HomeMy WebLinkAbout0840 , . . , . , , . . RESOLUTION NO. 840 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING PROCEDURES FOR ADOPTING AND AMENDING THE GENERAL PLAN. WHEREAS, the Planning Commission on its own motion held a public hearing on December ll, 1973, to consider adding 'procedures for adopting and amending the General Plan to the Arcadia Municipal Code; and WHEREAS, all .interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF TH~ CITY OF ARCADIA RECOMMENDS TO THE CITY COUNCIL: SECTION L That the following be incorporated into the Zoning Ordinance of the Arcadia Municipal Code~ "DEFINITION: The term General Plan as used in the following sections shall include the General Plan or any part or element thereof or any amendment to such plan or any part or element thereof. The General Plan shall be adopted or amended 'in the manner provided in this chapter. The Planning Commission or City Council upon its own motion may initiate proceedings to amend the General Plan. Any interested person may file an application for an amendment to the General Plan. Before accepting for filing any application for an amendment to the General Plan, the City shall, for the purpose of -1- 840 . . . . . defraying the expenditures incidental to the proceedings described herein, charge and collect a fee as may be set from time to time by resolution of the City Council. Application forms shall be in a form and content approved by and shall be obtained from and, when completed, submitted to the Planning Department. A two-week period of time shall be provided between the adoption or amendment of the General Plan or element thereof and a proposal for rezoning for the purpose of bringing zoning into con- sistency with the General Plan. All proposed changes shall. be evaluated in regard to en- vironmentalimpact and consistency with the balance of the document. Public hearings for amending the General Plan shall be held quarterly in July, October, January and April. General Plan changes filed during each pertinent quarter shall be announced at the first Planning Commission meetipg after the end of the quarter and shall have a public hearing at the second Planning Commission meeting. The Planning Commission shall hold at .least one public hearing before approving a General Plan. Notice of the time and place of the hearing shall be given at least ten (10) calendar days before the hearing. The notice shall be published at least once in the official newspaper. In addition to notice by publication the City may give no.tice of the hearing in 'such other manner as. it may deem necessary or desirable. Any hearing may be continued from time to time.' -2- 840 . . . : . . The approval by the Planning Commission of the General Plan shall be by resolution of the Commission carried by the affirma- tive votes of not less than a majority of its total voting members. The Planning Commission upon the adoption of a resolution approving the General Plan shall transmit said resolution to the ci ty Council. Before adopting a General Plan the City Council shall hold at least one public hearing. Notice .of the time and place of the hearing shall be given in the same time and manner provided for the giving of notice of the hearing by the Planning Commission. In addition to notice by publication the City may give notice of the hearing in such other manner as it may deem necessary or desirable. Any hearing may be continued from time to time. In adopting a General Plan which has been approved by the Planning Commission, the City Council shall not make any changes or additions until the proposed change or addition has been referred to tne Planning Commission for a report and a copy of the report has ~een filed with the City Council. Failure of the Planning Comm~ssion to report within forty (40) calendar days after the reference shall be deemed to be approval of the proposed change or addition. It shall not be necessary for the Planning Commission to hold a public hearing on such proposed change or addition. The adoption of the General Plan shall be by resolution of tne City Council. The Planning Commission finds that the public necessity, convenience, general welfare and good zoning practice justify the above recommendations. SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Motion was made by Commissioner ,Erickson, ,seconded by Commissioner Perl is to close the public hearing on LA. 73-12. Motion was"'passed'by voice' vote 'with none dissenting. Commissioner Hegg commented that the accumulation of possible plan' changes was certainly beneficial. Commissioner Perlis questioned if there was nothing in between notifying persons by mail or by paper? Mr. Woolard said that they could post the property. There was further discussion regarding notification of public hearings. Mr. Erickson suggested, that they have. the meetings the second'meeting after April I and October I and announce at the first,Planning Commission 'meeting before those dates what areas a're up,for,adjustment. ,He,also,'commented that he felt six months was too long a wait between , meetings and . felt that the"meetings"should-be held more frequently, perhaps quarterly. Commissioner Coghlan concurred with Mr. Erickson. Commissioner Per lis. commented that the six month period was not to discourage appli- cation but gather these things together because they did tend to 'affect one another. Commissioner Reiter remarked that,in,changing the General Plan she thought they should consider,that this is a document that, should not,be changed willy nilly; but did feel that six months was too ,long and that perhaps they should be:reviewed quarterly. She suggested some alternatives to ,notification of,thepublic hearings such as 30 days advance notice, or perhaps noticing, in the city. newsletter. 'She:"f'urther suggested that the paragraph in the middle of, Page 2, beginning "No hearing..." ,be stated more positively such as "that a two week,period of time shall be provided between the adoption or amendment, of the General Plan 'or element thereof . and 'a 'proposal for re- ,zoning for the purpose of. bringing, the zoning into, consistency with the plan." " Chairman Huddy agreed with the.public hearings being held quarterly. He did not think 30 days prior notice was,goodbecause' it would,not-bekept fresh in the minds of the people.
