ication was filed on January 2, 1974 by P & F Motors and proposes to construct a garage for automotive repair at 412 ' North First Avenue. The applicants are also including their present automotive gara'ge at 418 North First Avenue in this 'application. PRESENT LAND USE AND ZONING The northern lot is developed with'~'automotive garage and the southern lot is vacant, and are zoned M~; property'to the north is zoned M-l and is developed with a'service station; properties to the east, wes.t and south are .zoned M-l and developed with re~idential uses. This project is in the redevelopment' area and, if approved, would be reviewed by the executive'director of the redevelopment agency for his report on what effect" if any the issuance of a building permit would have upon the redevelopment plan. HISTDRY On April 14, 1966, P & F Motors filed C.U.P. 66-10 requesting a garage-type development at 412 North First Avenue. The Planni,ng Corrmission at, its regular meeting of April 26, 1966 denied this application without prejudice because of insufficient lot area. The Planning Conmission further s.tated. in Resolution 588 "that the granting of.a,conditionaluse permit as,requested on such a substandard site would.be contrary' to. the' plan for the area, and, therefore, detri- mental to other properties and improvements in the area." The Planning Corrmission later granted a C.U.P. when p' & F Motors in May of 1966, submitted a revised, plan which used the ne~t lot to the north (418 North First, present site.of P & F Motors) for a garage development. In granting a conditional use permit, the Planning ~~ . . . C.U.P.74-1 2 Commission found that development of. this site (418 North First) would not be detrimental to the vicinity because the possibilities for consolidation into some ultimate. use of a suitable lot size was significantly limited by the alley on the south and the developed service station on the north. PROPOSAL AND ANALYSIS . The subject sites (412 and 418 North First) have a frontage of 53.65 feet and 50 feet respectively on First Avenue, and a depth of 135 feet adjacent to a 20 foot wide alley running the length of the property on the south and north., . For the purpose:of- meeting the minimum lot area requirement of' 15,000 square feet for development of 412 North First Avenue, as per Section 9266.2.3 of the code, the applicant contends the square footage of both lots should be included in the lot area calculations. If both lots were treated as one and their square footages totaled as the applicant contends, then these lots would comply with code in respect to lot area. However, in checking the Santa Anita Tract Map it was found that Lots 3 (412) and 34 (418) were subdivided into separate lots with both First Avenue and the alley that separates the lots being dedi- cated to the City at the time of the subdivision in 1887. From 1887 until tilis date, irrespective of ownership, the two lots have existed separately as Lots 3 and 34 of Block 83, Santa Anita Tract. The applicallt Ilas not submitted any material which would tie these two lots together and prevent them from bein9 sold separately as is now possible. On the basis of this application, staff feels it is Ilecessary to review each lot on its own merit. The lot at 418 North First Avenue is now developed with a garage use. The building contains approximately 2,240 square feet with the minimum amount of landscaping required by code, in front of the building. The balance of, the lot is covered with hard surface material. On-site parking consists of___four ~tandard parking spaces which meet code, and -two smaller parking spaces which would not count toward meeting the co_d~_ t:,equi renlents of six parking spaces. ""'"L _ ____ _~___ ___n ... The lot at 412 North First Avenue, to the south and across the alley is vacant., The applicant proposes to construct a concrete block building with a flat roof. The building would be rectangular in shape, 28 feet by 84 feet, with' approximately 2,352, square feet and would be positioned on the south property line behind the front setback. . . . . C.U.P. 74-1 3 The plans submitted by the applicant show three large garage-type doors to be used as entrances, each door faces, the alley and would pre- sumably be open during some portion of the' business hours. The place- ment of the, building is,such that,all three"of, the Vehicular entrances to the building would' be visible from the street. Proposed on-site parking consists of seven spaces, three of which do not conform with the code and would not count toward code requirements of six parking spaces, either because. of insufficient turnaround dis- tance or because one or more cars must be moved to permit access. Proposed on-site landscaping. consists of the minimum code require- ment of 1 0 feet, in the front setback. The rest of the lot wou 1 d be covered with hard surface material. The applicant.. proposes to construct a' six foot high block wall across the rear. property line and around portions of tre parking area adjacent. to the alley and interior side yard, similar to their existing development. ., . CALIFORNIA ENVIRONMENTAL QUALITY ACi (CEQA) Pursuant to the provi s ions of the CEQA, the Planni ng Department reviewed this application and determined that the pr.oposal would not have a significant effect on the environment. A Negative Declaration has been prepared and filed for this item. The Planning Commission in its approval or denial of this applica- tion must make the determinatton that this item would or would not have a substantial adverse impact on the environment. RECOMMENDATI ON The Planning Department feels the circumstances surrounding this proposed development have not changed materially since the Planning Commission~s denial of a similar application in April of 1966. Should the Planning Commission wish to consider approval, staff recommends the following conditions. 1..
